What Is the Defense Strategy #2

  • #481
Sounds to me like she is going to say it was an accident and she couldn't tell them because she was afraid. Hello? You've been in jail 3 years because you didn't want to admit an accident...i don't think so? And I don't buy she was afraid of her family...she didn't act timid around them, she ruled the roost. If it were an accident why couldn't she have admitted it prior to this? She was safe in jail for 3 years, away from and refusing to see her family anyway. Seems to me the abuse has always been on GA, CA & LA, not ICA. My head is spinning.:banghead:

This is their best shot IMO its to say it was an accident vs the other stories they have floating around. Do you think they want to plea to a lesser charge and the DA refused?

I think one of the Defense strategies is to stall, delay and postpone the progression of the forward motion of everything. I think they are in somewhat of a panic as the " time frame " of ICA 's premeditation has already been upon them, execution of her crime and the 31 days that followed are rapidly approaching. I don't think they are that arrogant that they believe that ICA will be able to hold it together in court through the 3 yr anniversary of each and every step of what she did! Although time has ticked by and she has had to relive her actions anniversaries twice before, she was contained in a very closed enviroment with her small cell and 4 walls to protect her. She could act out anyway she wanted to with little to no witnesses. This time she will bbe in a crowded courtroom with tons of people and cameras staring right through her. Knowing that the Prosecution can stand up and clearly state and prove " today is the 3 rd anniversary of the exact date that ICA murdered Caylee ". And this is how she did it! ICA will know that every eye that is on her no matter if in the courtroom or by camera knows what she did and tried to hide and get away with......One only need to ponder how she will handle this.......I'm not fooled ,as many are that ICA has ugly coping or anything else that prevents her from remembering everything down to the tiniest details of exactly what she did. Her lies are way too detailed down to the tiniest thing this just proves how detail oriented she is by nature. I think the DT knows this will be a huge problem and they don't know what they will do about it as they really have trouble trying to contain her behaviours. That's why I think they will prefer to have her tucked away and out of public view until the totality of the time frame of her crime has passed by for another year........JMHO

In reading several threads tonight, and going back through the litany of Mitigating Factors AF ran through yesterday in her questions (sexual abuse, brain development, etc etc) then finding out who Ms. Bolin is........well the loose ends are beginning to come into focus for me.

And the fact that Larry Garrison isn't out of the picture evidently either....run through this thread for insights. [ame="http://www.websleuths.com/forums/showthread.php?t=135955"]Rosalie Bolin - What is her role? - Websleuths Crime Sleuthing Community[/ame]

I still say that the A's will catch the 'abuse' claim, but I am also thinking that the Grandfather will catch the 'brain development' claim - he was ICAs babysitter when CA went back to work initially - and he cannot defend himself against a proposed theory that ICA as a baby was dropped. I still don't see how they will get in the claims without having some psych testimony, but I know have a better understanding of why they wanted the testimony dropped because they didn't want to have to deal with the professional theories of her symptoms, they only wanted the story that ICA told them...........still not sure how they'll get that into the testimony.

During the Frye hearings, I watched KC look cold toward GA when he testified, she cried when CA testified, and she looked downright angry when LA testified. At the time, I couldn't figure out her behavior and now I think I've got it!

She is playing the abuse victim. She is now showing that she's upset with GA and LA for their abuse and crying because her mommy didn't do anything about it. "Oh Mom, why didn't you save me?"

I think they are going to say that Caylee's death brought out the truth of her past and now she's well aware of those suppressed memories. That is going to be used to explain her behavior for the 31 days. And then the defense will argue the evidence as not being connected to KC whatsoever and someone else killed Caylee.

That's my theory for today. It may change next week though. :dunno:

How can they claim sexual abuse/molstation? Didn't Cindy tell her brother and the doctor that it was impossible that Casey was pregnant because she was a virgin? :waitasec:

Sorry couldn't stop laughing.

How many months gone was she at this point?

Perhaps the prosecutors just need to resurrect some of the family photos or videotapes where Casey is seen smiling from ear to ear and hugging her brother -- errrrr her molestor. (See my avatar that I just changed for that reason). Explain that, Casey... is that poor coping skills or brain damage? Name your poison. I also rewatched a video of George visiting Casey in jail back in August of 2008 and Casey is telling her father how much she misses him and loves him (blah, blah blah). That video does NOT look like how someone who was allegedly abused by him would/should act. But that's just my opinion...

She didn't just kill he daughter. She put duct tape around her mouth and some sort of a silly sticker on her mouth. She drove around with her dead body in the trunk of her car for several days before she mustered up the courage to fling her body (in a plastic bag) into her neighborhood dumping ground. Ah yes. Poor abused child that she is...She should really be excused!

