The parties agree that the trial should be postponed. The co-defendant, Damian is an essential witness and the parties will need to cross-exam him in person.
Damian's appellate counsel has informed defense counsel that he will be invoking his 5th amendment rights and will be unavailable to testify at trial. The trial will proceed as scheduled. The court does not feel that the trial cannot proceed f the defendant invokes his 5th amendment right. Defense clarifies for the record what statements they would like to introduce under the hearsay exception.
State has until January 5, 2026 to provide any rebuttal or additions to complete the record. The State should address if the probative value outweighs the prejudicial effect and possible confrontation issues.
Defense has one week to respond. The court will address the submissions at the pre-trial conference that is already scheduled.
Defense does not feel that the defendant will have a fair trial as there will be no cross-examination of the co-defendant or any explanation regarding the difference in his statements over time.
Defense feels that the court should recuse itself as it is presiding over a case that includes the victim. The victim is no longer present on zoom for today's hearing. The court preliminarily denies the motion, as it does not feel that his role in that case presents any conflict that would require him to recuse himself, but the issue can be re-raised to comply with Marsy's Law.
The co-defendant will need to invoke his 5th amendment right outside of the presence of the jury on the day of trial, a WRIT will need to be prepared.
Manitowoc County is to mail the supplemental jury questionnaires that were previously prepared.

The parties make argument to the court to accept the plea negotiations. The mother of the victims, A.E., makes a statement to the court. It is the defendant's intent to make an Alford plea in this agreement. The court will not permit the plea agreement as it is not in public interest. The defendant wishes to change his pleas to guilty. The court does still not believe the plea agreement is appropriate & denies the motion. Defense argues that all rulings made in this case should be void as the judge did not have appropriate jurisdiction over this case. The court is confident in the thoroughness of counsel & does not believe this is necessary. State argues their motion to amend the Information. The State moves to amend count 1 to Child Neglect, death as a consequence, contrary to sec. 948.21 (2)(d); penalty 948.21(3)(a), Wis. Stats. Argument. Court allows the amendment. State argues their motion to confirm prior court rulings on use of audiovisual recordings of child victim as that victim has had a birthday since the date of the ruling. Defense does not feel that this motion needs to be addressed. The ruling stands. Defense filed a motion to change venire. State does not feel it is necessary & is denied. The court believes that Manitowoc County is able to provide a fair pool with extensive voir dire & possible additional jury questionnaire. MANITOWOC, WI (WTAQ-WLUK) — A judge rejected a third attempt at a plea deal Monday for Timothy Hauschultz, the man who allegedly ordered the punishment which led to the 2018 death of his great-nephew, Ethan Hauschultz, at age 7.

The judge also again rejected a joint request from the state and defense to delay Timothy’s trial because of Damian Hauschultz’s unavailability to testify at his father’s trial.

Manitowoc County Judge Jerilyn Dietz and then-Calumet County Judge Carey Reed previously rejected two different attempts at a plea deal.

In court Monday, the parties presented another plea deal. It called for Timothy to plead guilty to two counts: failure to act and neglecting a charge. That differed from the last version, in which Hauschultz would have entered an Alford plea. In an Alford plea, the defendant maintains his innocence but acknowledges the state has enough evidence to gain a conviction.

Judge Reed said the plea deal was inadequate and didn’t provide the court with any flexibility at sentencing, as his options would be time served or a limited additional period behind bars for Hauschultz.

That said, the judge encouraged the parties to continue negotiations towards a plea deal, though the defense said it would reject a deal with the possibility of more jail time.

After the plea deal was rejected, the focused turned to Timothy’s trial, which is scheduled to start Feb. 23.

The parties expect jury selection will take one day. The original pool was 150 people, but the draw is expected to be reduced ahead of time after the attorneys review pre-trial questionnaires. It’s anticipated a total of 14 jurors will be seated to hear the case, with two alternates selected before deliberations begin.

Another motions hearing is scheduled for Jan. 21.

A new judge has been selected to handle the Damian Hauschultz case.

After Judge Jerilyn Dietz was forced to recuse herself from the case, Judge Robert Dewane was chosen to handle a hearing for post-conviction relief filed by Hauschultz and his lawyer.

Dewane is no stranger to Hauschultz either, as he actually presided over that case.

In his latest motion, Hauschultz claims that he should not have been charged with 1st-degree reckless homicide because his lawyer at the time was ineffective in arguing for him.

So, he is asking for a new trial or to be resentenced.

