Did the family ever go on vacation when they were together? If so, was it out of State, country? IIRC, Julia has family in Canada. Did Sky ever leave the country as a baby? Did he have a passport?

In a very early press conference, LE stated that Sky did not have a passport.

She did admit to that (or so we've heard) but there's questions about how long Sky has actually been missing (and, we've all learned how reliable, truthful, and accurate JB's words are). Sky may have been missing since June, July, August, September....who knows at this point? JB is saying she left him unattended during the mediation and she's saying she left him unattended in the car that day. But, we can't prove it because we don't when Sky actually disappeared. And, frankly, she says a lot of stuff that isn't true. So, if she's convicted for neglecting him during the mediation but it later comes out that she "disappeared" him months prior, then what? It can't be both. I'm in no way a legal expert, but I just can't see how you can charge someone with two crimes that might be mutually exclusive.

That said, I think they should proceed with neglect charges for M in regards to leaving her unattended during the mediation and for not feeding her to a very severe level. There's evidence for that and no potential for double jeopardy. Believe me, I think JB belongs behind bars at this point.

Hopefully, Gitana or someone else with legal expertise can shed light on this. If they charge JB with neglect for Sky but he was actually "disappeared" months prior and they find this out after she's already been convicted for neglect, can they charge her with murder? Does the conviction for neglect get dismissed? What happens? Also, would a prosecutor be likely to move forward when the only proof is the mother's word (which she may later rescind)? Thanks in advance!

There are two processes involved in "charging" someone with child neglect. There can be a "founded" allegation of child abuse/neglect on someone's record with CPS (aka DCFS). That is a separate issue from charging her with "criminal neglect" which involves the court system. I am certain that JB has a "founded allegation" of neglect with regard to MM. As SM had been reporting that JB would refuse to provide appropriate foods and he did put in his declaration that she cared more about cleaning the countertops than feeding his daughter. When MM was placed into care she weighed 29# and quickly gained weight once she was removed from JB's primary care. That info is no doubt recorded in her CPS file, as well as her not attending any of her visits with MM. If JB does not comply with her court ordered services . . . she could potentially have her parental rights terminated. She has one year (from the date MM was placed out of JB's home) to complete all of her services including regularly attending her visits with MM.

She would be appointed a public defender to represent her in court for the CPS actions. This is a completely separate process and issue than the criminal charges she could still face through LE and the prosectuing atty's.

According to this article, SM prevented JB from obtaining passports for either of the children. She also couldn't cross the state line with them (though how could that be enforced given that seemingly no one was keeping tabs on their whereabouts or well-being).

Solomon Metalwala had blocked Julia Biryukova from obtaining passports for the children or traveling with them out of state, according to attorney, because of fears that she would disappear with the children.

I think there might be some confusion about when Sky was actually born. Most sites and all the posters I've seen say 10/2/09. But, some sites say Sky was born in September of 2009 and Solomon himself said in his declaration: "In September of 2009, our son was born, but that did not solve the problem." It's a small detail but it may be worth something later.

Wish they could find this little guy, but Julia, who knows where he is, won't tell because she would lose her freedom. Sky was a beautiful child, and Julia cut his life short to satisfy her own need. She punished Solomon in the worst way by destroying his son, yet she remains unpunished. I hope this darling child is found soon, along with evidence that will put his murderer behind bars forever, so she can't produce any more babies.

My husband had it in his co that his ex wasn't allowed to take their daughter to another state for awhile (she had family in that state and one was being investigated for sexually abusing her). We had a guardian ad litem at the time who gave his ex permission to take the daughter to that state, but not to XX city where alleged perp lived (wanted to add in here that the gal did NOT have the authority to do this - only a judge can change a co). His ex did take his daughter to the state, and even to the city she was not supposed to go. We even knew she would do this but there was nothing we could do to stop it. Of course his daughter told on her mom as soon as she got back. My point is, having that stipulation in the co doesn't prevent the parent from taking the child out of state, it only gives you restitution afterwards (if you find out, in which case you can file contempt).

That's not exactly true. There were people who thought they recognized Shawn and even asked him if he was Shawn. He said he wasn't and they apparently believed that and never contacted police or his parents.
