I know it is quite the leap to look at these pleadings and infer too much, but the chronology ending with the withdrawal of Dina's attorney makes me scratch my head and wonder if the defendant has been leading the charge and her attorney said 'enough I'm outta here'.
It further seems that the "inability" to view the Rady CD's is more than weak. Come on, really? You can't get your hands on them and you state that's your primary defense? Heck, I would remove myself from the defense counsel as well.
Things don't appear very good for the defense at least from these last items.
My question would be "what else you got, Dina?".
Well, for several years there have been comments all over the place that DS has witnesses who will testify that she was at Max's bedside in Rady ICU during the relevant hours of Rebecca's death. I'd think that "now" would be a good time to be sending out subpoenas to those individuals, so they can be deposed. And despite all the recent issues with Howard Luber's wife, Lisa Luber, and rumors that she was going to be the witness to confirm DS at the bedside, we now know with certainty that that was completely false. LL filed an affidavit that she wasn't even in California.
So, yes, *now* would be a really good time for those witnesses to be subpoenaed, right? Especially since defense attorneys claim they are having so much trouble getting to look at the surveillance recordings.
And by the way-- if DS has an alibi for Rady, she will know exactly which door/s she habitually used to enter and exit the hospital. And approximately what time she entered and exited, as well as anything like a parking garage charge. So, they could narrow down "which" of the 27 CDs of surveillance they need to review, pretty quickly. She's either there, or she isn't. The sheriff said in a press conference she isn't seen on surveillance. I tend to believe that. Especially since no one has offered anything substantial to indicate she was, other than cell phone triangulation that places her phone "in the vicinity" of the hospital. And the bicycle family identified her at the front door of Spreckles. So there we are. I seriously doubt that there are any witnesses that can be subpoenaed to support her story, or we'd be hearing about that in these kinds of documents. DS appears to be hanging all her hopes of exoneration on something the DOJ may, or may not even have. I think it's just delay tactics.
