Watching Motions Hearing Live on Friday 10-10-08 - # 2

IMO these were the most important issues.
1. Motion to seal
No ruling yet, will be heard at a future court date

If he wins on this one, we will lose any ability to get info on what is happening.

5. Motion to compel department of children and family records
Denied, Baez has to retile

He will eventually get this one anyway since it most likely relates to the neglect charges. But I do have to wonder if there were any previous investigations either of Casey or Cindy.
8. Motion for allowing defendant to travel to places of interest
No ruling yet, will be heard at a future court date

If Fla gives her this one, I am going to seriously question the purpose of bond/house arrest in Fla. Is it really meant to protect or is it a means of raising funds for the county. I mean what is the purpose of putting her into electronic monitoring if they are going to allow her to take it off whenever she wishes. They have talked about how much monitoring costs the county. So why pay to put it on her if they are going to allow her to take it off when she likes?

So when the next person suspected of killing someone and pays their bail, if they decide they don't want to stay home, will Fla. allow them to get out and run around doing as they please?
After all, they will have their bond money.

I agree with you, but wanted to comment on #5. Baez may get this on down the road, I don't know. I don't know what obligation child services may have in releasing this type of information. The bad thing about the motion though is, JB filed the motion against the state when the state doesn't have the authority to comply with such a request. He did the same thing where the FBI was concerned.

agree with the state, why did Baez need all this now for a child neglect case.
But, he would have gotten it next week anyway, so whats a week?
Im just glad she cant travel, and I really dont think the judge is going to allow it and she will be going up for murder charges anyway so it wont happen.
She will be in jail next week for good.

Is it possible he was using the majority of his requests as a smoke screen around the travel and and privacy motions? Really, these were the only important things he asked for today. Hopefully the answers going to be a big N_O! :nono:

Everything else will be a given once she's indicted, Judge S handled JB really well today. :weaklink:

I was just looking around for the video of the bond hearing and found an article from July 25th. http://www.wftv.com/news/16991834/detail.html It looks as if Jose has been wanting to go on this field trip for a long while. I find it funny that when it came out this time everyone said it was Casey wanting to go look for Caylee.

Very good analysis Nancy. I watched most of the hearing and saw the same things you did, then see the news reports about him "winning" some of these and couldn't believe that's the way they were characterizing them.

In my opinion he did not score very well today, despite what the press say. And he made himself look kind of foolish and unprepared.

Same. Thanks Nancy for posting this, I thought I mustabeen dreaming when I watched (some of) the proceedings, because there were so many restrictions on what Baez "won" that it wasn't much of a win, but that's not how the media was portraying it.

I thought the Judge was almost coaching Baez in what he should be asking for, "so... you are asking for xyz then?" Baez: "Uh, yes sir".

If JB was so worried about KC's safety, I would think that he would not want her travelling back and forth to his office every day and to "places of interest". I would think that the safest place for her to be would be in her house 24/7.

Good point!

Although I personally think she probably *should* be allowed to show her attorney where she went with LE before she had representation.

But someone else should attend, as well, and imo, only places she WENT with LE, not whatever she declares a location of interest.

Anthony, though given a temporary release from house arrest to attend the hearing, was not present. Black said the defense never intended Anthony to attend the hearing, saying they wanted to show the judge how much the media attention her movements attract.

Nice litle stunt on Baez part

sooo... Here we are on monday and, no surprise to many of us, we hear we won't likely see any rulings from Judge S today... Looks like TurboThink was right when saying during the last thread for this topic we won't be getting any rulings until later in the week....

GREAT tactical legal maneuvering by Judge S, if you ask me: he doesn't issue any rulings that could potentially be challenged and/or overruled by a higher court... and by the time he does get around to issuing a ruling(s), perhaps we'll have a GJ indictment!

Why is it everything he does seems so under handed? He always has an ulterior motive.

Does he think Judge S isn't aware of the media following his client around?

I give up...

Go all the way down half way is snippet

:snip:
A judge ruled Wednesday on some of the motions filed on Casey Anthony's behalf. Two of the motions have been tossed due to her new arrest on murder charges.

Casey had asked the judge to seal her weekly schedule and to travel to locations of interest in the case. The judge said those points are moot now.

There was still no ruling, though, on the appeal by defense lawyer Jose Baez to do his own testing on the evidence in the case.
