Yes, they would, the defendant always has to be present in the courtroom for jury questions, even simply when the jury asks for a break. All participants must be in the courtroom.

Until the jury reaches a verdict, there can always be a plea *if* the state offers one and the slayer accepts it.

This is very odd. They usually only go back with the defendant if they need to have a discussion with him, where all parties can talk freely, and the defendant has some decision he has to make (and be fully informed by his attorneys about). I wonder if it's juror misconduct, or plea bargain (I didn't think you could do this once submitted to the jury), or something else??

Wow, I have always thought that once the jury began deliberating all deals were off the table and it was solely in the hands of the jury from that moment on. Thanks for the insight.

What would be the benefit of a plea at this point. He's close to maybe being a free man (I doubt it, but always a chance). And it's not DP, so what would be the point?

My stomach is churnning. We need a 'Beth Karras' to be giving us a blow by blow of what is going on in the courtroom. If Raleigh, Wake Co. is going big time, we need an announcer.

Wow it's a weird morning. Over at the Casey Anthony trial, she tried to pull the crazy card (incompetence) and was evaluated by 3 shrinks over the weekend. The judge ruled she was capable of standing trial (now that it's almost over).

Yikes!

benefit?

less jail time for slayer (10 - 20 yrs instead of LWOP) and state gets the slayer in jail. This is if neither side is confident in what the jury will do and each wants the best...considering the alternative.
