I would guess they would load her up on meds....

Yet that wouldn't take ten months?
Do they plan to give her a pre-law course or something so she understands?
Do they just think she will be competent when she's twelve?
I don't understand, I've not heard of this before.

The girl was given a mental evaluation earlier this month. The psychologist determined the girl is still not competent to proceed on a homicide charge at this time, but she is expected to be competent by next March, said prosecuting attorney Richard Dufour.

Dufour objected to the idea of allowing the girl to waive the preliminary hearing.

“Our position is you can be either competent or incompetent,” Dufour said after the hearing. “You can’t be ‘somewhat competent.’”

A competency hearing slated for July 3 will be the next court date in the matter...."

What do you want to know? It seems they may either have her on medication that is working but needs time to fully work, or, they believe she will be mature enough to be competent (understand what's going on), in another year.

Just wondering if that's normal, I've never seen them predict competency in like 9 months before. Maybe it isn't all that weird after all.

Confessed to dropping baby who hit his head on footstool, and she stomped his head & killed baby in a panic.
11/5/18 Update: Had bond hearing (11/5) will be charged as adult under Wisconsin law.
11/5/18 Update: Hearing continued to 12/11. 12/11/18: Both Chippewa County District Attorney Wade Newell and Judge James Isaacson have recused themselves in the case, turning it over to the DOJ for prosecution. Jaxon’s father, Nate Liedl, works in the county’s clerk of courts office, so that presented a conflict of interest. And the case has been sealed. Since sealed no further dates available.
1/24/19 Update: Hearing held 1/24, defense asks for dismissal of case, denied by Judge. Next competency hearing on 3/5.
3/5/19 Update: The girl has been deemed incompetent to stand trial, causing the homicide case to be suspended indefinitely. The judge agreed with a psychologist that it is possible that the girl could become competent within the next year, so he ordered she be re-examined on a quarterly basis. The judge set up a return date for July 3 to see if the girl has been found competent at that time. The girl will remain in the custody of the Department of Human Services for at least the next year; a prosecuting attorney said it is likely the girl will eventually be committed to deal with her mental health issues.
3/21/19 Update: Motion hearing, but motion was withdrawn. Will remain in an adult women’s wing at Winnebago Mental Health Institute, a judge ruled Thursday. She will be reviewed quarterly to see if she becomes competent over the next year.

Prosecutors have now upped the charges against the girl. She was originally charged with reckless homicide, but the charge has now been amended to 1st degree intentional homicide. The girl is charged in the October 2018 death of 6 month old Jaxon Hunter. Earlier this year a judge found the girl is not competent to stand trial. Another hearing is set for September."

"Chippewa County (WQOW) – We now know why prosecutors have upped the charges against a young girl accused of killing a baby in Chippewa County.

The girl, whom News 18 is not naming, was originally charged with reckless homicide.

She now faces a count of first degree intentional homicide in connection to the death last October of 6-month-old Jaxon Hunter. She was just 10 years old at the time.

According to an amended criminal complaint, the final autopsy report concluded there were at least seven distinct impact injuries to the baby’s head.

The autopsy found at least one of them, and possibly more, was a direct match to the shoes the girl was wearing at the time.

In a past interview, the girl said she knew more than one strike would kill Hunter.

Based on the final autopsy report, prosecutors determined it’s clear she knew her actions would kill him.

Earlier this year, a judge found the girl not competent to stand trial. A review hearing is set for September 4."

This case makes me feel ill.

I can't help but wonder if the girl had exhibited brutal/violent tendencies before this incident. Will we ever know?

That poor little 3 month old. The parents' grief must be horrible.

I'm not surprised. I knew this kid had done it on purpose from the beginning. There is no way any kid that ages "panics" and sort of accidentally stomps an infants head and kills them. What's interesting to me is how she went from somehow functioning in society to intentionally killing an infant one day to no longer being competent to stand trial. Did she seem unstable before being left alone with the baby? Now she's a total mess and not competent to stand trial? Is she traumatized by the actions she chose? I know I'm not expressing myself well here. I need some coffee.... And I need to go back and read why she was alone with the baby.

This is terrible. Assuming her actual words bear it out (I wouldn't assume a reporter had summarized it 100% as-told), I can no longer think this was a situation of "well, we have to take into account past history, and what she was told in another situation might happen, if it was found out that she caused a baby to cry". I was ready to say "we don't know what type of modeling behavior was in her life up until now" - maybe her family of origin had adults who threatened her with dire consequences (or worse) if she caused a baby to cry - but without any provocation? I find it hard if not impossible to imagine, someone's thought process even at age 10, which said/postulated "The best way to get myself out of this untenable situation is by killing the baby". I feel like there's no way that "making him cry" in the first place was accidental on the girl's part, with this additional information.

The baby was 6 months not 3 months. Doesn't make any difference in the whole scheme of things but I wanted to correct my post.

IIRC she was supposed to be in the yard with Foster Mom & everyone else -- either snuck in or asked for a drink?

Girl ruled incompetent in infant's death

SEPTEMBER 4, 2019

"CHIPPEWA FALLS — The 11-year-old Chippewa Falls girl accused of killing a six-month-old infant last fall is still considered incompetent to stand trial, keeping the murder case filed against her in limbo.

The girl was given a competency review by Dr. Michael Hammer in late August, which showed the girl has actually shown some regression in her mental capacity, said Dunn County Judge James Peterson, who is presiding over the case.

"The defendant is not competent to proceed," prosecuting attorney Richard Dufour told Peterson during a court hearing Wednesday in Chippewa County Court.

Defense attorney Laurie Osberg noted the state has now filed a fourth criminal complaint in the case, with the most recent filing increasing the charge to first-degree intentional homicide, a Class A felony.

The attorneys once again discussed whether the girl is competent enough to waive a preliminary hearing, even though she has been found incompetent to stand trial. Osberg said she believes the girl is now able to understand a preliminary hearing. The girl, who has been incarcerated at Winnebago Mental Health Institute in Oshkosh since March 5, made the trip to Chippewa Falls on Tuesday, allowing her to get a good night's rest and meet with her attorneys.

"We believe she is refreshed and ready," Osberg said.

However, Dufour contends that you can't be competent for one type of hearing but incompetent for another....

The girl will continue to receive quarterly mental health evaluations to see if she becomes competent. Another court hearing was scheduled for Oct. 11. Peterson said he would address at that hearing if she can waive the preliminary hearing, even if she is still not competent.

Before concluding the hearing, Peterson turned and spoke directly to the girl, asking her to do her best to interact with her attorneys and be engaged in her own defense...."

I don't understand the concept - if she's too ill to sit for trial, how can she be considered mentally healthy enough to be culpable at the time of the crime?

Legal wrangling slows the process but the perp needs a fair trial . Just such a horrible act ! Frightening
