this is just my amatuer opinion of body language but the pros team is just sitting back in their chair relaxed, something routine to them.

the def on the other hand, JY is leaned forward with his elbows perhaps on his knee/legg, while one of the def guys is sitting forward in his chair, (seems nervous to me) and the other guy sitting back in his chair and he's close up to the def table.

Hmmmmmm................does this sort of thing usually bode well for the pros? is that why the def side looks a little more rattled? or is that just the MO for the def because they have so much at stake, the freedom of their client?

just wonderin'

I believe the defense is hoping for a 'miracle'.

I remember the ADA's looked pretty relaxed in the pics and little bits of video I saw during jury watch in the last case. They were so confident and I was chewing my fingers down to the knuckles (and then turning to massive amts of chocolate).

I think this team feels confident as well. They have the burden but they appear to feel strong that they met that burden. The defense team doesn't look so confident, do they? Perhaps they're expecting bad news.

Yes, if he had testified that he grabbed a rock, it would have been more believable. He was trying too hard to separate him from the evidence, IMO.

That is EXACTLY! what I thought when I heard JY said the 'twig,' or was it 'branch?' Anyway, trying to separate himself.

It would have been believeable, POSSIBLY, had he said he did use a rock and FORGOT or musta' forgot and that's what the night-guy found.

That one item, in and of itself, to ME, made all the difference on wheather to believe him or NOT. Sorry, made all his other EXCUSES seem just as lame.

Defense exhibit photos 102, 103: Thanks to Just the Fax for posting these images on Wednesday. I put them side by side, and adjusted the exposure on both. The video still was overexposed, so I reduced the exposure of that image and increased the exposure on the party still. When I looked at these a couple of days ago, I first thought that the collar was clearly different, but I also wondered if Jason had a shirt collar on the video still and a t-shirt collar on the party still - accounting for some difference. Even when they are both B&W, they seem to be different colors with the party shirt being darker.

Looks like different collar and you are right I think about the color too. :rocker:

Hey gracie,
fran is going to whupp us if we keep talking about this but RG took an Italian 'fast track' trial instead of a 'full trial' like AK and RS. No plea deal. Sorry fran... no more I promise.

Bring it to the AK thread!

Thanks for the correction, I thought that was the Italian equivalant of a plea deal.

The stripe across the front of the Bday top is higher than the one at the H.I. There are several notable differences. Hopefully the jurors will understand it too.

I still chuckle about the Mr. Fantastic comment in the state's closing.

I can't move from here during verdict watch! :banghead: Finally figured out how to have two screens up at once, half courtroom, half WS's. And I don't want to lose either. :maddening: Plus I have the ICA trial on the TV. My husband knows better than to interrupt any of this *important stuff*. :floorlaugh:

Last trial verdict watch I was digging into the chocolate--actually I fell into a vat of chocolate and ate my way out. This time (today, at least), I've been eating whipped cream. Make of that what you will. A daily gym visit of at least 2 hrs will be required for the rest of the year.

I DEFINITELY see these are two different shirts.

Shirt from the bday party is darker, plain neckline, and the stripe is almost invisible as it's color difference from the FIRST photo, taken the night of the crime from the HI

In the photo from the HI, that shirt, sweater, sweat?, has a little dip in the center of the front neckline.

IMHO, there's no mistake. They are NOT the same item of clothing.

Oh god, if I was a lawyer I'd weigh 300 pounds. Just thought of that when you mentioned the massive amounts of chocolate! :banghead:

Is the sound off on everyones feed?

The defense should have simply let the 'shirt issue' drop, rather than bringing for a photo of JLY in a completely different shirt they are attempting to 'pass off' as the same shirt IMO.

LOL. Good thing I don't follow many cases, and I only get emotionally attached to 2 or 3 every decade or so. This one isn't as bad for me as the last one.

Oh, sorry. FWIW, for those who don't have video. Although I have the sound on, they must have the mics in the courtroom off.

Anyway, the jury is done with handouts and now are on the few items needing to be viewed by video. I even think they're done with that now. Just see the pros sitting at their table, the judge is not in his seat, and the def attorneys are sitting behind the pros, they were all in a position to see the visual that was directly in front of the jury. Not sure what's up now.

Oh, looks like they're looking at more items now. Can't see what they are from our viewpoint but you see the frames changing.

fran

eta...........seems the attorneys from both sides are kinda' looking at the screen, kinda' sideways for them. Actually, I think they're both studying the jury, they keep glancing at them. that may be why the def attorney is sitting behind the pros, getting a better view of the jury faces. imho (it's the heavier set gentleman/def attorney that's sitting behind the pros)

Panned over to JY, he's still hunched over in his chair. He must be worried, IMHO.....

The juror's appear to be looking at each photo on the tv or whatever it's called, almost painfullly slow. If they're actually slowly changing the picture, it must be when I blink! LOL.

I agree. I think the jury will see that as an attempt by the defense to pull one over on them and will lose credibility. Guilty verdict at 4:30.

I personally am not as clear on the 'abundant and clear circumstantial evidence' that resulted in the guilty verdict in the Kercher murder.' I am positive Rudy was there and participated in the killing, but he took a plea bargain.

It's more difficult to be aware of all the evidence when the trial is conducted in a foreign language over a period of 11 months, but there is an equal abundance of evidence (note: no plea bargain in that justice system). After a few weeks, we heard nothing more than circumstantial evidence in the murder of Michelle Young. Even with the absence of DNA, hair or fibers from Jason on the victim and no injuries to Jason (even though this was a violent, brutal attack), his alibi is dismissed and the assumption is that the jury will arrive at the "correct" conclusion that he is guilty of murder.

To quote Madeleine74 (post #7): "I too am amazed at the gullibility and sheer ignorance of so many who do not understand circumstantial evidence, reasonable inference, don't actually follow a trial and yet claim to know what the proper verdict should be"

I especially thought this comment was relevant in terms of respecting jury opinions. As I mentioned, I really enjoy the insights that Madeleine brings to the discussion (Cooper trial post-verdict):

I respect his position and understand his reticence.

We have to remember there are people out there who are not of sound mind, and who believe the whole justice system (including any jury members) are hellbent on throwing innocent people into prison, just because they feel like it.

Some people threatened to 'out' the jury after the verdict, some talked openly of wanting to do screen captures off of the media feed, when the jury was seen leaving the courthouse, and plaster those pics on the Internet. Some are now trying to prove juror misconduct because this particular juror happened to be at a hockey game the same night as the victim's parents.

The vitriol spewed towards this jury through social media sites has been sickening, and it continues to this day. Fortunately none of that nonsense is allowed on WS.

I hope the jury members will all be safe from the 'crazies' out there. I also hope they'll feel comfortable, as time goes on, sharing what this process was like for them and what evidence made the most impact.
