If by Monday, KC takes the plea agreement for check fraud...will that mean she will be finally going to prison (instead of Orange County Jail) and how will this bode for the future?

why? If she is convicted on fraud charges...this ensures a prison sentence...does it not? Would it be special treatment for her to be in the nice county jail....close to her home, in solitary?

My sense of things is that she will get time served on the check fraud. Regardless, she will remain in jail up until and throughout her trial. She is being held without bail on the murder charges. If she is not sentenced to time served and JS gives her more time, he could always sentence her to serve it in the County Jail in lieu of prison. We will have the answer to all things check fraud on Monday.

I shouldn't post this as I have no link. I read in one of the papers that Orange County jail also has prison facilities,I believe for short term prisoners.Once she is convicted she will no doubt go to Lowell which is no palace,look it up (google)..

I believe it was at the December 11th hearing JS told JB that because it was her first offense he would probably give her time served. So the judge basically offered it to KC that day. I think he would prefer KC came before him instead of a jury trial as he is willing to be fair and just wants this out of the way to focus on her murder trial. Since KC has put it in writing that she does not trust LE or SA it was nice of the judge to offer, don't ya think. Don't think the judge has made it to KC's version of the A's "do not invite" list, yet. JMO


I don't think she should be given a break of any kind. If she just gets time served it is like there was no punishment at all which is how it has been every time she has stolen for years. Never any punishment. I just wish the judge wouldn't do that. I also wish he would have made her go before a jury. If the judge starts giving in to every thing that Casey wants she is going to think she has him in her pocket. If I were Amy I would feel cheated by the system.

The defense doesn't have to take its chances with the judge; it could go to trial. But Sheaffer says taking responsibility for the crime usually brings a lighter sentence.

Yes, I do..... with a hair toss before, during and after. Andrea has explained to her that there is no other option. The stardust that used to be in her eyes when she looked longingly at Baez has cleared since Andrea has taken the wheel. Casey sits there in court time and time again and see the defense give its best shot to hammer at all the technicalities only to find that while Andrea's arguments may be persuasive in her county where she is learned, they have no relevance to Florida law and they fall flat with the judge. Even at 23 years old, it must be painfully obvious...the fact that Andrea is not going to be able to work miracles, as she was likely presented by Baez. Casey sits in her cell 23 hours out of each day, that is a lot of time to go over what happened in court and come to understand things are a lot different now than a year ago when she arrogantly told Tracey that she will get a COV, a mistrial or off on a technicality. Day and night. Especially after the smack down that Mr. Ashton gave her in the recent hearing. The fog has lifted. Her own Andrea has been on national TV saying it is a hopeless case. Casey is visited often by the mitigation specialists that spend hours with her preparing for the penalty phase, that has got to be sobering, even for someone delusional.


The prosecution will argue, vehemently, that she should not benefit from any deferred adjudication, the judge will concur and we be able to move on to the murder trial. I hope.

I do think Casey may be still holding out hope that any conviction in the murder trial could very well be reversed on appeal, but I imagine she is resigned to pleading guilty on the fraud, and she sees that the judge is giving her a GIFT of only timed served. In fact, since they never deposed Amy I think the defense had this well decided that she would plead guilty some time ago. With or without any mention of the stealing in the murder trial, as Doogie's girl points out there is a mountain of other very compelling evidence. I am hoping the judge says no to the defense motion to allow the deposition to perpetuate Kronk's ex wife's testimony. Once that gets shot down too...we are one step closer to a no nonsense trial and justice for sweet, innocent, helpless Caylee.

As you said, the defense choosing not to depose Amy has been a red flag glaring at me for quite a while.

Andrea Lyon is a serious woman. She has provided a much needed reality check for KC. She's has made it clear that this is no longer about CA/GA looking the other way or friends who accept, ignore & fail to confront her on her constant lies. This is about the people of the state of Florida who are holding her accountable for the murder of her precious daughter this time. She should be scared senseless.

In re. Judge Stricklands gentle nudge to strike a plea deal in the check fraud case and pretty much telling the defense what they could expect her sentence - I don't have a problem with the 'time-served' sentence, if that indeed happens. I think it is probably a pretty typical sentence for anyone else with no priors, so I consider it fair. The check fraud sentence is small potatoes in the grand scheme of things and JS knows that. He wants to get on with murder trial, stop all the pettiness and these silly delay tactics and move on.

Still struggling with what Casey's plea will mean to her murder trail. Suppose she gets the time served and has the convictions on her record, but set aside until after the murder trail? I'm looking for ways this is going to back fire for the defense. I have complete trust in JS. He will know how to handle his decision and get Justice back on track.

A great idea was posted on Sheaffers blog that all anti-KC attendees should sit on the Defense side of court so that GA and CA are forced to sit on the State side, so that they implictly support Caylee.

given the way judges are being idiots in other cases posted here lately (60 days for rape, 10,000 bail for a child rapist, 2,500 dollar bail for a criminal who was on the run for years) i wouldnt be shocked if they make a clerical error and her time served results in her accidental release.
