GUILTY WI - Kelly Dwyer, 27, Milwaukee, 11 Oct 2013 - *Arrest* #2

  • #161
Kris Zocco will be back in court this afternoon for a motion hearing, here is the description "State's Motion to Preclude Testimony at Hearing on Defendant's Motions to Suppress received and filed".

Online records of his cases can be found here http://wcca.wicourts.gov/caseDetail...ffset=0&mode=details&submit=View+Case+Details and here http://wcca.wicourts.gov/caseDetail...ffset=1&mode=details&submit=View+Case+Details

The good news is that the authorites have him dead to rights on the child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 and drug charges so they can lock his 🤬🤬🤬 up until he cracks and the truth about what happened to Kelly Dwyer comes out.

Thank you so much black4vcobra.
Dead to rights = caught red-handed, no excuse.
I sure hope you're right. Seems so to me too.

Welcome to :welcome4: websleuths (notice I selected the #4 welcome smiley!).

Glad to be here, I've followed the case at a distance but it seems as if it's died down on this board and it needed to be brought back to the top. I can't be of any help right now but this story hits pretty close to home for me for a couple of reasons

- I've spent a good deal of time in Milwaukee
-I grew up in Slinger, only about 8 miles away from Richfield (where Kris Zocco lives now)
-A good friend of mine actually dated Kelly in the summer of 2013. He last spoke to her about a month before her disappearance. He did contact the police and gave them all the info he had.

If anyone is wondering black4Vcobra is automotive related, as in I have a Mustang Cobra with a 4V engine

Good news, the courts denied Kris Zocco's motion to suppress evidence.

"As to the motion to suppress: Defense is moving to suppress evidence due to lack of probable cause. Court finds there is probable cause within the four corners of each of the four affidavits and each affidavit is sufficient. Court denies defense motion to suppress. As to the discovery motion: State agrees to preserve the original memo books and to provide redacted reports to the defense so they can determine if there is a basis for a motion for In Camera inspection."

:tyou: Thank you for the update! Whew, that's a relief.

This is good news and Kelly's uncle can rest his fear a little bit. I pray (hard) for justice in Kelly's case.

Help me to be sure I understand please.

The Defense suggested to the court (via legal procedure/motion) the police didn't have a good enough reason (probable cause) to conduct a search of Zocco's apartment (where drugs and 🤬🤬🤬🤬 were discovered during the process of searching). Therefore, the Defense hoped the court would overlook (forgive) what was found (various drugs and child 🤬🤬🤬🤬 featuring children young enough to be in diapers) and drop all charges relating to these peripheral crimes (which may or may not be directly related to Kelly's disappearance). Is this description right?

Why redacted reports? Does the State remove information from the reports?
Are memo books police notes?

Does 'motion for In Camera inspection' mean that after the Defense looks the discovery over, they may want to bring some of it before the Judge to argue it shouldn't be allowed in court to be used to prosecute Zocco? Is this process step two (defense tactic) to step one (decided against Defense today). By now I'd think the Defense would have the discovery but I guess they were hoping to have the case thrown out first, correct? Since that didn't happen today, they are going to argue the discovery? The wheels of justice turn slowly.

I'm seeing lots of 'fours' all of a sudden; "four corners" and "four affidavits". lol!

Wow having read through the two threads I am gobsmacked that this poor girl hasn't been found yet :(
Sad times.

"There is no case related to a missing person here, so I'm not going to comment on that." (Defense Attorney)

Are we all living on the same planet?

He was back in court on Thursday. The reporter says he would be facing hundreds of years if convicted. What goes around comes around, I guess.

Thank you for the link.

Kelly would have turned 28 - reporter said "last week" and court was on October 2.
Her father was in court having to listen to Zocco's lawyers defend him.
The trial (for drug and child 🤬🤬🤬🤬 charges) is scheduled for November but the specific date wasn't stated.

How can Zocco live with himself, when he knows Kelly's father is in the courtroom, knowing where he put Kelly but won't end the pain her family suffers. How can Zocco's family continue to support their son knowing he holds the key to end a little bit of their agony.

With this in mind, I hope he gets the maximum sentence allowed for the sick charges brought against him already.

I understand what defense lawyers do but I can't understand when they go out of their way to defend a person like Zocco. They have to realize the truth in this case. Afterall, one has to be a lot smarter than I am to get through law school. Maybe having brains without a heart is a prerequisite as well.

In cases like this, where the perp has quite a bit of evidence against him, then bring on the torture until you get a confession of where the body is! I know we can't expect a murderer to have a heart, and care what the family is going through, but by gosh there needs to be a way to make them talk!

Also, defense attorneys in general should uphold the perp's rights, but, when the evidence is showing pure guilt, I don't like them trying to get their client released, with all charges dropped, or found not guilty, etc. There are cases where it's not really clear if someone is guilty or not, and thus I can see 'other' options being brought up by the defense. But I couldn't sleep at night if I knew I was allowing a child predator, murderer, etc back onto the street. Yes make sure due process is upheld. (Except my torturing for the location of the body!!! ;))

IMO the reason he didn't get a new shower curtain or hide the CP is because he is a classic case of a sociopath.

Sociopaths:

1. charming
2. more spontaneous and intense than other people
3. incapable of feeling shame, guilt or remorse
4. invent outrageous lies about their experiences
5. seek to dominate others and "win" at all costs
6. highly intelligent
7. incapable of love
8. speak poetically
9. never apologize
10. delusional and literally believe that what they say becomes truth

People in MKE who know him or worked (use that term loosely because he rarely worked at all) say he exhibited almost all these characteristics.

I so agree...

I wish all defense lawyers were struck by the spell like Jim Carrey's character was struck in "Liar Liar"....

a defense should be used in unclear cases...

but not with the intent to obfuscate the TRUTH...

:judge:

IMO...

Court day for Kris Zocco for a final pre-trial. Considering they got him on drug and child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 charges, I wonder if he accepts a plea deal today.