1/12/26 Update: Judge Reed rejected a third attempt at a plea deal Monday for Hauchultz. The judge also again rejected a joint request from the state & defense to delay Timothy’s trial because of Damian Hauschultz’s unavailability to testify at his father’s trial. Manitowoc County Judge Jerilyn Dietz & then-Calumet County Judge Carey Reed previously rejected two different attempts at a plea deal. In court Monday, the parties presented another plea deal. It called for Timothy to plead guilty to two counts: failure to act & neglecting a charge. That differed from the last version, in which Hauschultz would have entered an Alford plea. In an Alford plea, the defendant maintains his innocence but acknowledges the state has enough evidence to gain a conviction. Judge Reed said the plea deal was inadequate & didn’t provide the court with any flexibility at sentencing, as his options would be time served or a limited additional period behind bars for Hauschultz. That said, the judge encouraged the parties to continue negotiations towards a plea deal, though the defense said it would reject a deal with the possibility of more jail time. After the plea deal was rejected, the focused turned to Timothy’s trial, which is scheduled to start 2/23/26. The parties expect jury selection will take one day. The original pool was 150 people, but the draw is expected to be reduced ahead of time after the attorneys review pre-trial questionnaires. It’s anticipated a total of 14 jurors will be seated to hear the case, with two alternates selected before deliberations begin. *Tina McKeever-Hauschultz (35/now 42) (great aunt) – 3/12/21: Plead no contest to 2 counts of child abuse-failing to prevent bodily harm & the 2 counts intentionally contributing to the delinquency of a child were dismissed. Sentenced to 5 years in prison & 5 years extended supervision. Was released in January, 2025 & now serving 5 year extended supervision.

(14/now 22) – Plea hearing on 6/25/21 & plead guilty to 1st degree reckless homicide & was sentenced on 9/2/21 to 20 years in prison & 10 years probation. Filed official appeal on 12/9/22. Court of Appeals acknowledged on 4/11/23. Appeals denied (3/13/24). His 2nd appeal was denied to heard in the Appeals Court (9/12/24).

MANITOWOC (WLUK) -- Timothy Hauschultz’s trial for allegedly ordering the punishment which led to the 2018 death of his great-nephew, Ethan Hauschultz, 7, which was scheduled for next month, was postponed Wednesday.

No new date was selected.

Three different plea deals for Timothy have been presented to the two judges, but all were rejected. The judges have said the proposals didn’t adequately reflect the charges, or provide enough flexibility at sentencing.

Both District Attorney Jacalyn LaBre and defense attorney Donna Kuchler reiterated their support Wednesday to Calumet County Judge Carey Reed to accept the plea deal. The judge again said it wasn’t acceptable in the current form, but could be revised.

As for the Feb. 23 trial date, LaBre noted that without Damian available, the state’s case would depend more heavily on the testimony of three other children who were in the home. She raised concerns about the trial adding to their trauma, particularly for one of the children.

Kuchler, who previously supported holding off on Timothy’s trial to allow Damian to testify, said Wednesday she opposed a postponement, noting pre-trial preparations were underway.

Judge Reed said the increased toll on the other children is a different factor than was previously considered. He also cited the victims’ concerns that Damian’s testimony is necessary to properly try the case, and the judge expressed hope that Damian’s motion could be resolved relatively quickly.

The judge set a status conference for next week to discuss scheduling and other issues for Timothy.

When this case was reassigned to him, the court did not discover any direct conflicts in terms of being involved in matters related to this defendant.
The court recused itself in the co-defendant's file because the victim's mother was a participant/graduate of the Manitowoc County Drug Court Program of which it presided over. Given that relationship and the reasoning in that case, the court will also recuse itself in this matter.
The court notes for the record that it did not preside over any adoption regarding this defendant as has been reported by the media.
The District Court Administrator has been notified of this court's recusal and a new judge will subsequently be assigned.

Later Wednesday, a separate status conference was held on Damian Hauschultz's post-conviction motion asking for a new trial or a re-sentencing.

Judge Robert Dewane was assigned the case, and said he had done a review of the case noting no direct conflict of interest for Damian's case.

However, after it was pointed out he had recused himself from Timothy Hauschultz's case because Ethan's mother appeared before him in drug treatment court, it was appropriate to remove himself from Damian's case for the same reason.

As a result, the Director of State Courts office will appoint another judge to preside over Damian's case moving forward.

