Snipped and BBM.

Just a point of clarification. Dina did not create a memorial foundation; Jonah created a memorial foundation ("Max in Motion"). Dina started a non profit 501c (3). They have vastly different operating rules.

"Max in Motion" is thriving, and quite successful, and has good prospects to remain present and active for many years to come. It's growing and expanding, per the foundation documents.

It's a hard thing to "compare" these organizations, but I can't say the same for DS's memorial nonprofit. I predicted 3 years for this organization a long while back. It's clear from the financials and other info that this nonprofit hasn't done much work of any substance related to the stated mission statement, in the past 2 tax years. (Except pay a salary to, presumably, the founder and CEO, and file the requisite tax forms.) It appears to primarily be a shelter for a little bit of income, IMO. Wouldn't be the first time that happened. It can easily be "revved up again" if the need arises to justify the nonprofit status.

Thanks for explaining the difference between the two, K_Z !!! So, Dina is essentially using the donations she receives for 'Maxie's HOUSE' as income for her personal use? Ugh. I hate that she is exploiting Maxie's death like this, isn't this criminal behavior???

OTOH, I'm happy for all those kids who are benefiting from the 'Max in Motion' Jonah set up. A very nice way to honor little Maxie.

Wow. This is earth-shattering info! Thanks so much, Overthinksit.

With such high surveillance cameras everywhere on the hospital premises, and Dina never been viewed in ANY of the hospital surveillance videos during the critical time period when Rebecca was brutally murdered (because clearly if Dina was on ANY surveillance videos, Gore would have most definitely mentioned this at the Presser), this means only one thing: Dina was NOT at the hospital "sitting vigil" by her son's deathbed and has ZERO alibi.

SO the question is: WHERE WAS DINA TUESDAY INTO WEDNESDAY MORNING when Rebecca was tortured and viciously murdered???? And more importantly, why (besides the obvious which is that Dina was murdering Rebecca at the Spreckels mansion) has Dina been lying from day one since questioned by police that she was "sitting vigil" by her son's deathbed at the hospital when clearly she was NOT? And another important adjunct question, why did Sheriff Gore take Dina's word at face value and not look into her absence from hospital surveillance videos as a sign that Dina was LYING to cover up that she was at the Spreckels murdering Rebecca?

Hi bourne. I've come realize when Dina is talking, Dina is lying. She's one NOT to be believed. For crying out loud, Jonah is probably a schemer but he's smart enough to keep his mouth shut. Alas, Dina, you probably would do better if you were to not flap those lips of yours.

Rebecca Zahau told the responding medical personel and LE that "only she and XZ were there".

That is in the report taken that morning of Max's accident. It is a FACT.

GMAB. First you say Rebecca lied about XZ being her daughter. And that she lied about Max's accident. Now you claim she's telling a FACT about her and XZ being the only ones at the mansion morning of Max's accident. And now you admit that Max had an accident. Which is it? You think she's a truthteller or a liar?

Also, statements people make are simply that: STATEMENTS = OPINIONS. Nothing more, nothing less. Just like all your statements. It doesn't make the statements FACTS.

I do not believe the law suits are linked either. IMO Dina wants money from Jonah.

Certainly the two WDS are not linked in the sense the Zahau's are primarily on a fact finding mission whereas the WDS Dina has brought against Maxie's Dad is just another vehicle to harass and dog him. I'm pretty sure the judge can/will see through all of Dina's machinations and the suit will be thrown out. Remember, Jonah requested an order of protection and he was given it.

Yeah, so the reasons for the two WDS are worlds apart. I see the Zahau's suit as a fact finding mission and hopefully a criminal investigation will come out of their WDS. Whereas Dina's WDS is purely about money. She can say Maxie's death is because Jonah allowed Maxie to be alone with Rebecca and her sister. But there is no proof he ever agreed to such a silly demand. All she has is her words...and we all know the multitude of lies she's told.

But MyBelle, what was the corroboration on what Dina claimed? If it was that important and Dina had any evidence that supported her wishes, then why wasn't there any court action on this. I do not believe there was any reason to fear Max being with Rebecca at all. I think this was fabricated as retribution.

Speaking of "proof", maybe the discovery has now proven that out of the dozens of Rady cameras in both the garage and all entries/exits, corridors, stairwells, etc, "everywhere" as the nurses attest to, not a single one recorded Dina? BOMBSHELL as NG would say.

Yes indeedy! BOMBSHELL. But ya know, I bet it would show when she left and what frame of mind she was in ! tehehe

Here is a pic of the place holder. Justice was lovely to post a link to where it is on the site, but I couldn't see it from my tapatalk so I thought I'd post it.

According to my computer, I took this screen shot on 7/15/12.

MAXIEHOUSE.jpg

It still gives me the cold creepies. I suppose it could just be in very, very bad taste...but IMVHO, it's more like a malicious taunt. Obviously this is my own opinion formed from having followed this case for years.

ALWAYS MOO

Sounds to me like everyone is getting a little nervous about May 1?

