After questioning, Timothy's attorney, Donna Kuchler, argued that while Timothy did instruct the three boys to carry wood as a punishment on April 20, there was no way for Timothy to know that Damian, who was 14 at the time, would become so violent toward Ethan and his brother.

However, Assistant District Attorney Jill Vendetti argued Timothy knew about Damian's behavior toward the younger children and continued to leave Damian in charge of making sure the children finished their punishments in his absence.

Manitowoc County Circuit Court Judge Jerilyn Dietz ruled that Timothy stand trial because she was convinced that "a felony probably happened and (Timothy) probably committed it."

An arraignment is set for 1 p.m. March 20 at Manitowoc County Courthouse....

Dietz ruled against the motion to dismiss the criminal complaint, saying that while the circumstances are complicated, it is in the nature of the laws to be applicable to varying circumstances."

Yeah, sure. 14 years of living with him, raising him and there was "no way" he could know his kid had a mean streak? The kid who has a photo of some sort of automatic weapon featured on his FB? GMAFB.

I'm glad the judge ruled against the motion to dismiss; let the court and a jury decide how well TH "knew" his kid. DH learned his behavior from someone, somewhere. We may hear more about his violent behavior before this case is finished. MOO.

Interview of Child 1

“6. … Other times, DAMIAN is given the responsibility to monitor the children and make sure they complete the punishment. TINA is aware that TIMOTHY utilizes this form of discipline. TIMOTHY and TINA are aware that DAMIAN has been physically abusive to CHILD 1 and EJH in the past while the children carry wood. …

13. CHILD 1 stated that TIMOTHY is home at times when he is carrying wood and DAMIAN hurts them. CHILD 1 described DAMIAN as a “bully”. CHILD 1 stated that EJH told TIMOTHY that DAMIAN hurts them. TIMOTHY responded by saying, “Maybe you shouldn’t drop wood.” CHILD 1 stated he does not feel safe at home because DAMIAN hurts him and EJH. CHILD 1 confirmed that TIMOTHY is aware of these activities and what DAMIAN does repeatedly to him and EJH.

Interviews of Child 2

“14. CHILD 2 believed EJH and CHILD 1 were afraid of DAMIAN and what he would do when he came up behind them carrying wood.”

[Child 2 would know this from past experience and has no doubt been on the receiving end of Damian’s wrath herself.]

17. CHILD 2 stated she believed TIMOTHY and TINA are aware of how hard DAMIAN is on CHILD 2 and EJH because sometimes when TIMOTHY is told, he does nothing, but sometimes he tells DAMIAN he should keep his hands off CHILD 1 and EJH.

[On a different note, para. 20 provides another instance of Damian’s shocking brutality:

“20. CHILD 2 stated she was concerned for EJH and asked DAMIAN if he could breathe and if she could take him out of the snow. She and CHILD 3 thought DAMIAN had gone too far. DAMIAN removed a small amount of snow where he thought EJH’s mouth was. CHILD 2 described the process of getting EJH out of the snow. She said EJH was unresponsive. She said DAMIAN told CHILD 3 to get a bucket of hot water and said that “if he’s faking it, this will hurt.”

Really!!!!! This kid is a monster. I believe it was only a matter of time before he murdered someone. If 7-year-old boys and young girls suffered this sort of abuse from him, there’s every reason to believe that eventually girlfriends or a wife would too.]

Interviews of Child 3

24. CHILD 3 stated that when TIMOTHY returned home and found EJH unresponsive, he asked CHILD 3 if DAMIAN did something he usually does not do. CHILD 3 describes DAMIAN’s usual behaviors as face-washes, pushing and kicking. She confirmed that today DAMIAN used a long stick to hit the backs of the boys’ bodies.

“28. CHILD 3 described DAMIAN as “being mad” that afternoon. She recalled this was not the first time DAMIAN had struck EJH or CHILD 1 for not carrying wood. CHILD 3 was confident that TIMOTHY was aware of the physical punishments and injuries to CHILD 1 and EJH as she had heard TIMOTHY tell DAMIAN more than once he needs to keep his hands off the boys. She has seen the boys crying and believes TIMOTHY has been told by EJH and CHILD 1 that DAMIAN is hitting them.”

All I can say is ... may this poor child RIP. Is there no-one who cared for him during his short life?

Guardian of Manitowoc Co. boy ordered to stand trial

Tina McKeever-Hauschultz, 36, is charged with two counts of intentionally contributing to a child’s delinquency, and two counts of child abuse-failing to prevent bodily harm. She returns to court March 22 for her arraignment.

Although just 15, Damian Hauschultz is charged in adult court because under Wisconsin law, certain homicide counts are handled in adult court for children ages 10 and up. He returns to court March 19 for a preliminary hearing.

Timothy Hauschultz returns to court March 20 for his arraignment in felony murder and other counts.

"MANITOWOC (WLUK) -- A hearing will be held June 21 to determine if Damian Hauschultz, 15, should stand trial in adult court or juvenile court for the death of 7-year-old Ethan Hauschultz....

Tim Hauschultz is scheduled to enter a plea Friday to eight counts, including felony murder. Tina McKeever-Hauschultz also returns to court Friday for an arraignment on court charges, including intentionally contributing to the delinquency of a child, resulting in death...."

Damian Hauschultz, 15, was bound over for trial Tuesday after a preliminary hearing.

Damian is charged with felony first-degree reckless homicide. The maximum punishment for that charge is 60 years in state prison. He is also charged with three counts of substantial battery and three counts of physical abuse of child-intentionally cause bodily harm. He is being held in the Sheboygan County Juvenile Detention Center, according to the Manitowoc County Sheriff's Office.

Since Damian is 15 years old and not considered an adult, the next step is a reverse waiver hearing to determine which court — juvenile or adult — will address Damian's trial and future hearings. The hearing is scheduled for 1:30 p.m. June 21 to allow time to prepare expert witnesses.

Defendant in custody. HEARING - The motion filed by Attorney Kuchler will not be addressed today. The Court schedules the motion hearing on that matter for 04-22-2019 at 1:00pm. MOTION TO MODIFY BAIL CONDITION - Attorney Kuchler argues for the defendant to be allowed to have contact with co-defendant, Tina McKeever-Hauschultz. The State opposes any changes to the current no contact provision between the defendant and Ms. McKeever-Hauschultz. The Court adjourns this matter to 1:30pm today, when the co-defendant and her attorney will be present for the Court to discuss this with as well. Attorney Kuchler lastly asks the Court for clarification regarding the defendant's contact provisions with S.H.; specifically in regard to the visitation system at Door County Jail. The State approves contact through the jail's visitation system only if an official from Door County Jail can verify that the conversations are recorded. If they are not recorded, the State would not find the contact appropriate. Minutes.
