Husband of missing Clarkston woman arrested on ATF warrant

The estranged husband of Rachael Anderson was arrested at 10 a.m. today at his business in Moscow on a Bureau of Alcohol, Tobacco, Firearms and Explosives warrant for allegedly violating federal firearms laws.

The arrest of Charles Capone was confirmed by an ATF spokesman in Boise. Anderson, 40, of Clarkston, has been missing since April 16 and was last seen in Moscow.

Anderson was in the process of seeking a divorce from Capone.

Him being aressted doesn't explain away not giving out the info nessicary to find Rachael.

It just means that in looking for rachael they found something else. If he was ever convicted of a felony he couldn't own firearms, so even finding a firearm at his business would be a violation. It will be interestng to see what happens in the media from here.

ATF does NOT issue a warrant for a COUPLE of firearms!!!!!!!! It would simply be a parole violation. Is this what Rachael knew about that put her life in danger?

  • Persons subject to a court order that restrains such persons from harassing, stalking, or threatening an intimate partner.
  • Persons convicted in any court of a misdemeanor crime of domestic violence.
Persons under indictment for a crime punishable by imprisonment for more than one year are ineligible to receive, transport, or ship any firearm or ammunition. Under limited conditions, relief from disability may be obtained from the U.S. Secretary of the Treasury, or through a pardon, expungement, restoration of rights, or setting aside of a conviction.

Anyone who has been convicted of a felony is banned by federal law from ever possessing "any firearm or ammunition." Specifically a person "convicted in any court of a crime punishable by imprisonment for a term exceeding one year" cannot possess any firearm in any location. 18 U.S.C. 922(g) is the federal law that prohibits anyone ever convicted of any felony to ever possess any firearm either inside or outside of his home. The federal punishment for felon gun possession is up to 10 years in prison.

That is even one gun.
And ATF hes local LE enforce everything from gun licensing on up.

OMG.... PLEASE let this bring more, I remain hopeful although I am HUGELY stumped that it is what they arrested him for, unless its just to start little and work their way up to bigger. I am scared. Not even going to lie on a public forum where no one knows me.

He was no longer on parole or probation. If he has ever been convicted of a felony it is a violation of Federal law which would lead to ATF being involved. Even for 1 firearm.

Five days later she filed for divorce from Capone, who she had been married to for three months.On April 28th, about a week after Anderson was reported missing by her daughter, a man went to the Moscow Police Department to report that he had given Capone a Lock Model 22 .40 caliber pistol as collateral for a Dodge Dakota pickup truck he wanted to purchase from Capone.When the man decided he couldn’t afford the truck he went to get his pistol back, only to be told by Capone he had taken it to a friend’s house for safekeeping but that friend was out of the country so he couldn’t get the gun back. Capone later purchased the pistol from the gun’s owner, which under law he was not allowed to do as a felon.The next day, April 29th, task force investigators looking into Anderson's disappearance searched the home of the man that Capone had been living with from early February through April of this year. The man let him stay temporarily as he knew Capone was having marital problems. In mid-February the homeowner says that Capone brought a Glock pistol to the home and, knowing Capone had ongoing marital problems, volunteered to store the pistol for him.The man also said that Capone had taken the gun with him in mid-February down to Lewiston to follow her and figure out if she was seeing someone else.

Looks like the cops were working! This is amazing news. Saddening news. Dis-hearting news. But I believe it will lead to finding out what really happened to Rachael.