Part of me hopes that it doesn't get thrown out just so we can see Mary Zahau look like the greedy, lying, conniving person in court that she really is.

But, I think the innocent Shacknai and Romanos have been through quite enough at the hands of the greedy, cruel and vindictive Zahau family, and I pray the Judge throws this false and contrived lawsuit for $$$ out of court.

I have learned never to predict what a court is going to do. The number of corrupt judges and attorneys in the news lately makes me wonder just how much politics plays in decisions.

This lawsuit has never made sense and the maliciousness against Dina was way over the top, imo. She is a victim and it is pathetic to bash an organization created in memory of a victim such as Max. I applaud the efforts of Maxie's House to focus on legislation that will help ensure divorced parents can become more knowledgeable about who is caring for their child. My sister's infant granddaughter suffered a head injury while in the sole care of her paternal grandmother's 80-year-old boyfriend. The child's mother had told the court she wanted him nowhere near her children but it still happened. Parents need a law to help protect these children.

This is a harrowing statistic:

Children living in households with unrelated adults are nearly 50 times more likely to die of inflicted injuries as children living with two biological parents, according to a study published in the journal of the American Academy of Pediatrics.

OverThinksIt-- I have a question about Rady and RMD house.

Is the Ronald McD. house completely free standing, or are there corridors or walkways from the main hospital to the RMD house? Is the RMD house connected in any way to Rady?

Thank you very much for your offer to describe Rady.

And welcome to the Rebecca Zahau forum. Glad you decided to begin posting!

:tyou: :welcome6:

Thank you!! Here's a link to a quick video my son insisted on shooting for you guys. (He's not inpatient currently, so didn't have to escape outside in his open flapping gown to do this. ;>) It's simply a pan from the Ronald McDonald House to the entrance of Rady Children's Hospital, which may help you estimate the distance. Or lack there of.

https://youtu.be/30gLGlu3-tE

ALL of the buildings you see attached to the North (left) of the Ronald McDonald House are parking structures. There are NO medical facilities on that side of the street or connected directly to it. Like Inparadise said, the Ronald McDonald House doesn't directly connect to the hospital. You have to walk across the street, but it takes only a minute or so.

Statements made to police are supposed to be statements of fact, not opinions. The reason Rady gave for calling in CPS/police was that Max's injuries were inconsistent with how doctors were told they occurred. The doctors would have had access to the first responders' reports.

This is off topic, but I will offer this link to Charity Navigator. Max in Motion is a private foundation. They still have to have a tax ID number.

http://www.charitynavigator.org/index.cfm?bay=search.profile&ein=453760957#.VT02S3A8KrU

Why isn't this organization rated?

This organization is not eligible to be rated by Charity Navigator because it is a Private Foundation.

Private foundations receive the majority of their money from only one individual, family or corporation. This differs from the public charities that Charity Navigator evaluates. Public charities have a broad-base of support from the general public as well as variety of other funding sources. The IRS requires that private foundations file a Form 990-PF which differs from the document public charities file. This makes it impossible for us to compare the financial performance of private foundations to public charities.

What does it mean that this organization isn’t rated?

It simply means that the organization doesn't meet our criteria. A lack of a rating does not indicate a positive or negative assessment by Charity Navigator.

I generally only read on this thread but I've had a nagging question.

If Dina was so set against Maxie being around Rebecca, I wonder why Dina didn't just have Jonah pick him up and drop him off when Jonah wanted to see him.

It seems kind of odd that it was so hard to get in contact with Dina after the accident if she was so concerned about Maxie's care.

My ex-husband handled my kids in a way I didn't agree with and I was checking on them constantly while they were in his care.

Adam Shacknai Superior Court of SD filing 134 on 4.24.15

https://roa.sdcourt.ca.gov/roa/face...-CTL_ROA-134_04-24-15_Reply_1430076544699.pdf

Defendant Adam Shacknai's Reply in Support of His Motion for Judgment on the Pleadings

More of the same.

It occurs to me that the Zahau attorneys have the overwhelming burden to have three different sets of lawyers defending their respective clients and which the Zahau's Greer then must work triple time pressing their case.

Further, each defendant has the ability to utilize the co-defendants' responses and points of law which they seem to be doing.

Hardly seems fair. If the defendants had combined their cases with one attorney representing all three, this wouldn't be the case. God bless the Zahaus in their unwavering pursuit of justice for Rebecca and more power to them.

Yes, I agree wholeheartedly. As detailed as this case has been, sometimes one simply needs to view the obvious and this is only one of the obvious surface facts that is inconsistent with what the defendant is preaching.

And I'm certain that the kids really enjoyed the wine.

rhetorical question really, but has anyone else ever wondered, when some posters have gone off on a non-sense rant, or convoluted, twisted tale, or downright vile spewing post, if they aren't hoping that later they can use copies of their posting as a defense? To prove insanity?

well I sure hope it wasn't more than a glass or two for the parents; they can display some downright inappropriate behavior with too much wine while parenting.
