How coincidental that at the same time Dina was supposed to have retrieved her son at the Spreckels mansion that was the same time Max then had the accident and Dina was then NOWHERE to be found for 4-6 hours thereafter? Hmmm....Hmmm....Very HINKY.

As this is a hearing for summary judgment, there has to be (as AZlawyer has posted) a motion filed for summary judgment. Thus far, there has been no motion for SJ.

I think San Diego just automatically re-schedules this after a certain interval. We have seen this a number of times now. Note that the date is a year from now.

Thanks I didn't know that part..now there is even more reason for Rebecca to have been mad and taken her anger out on Max!
 
regarding RZ's ability to jump over the railing, or run away from would be captors, I remember that Rebecca was injured during this time and walking with a pronounced limp. any ideas?

I was under the impression it was a lifelong or permanent type thing that she had for a while, although not sure what caused it in the first place. and it didnt appear to be anything that kept her from working out or running etc.

Judge Bacal has yet to rule on the Demurrers.

And nothing on the court docket is set in stone.

Events can be vacated and rescheduled.

At one point a trial was scheduled for last fall.

San Diego County currently has no Sunshine Ordinance under the FOIA.

It has to be passed through a ballot initiative.

Only these CA municipalities have the ordinances:

Contra Costa County
Benicia
Berkeley
Milpitas
Oakland
Alameda
San Francisco
Riverside
Vallejo
Gilroy

So there is no path for the San Diego media to get the SDCSO case file released so the public would at last learn WHOLE truth.

But the fact is, the media quickly moved on after hyping and sensationalizing the case. Which led to all the wild speculation and rumor.

Even if there was a Sunshine Law in place, I doubt any of them would bother with this "old" story.

FWIW, in the very early days of the investigation(s) the story was Dina was scheduled to pick Max up before noon. I don't know where this detail came from. Maybe Bourne has a link? Whether it was reported and scrubbed or maybe a comment made somewhere? When creating the timeline here for WS I could not found a link to support this.

What we do have is an interview with Tricia and Zahau attorney at the time, Marty Rudoy. Attorney Rudoy does not mention any plans for Dina to pick Max up that day. In his interview Rudoy states the plans for the the day were to go to the beach.

10:00 AM – Rebecca and Max wake XZ. She was to shower and Max clean his room. They had plans to go to the beach. According to Attorney Marty Rudoy.

My notes in the timeline show that Dina provided this information in a press conference she gave about Max's custody arrangement she had with Jonah.

Looks like we need to find it in the transcripts of her press conferences.

Thank you, Betty P. Very interesting. This family has been through so much, and they remain so dignified.

And it is even more disheartening to me to think about how Dina and her attorneys are focused on exploiting the Zahau's history and immigration status in this lawsuit. What in the heck does any of that have to do with Dina defending herself from allegations of murder?? It's absurd to the extreme. That whole line of Dina's inquiry is simply astounding and disgusting to me, on so many level-- racist, classist, etc. Certainly revealing of Dina's state of mind. I'm glad Dina and her attorney were told in no uncertain term by immigration authorities that the details are simply none of Dina's business.

As we discussed before, this was just Dina's attempt to dig up "something" that she could use to try to challenge Robert Zahau's, and Pari Zahau's standing to bring the lawsuit. And it didn't work, fortunately.

Oh-- and that letter from USCIS was just posted March 23, 2015-- so we know Dina has been obsessing over the Zahau immigration as of just a few months ago. Man, what a grudge, IMO. Sick.

And also remember Dina has recently (Aug 31, 2015) filed a request to submit a Letter Rogatory (#223, 224 on San Diego ROA). So she is still poking and prying, trying to dig up "something" on the Zahaus from another country, rather than focusing her legal efforts on defending herself and providing an alibi.

IMO, the second ex-mrs. jonah shacknai has no alibi! Not only has she no alibi, a witness saw her at the mansion lurking about. Hence the futile attempts to garner info on the Zahau family and their immigration. Probably hoping she could find some small technicality to get the case thrown out. Its also my very strong opinion this case will move forward to trial.

All she has to do is give her alibi...why has she not shown the court the plaintiffs are in error???

IMO, Dina Romano is up ***** creek without a paddle and everyone of import knows it.