Go Defence Go. Only the stupidest of jury pools could possibly buy into an "abused child" excuse for such a horrendous crime!

Explain away everything. This woman has explained everything and she will get the death penalty even with the most uneducated jury pool possible!

I can't wait to hear JB's opening statement. He's set the scene and I will be there!

I think that she will say that she was being molested by either/both LA and GA when she fell pregnant. She will say that she didn't know if either them might have been Caylee's father and that she hid the pregnancy as a result of this. She will also state that the entire family knew of this predicament. This will explain why she hid her pregnancy, why her mother consoled her and felt obligated to her, why they all "covered" their respective azzez to support her and why, ultimately, they supported her over Caylee.

Casey was at a family wedding in June, [baby was born in August], and was visibly pregnant. Cindy denied it to her brother Rick, and said it was impossible because Casey was still a virgin.

That is kind of funny because she had a very close relationship with her bf, Jesse Grund. Why would Cindy think she was still a virgin?

And don't forget the "high five" to her brother when she was out of jail.......

If this is the DT strategy, they need to reconsider it. MOO

I think the strategy is that ICA killed Caylee (I don't think they can get around that), but they are going to say that ICA was abused and has mental health issues. As they are questioning potential jurors, this seems to be a recurrent theme. I could be off base, but that is what I'm reading.

That's what it sounds like.

Casey killed Caylee due to her inability to control her impulses but that is because Casey was sexually, emotionally, verbally abused and not protected by her family..oh and something happened when she was young which caused brain damage.

Exactly! In fact earlier this morning I was actually collecting photos/videos and documenting anything I could find of her "contradictory" behavior ... for someone supposedly abused by either Lee or her father the pictures proved otherwise. But hey, what do I know... perhaps that's normal. NOT!

It does seem like they have a mitigating factor for all occasions. Not just one, they have one for every thing she has been charged with...like Casey's bedroom makeover...over do much?

I don't believe it's normal either. In addition, she was still living at home with her daughter, and having her father care for Caylee. If there had been any sexual abuse by her father, one would think she would get as far away from him as possible, especially since the "norm" is the pattern would continue with her own child. MOO

I agree. If her family were so horribly abusive why would she let Caylee stay there her entire life?

There is also one photo specifically of her brother holding Caylee (and there are probably others) -- and if he had truly abused her, I know I wouldn't allow my child anywhere near that person. So go figure.... Cos I surely can't... LOL

This has bothered me from the beginning....IF in fact it was an accident....and the duct tape "magically" appeared...AND, just happened to place itself over her mouth, such that it held her jaw to the skull....I don't care how "abused" or "mentally compromised" KC supposedly is, IF it were an accident....and obviously it's either an accident OR outright murder....I can't for the life of me figure out how her defense, in good conscience, can allow her to continue with this nonsence.
I understand it's KC's decision....I also know GA had mentioned something to the effect of "she'll lie right till the end" or "till she can't go any more"....or something like that. So, in effect, she's playing "chicken" or Russian Roulette with her life and the courts patience.
Does CM realize that his client is the MAYOR of "Idiotville"?????
AF keeps talking about "mercy"....how about her client admit it was a HUGE mistake/accident...throw herself at the "mercy" of the court....explain what happened...and do it as quickly as possible...it may not be too late.
If they go ALL the way to the "end"....the WHOLE state, the judge, the SA, etc. is gonna be mighty PO'd and she's gonna get the max, IMO...AND....I'll bet my bottom dollar...the judge will have all the charges she's found guilty of run "consecutively"...by the time she's out, her arthritis will prevent her from any "Hot Body" contests or pole dancing.

Oh, nevermind.....how many more perspective jurors have to say she's "guilty" before they realize the "accident" theory is leaving the harbor AND those "mitigating" circumstances will do absolutely NOTHING for her. JBP has NO qualms about giving the death penalty!!!

Throwing another theory out here. What if KC was pregnant by BS and as soon as CA found out she went livid. CA insisted if the daddy wasn't going to step up then KC could not bring another child in the house and said that KC should have an abortion.. KC confronted BS and BS said he wasn't ready to be a dad and that she should have the abortion. There went KC's chance at getting out of the house and having a family. She then had the abortion, which her mom pushed. Then she went over the edge. In the KC's mind if CA didn't want her to have another baby, then she didn't really want Caylee either.

The defense's strategy is easy "baffle 'em with BS"... "smoke & mirrors"... "we ain't gotta' prove a thing"...."defendent does not need to defend"...."State must pay"...."blame someone/something else for her actions"... will it work? I hope NOT...I hope that my fellow "Floridians" will have enough brainpower to be able to separate the "wheat from the shaft" and see the "truth" even though the "truth and Ms. Anthony are total strangers"...(JP Strickland...)
