The parties agree that the trial should be postponed. The co-defendant, Damian is an essential witness and the parties will need to cross-exam him in person.
Damian's appellate counsel has informed defense counsel that he will be invoking his 5th amendment rights and will be unavailable to testify at trial. The trial will proceed as scheduled. The court does not feel that the trial cannot proceed f the defendant invokes his 5th amendment right. Defense clarifies for the record what statements they would like to introduce under the hearsay exception.
State has until January 5, 2026 to provide any rebuttal or additions to complete the record. The State should address if the probative value outweighs the prejudicial effect and possible confrontation issues.
Defense has one week to respond. The court will address the submissions at the pre-trial conference that is already scheduled.
Defense does not feel that the defendant will have a fair trial as there will be no cross-examination of the co-defendant or any explanation regarding the difference in his statements over time.
Defense feels that the court should recuse itself as it is presiding over a case that includes the victim. The victim is no longer present on zoom for today's hearing. The court preliminarily denies the motion, as it does not feel that his role in that case presents any conflict that would require him to recuse himself, but the issue can be re-raised to comply with Marsy's Law.
The co-defendant will need to invoke his 5th amendment right outside of the presence of the jury on the day of trial, a WRIT will need to be prepared.
Manitowoc County is to mail the supplemental jury questionnaires that were previously prepared.

IT IS HEREBY ORDERED:
1. The Motion for Judicial Recusal is GRANTED, although the court explicitly declines to
adopt the factual allegations made in the motion for recusal as the basis thereto. The
court nevertheless grants the motion for recusal to ensure procedural due process.
2. The Honorable Jerilyn M. Dietz is recused from presiding over Defendant's motion for
post conviction relief pursuant to Wis. Stat. 974.06 and from any further proceedings in
this matter.
3. This case shall be reassigned to a different judge in accordance with applicable court
procedures.
4. No determination has been made regarding the merits of Defendant's motion for