5/10/21 Update: Damian has agreed to a plea deal & will plead guilty to a felony homicide charge, the most serious of seven charges against him & the plea agreement includes a recommendation that he be sentenced Friday to 12 to 17 years in prison & the other charges will be dismissed. But Judge Jerilyn Dietz is not bound by that, and may sentence the teen to up to 40 years in prison & 20 of probation. Plea hearing on 6/25/21 & sentencing on 9/2/21.
6/25/21 Update: Damian plead guilty to 1st degree reckless homicide & other charges were dismissed. 12/9/22 Update: The lawyer for Damian filed a formal appeal Friday to overturn his conviction for the death of a 7-year-old boy who was in his family’s care. At issue is whether statements Hauschultz, who was 14 at the time, should have been admissible in court. His lawyer points out police questioned the boy by himself three times -- first at the hospital, then at the sheriff’s office & then after being awakened at 2:45am in the morning after Ethan was pronounced dead -- and he was never given Miranda warnings. The circuit court said Hauschultz was not in Miranda custody at the time of the interviews, but would a 14-year-old boy feel free under those circumstances to end the questioning & leave, or even know that he could? His lawyer challenges a circuit court ruling that his statements were voluntary. “Damian’s overnight questioning took place in the same stationhouse interrogation room he’d spent two-and-a-half hours in before, again with no friendly adult present, again without advice about his rights—or even any mention that he could decline to answer questions,” the appellate brief reads. Hauschultz reached a plea bargain on a charge of 1st degree reckless homicide. Felony charges of child abuse & substantial battery were dismissed but read into the record, so the judge could weigh them at sentencing. The maximum penalty for reckless homicide is 40 years in prison & 20 years on extended supervision. Hauschultz received half of that, but it was more than the DA asked for, which was a 12- to 17-year sentence. The Court of Appeals District 2 will now wait for a response from the State to the lawyer’s challenge. That brief is expected by 1/9/23. There is no timeline for having a decision.
4/11/23 Update: Damian’s conviction for the April 2018 death of his 7-year-old cousin, Ethan, should stand, the state argued in a brief filed Tuesday. Hauschultz’s attorneys have until 4/26/23 to reply. It will be several months before a decision is reached, with or without oral arguments. Meanwhile, Timothy Hauschultz's fate is still to be determined. Damian is expected to be a key witness at that case, but his attorney has indicated if Timothy's trial happens before Damian's appeals are concluded, Damian would invoke his Fifth Amendment rights & would not answer any questions. As a result, Timothy's trial is on indefinite hold. No trial has been set & a trial in 2023 appears unlikely, given court workflow. He returns to court 4/20/23 for a status conference.
2/24/23: Appeals-Court of Appeals grants the State's request to have access to sealed record #32. State shall file its response brief within 15 days of receiving the sealed record. 3/15/23: Letter from JS, Clerk, to the Court of Appeals. 3/21/23: Order of Court of Appeals. It is Ordered that within seven days of the date of this order the assigned AAG may either (1) file a limited appearance in the circuit court to get electronic access to sealed record item #32; or (2) determine the copy provided by the circuit court clerk is sufficient. It is further Ordered that if the assigned AAG makes an appearance in the circuit court, the circuit court clerk shall grant the assigned AAG access to sealed record item #32. It is further Ordered that within fourteen days of the date of this order, the circuit court clerk shall return the record back to this court. 5/12/23 Update: A group of juvenile justice advocates from the across the country filed a brief Friday, urging the state Court of Appeals to overturn Damian Hauschultz’s conviction for the death of his cousin, Ethan, 7. They argue juveniles, especially those with trauma histories such as the then-14-year-old Damian, cannot fully comprehend their situation to waive their Miranda rights. The appeal asks the court to reverse the trial court's ruling allowing the statements from his first three interrogations & it wants Hauschultz to be able withdraw the guilty plea & have the case resume from that point. Prosecutors replied in April, 2023 arguing the law was followed & Damian did, in fact, understand what he was doing. Hauschultz’s attorneys have until 5/26/23 to reply to the state’s arguments. After that, the appeals court will issue a ruling, likely in several months.
5/14/24 Update: Damian's appeal argued because the teen did not feel free to end the questioning by police, his self-incriminatory statements were not voluntarily made, and should not have been allowed as evidence. But the state appeals court rejected those arguments in March, upholding his conviction. In April, Hauschultz’s attorney asked the Wisconsin Supreme Court to review the case. Her 34-page brief raises several issues it says the court should review. These include: whether Damian was in Miranda custody during any of the police interrogations, where his statements were voluntary, whether the circumstances surrounding Damian’s interrogations show “the pressures brought to bear” exceeded his “ability to resist,” rendering his statements involuntary. In its reply filed Friday, the state Attorney General’s office argued the Supreme Court should not review the case. The state contends the lower courts properly ruled on the Miranda issues, and the circuit court’s rulings denying suppression of Hauschultz’s third statement to police was harmless and does not need review. The Supreme Court will decide if it wants to hear the case. There is no set timeline for it to make that decision.
9/23/24 Update: The Wisconsin Supreme Court will not to hear an appeal of Damian Hauschultz's reckless homicide conviction in the 2018 death of his 7-year-old cousin, Ethan. The court decided not to hear Hauschultz's appeal Sept. 11, which keeps the appeals court ruling in place. No reasoning for the decision was included in the order, nor were the tallies for the justices' vote.

Interpreter Tarra Gammernos is sworn in to interpret ASL for proposed juror. It was determined that juror can participate without an in person interpreter as long as a microphone is used by the parties. Court excuses the juror at 1:07 p.m.
State's motion to adjourn. Pursuant to Defense's previous understanding of adjourning the trial, it objects to an adjournment. Defense renews its request to reconsider the plea agreement previously presented to the Court.
The parties have further discussion on how to proceed given the current circumstances. The Court determines that, given the new facts presented prior to the hearing today, the February trial dates will be adjourned.
Court will scheduled a status conference to determine what needs to be scheduled next after the scheduling conference is held in Damien's case at 3:00 p.m. this afternoon.
