I didn't say the manager was being positive about her, I said if they said anything negative they'd be hated. I don't think stating a fact about who was asking for the refund is a negative. Not being positive isn't the same as being negative.

Fair enough. I’ll restate that: I think the manager was pretty negative about her. She certainly didn’t avoid “saying anything negative “ about her.

I agree. My response was meant for those who believe the witness who claims she was crying. I tend to believe the manager, but if she was crying, it would not surprise me.
Yeah, I wish she had said something to indicate what her mood or demeanor was. I'm just thinking if she had enough nerve to walk back in and ask for her money back, she probably wasn't crying.

He wouldn't need to interview the witness who saw Brian slapping Gabby because there is a 911 recording of the call. We know they were running up and down the sidewalk with Brian hitting her because he was describing what he had just seen.

But we also have a video recording of the restaurant "witness" describing the big blow- up complete with angry voices and stalking in and out of the restaurant multiple times-- the one that doesn't match the manager's story at all.

I posted the witness interview. But, found it odd she did not hear what the argument was about but was sitting right next to them. And blamed everything on Brian. Yet, MP manager does not have a reason to lie about it now....

So.....even eye witnesses on youtube can get it completely wrong. LE knows this. I wish Brian Enin could interview the eye witness that said it was BL slapping GP.

In general, I don't think eyewitness accounts are ever very accurate. Some people can be very good at reporting what they've seen, but there is a plethora of studies that have shown the hazards of eyewitness accounts. Here is one:

The manager said they left without paying, were caught outside so they paid, then Gabby went inside to ask for a refund. I don’t think the manager was very positive about her at all.
I got the same impression from the manager. Am disappointed that BE didn't ask her more questions. Like why would they have left without paying, paid outside, and then had the nerve to ask for a refund. But they said to text questions to Brian to answer. Hoping someone who knows how to do that will!
I didn't hear him say that. Was it during the show? I don't think the manager gave a reason for them not paying.

And they did report the incident to FBI, that's pretty audacious if they made it up. geez Guess we're back to square 1. Why the hell did he strangle her? jmo

what should she have said about who was asking for a refund. Why is that negative? I suspect she didn't want to say anything, but for whatever reason fell under the pressure of BE to do an interview.

Oh, that's a new one on me. I've seen that video a bunch and never had my attention called to the player leaving or the curtain color changing. The first time I watched it, I also did NOT see the gorilla.

Humans have in and out listening. Eye witnesses are wrong sometimes. And sometimes I think we see what we want to see....when I use to do video and meeting planning it happened a lot. But, I think the MP manager and waitress probably got it close to right.

Or the service, (I also, long ago, in a life far far away worked in F & B) But usually a restaurant, especially when busy, will just give some sort of refund to hopefully keep a customer returning and/or be done with it as soon as possible. But maybe when the customer tries to leave first without paying, maybe they would prefer that they not return so no need to give a refund.

They didn’t say that in what Brian Entin reported, unless I missed it later. I did a rewind and there was no specific mention of any order, just that the behavior wasn’t as described. They left without paying, a server followed them out and confronted them. They paid, BL was calm, they came back in together and GP said she wanted her money back. The restaurant refused and they left. There was surveillance video at the time, but they didn’t know it would be needed so it wasn’t kept.

He said manager didn’t went to go on camera so he just took notes.

Exactly. There are a lot of "I think" and "she seemed" in her statements which IMO means her perspective was subjective. And she says he was "screaming." I do think others would have noticed him screaming. I don't think he was screaming. Again, JMO.

I don't doubt she witnessed a tense ongoing exchange.

The managers statements have really shed some light on this. There's no doubt about that.

JMO, I think the truth is in between what the witness said and what the manager said.

I agree about the restaurant staff getting it right. They kept it short without a lot of details and were more intimately involved than a customer would have been. The customer had already had to retract her statement about screaming so she has already shown that she might be wrong on some details.

Could it be possible that Gabby thought Brian paid the bill? Perhaps she stepped away to go to the restroom assuming he took care of it. When the server follows them into the parking lot, it then becomes clear the bill had not been paid. As another Poster mentioned, potentially cash was given at this point, possibly from Gabby’s possession. She then may have attempted to get the cash back by trying to put the transaction on her card.

I don’t know, but something about his possible financial state has been in the back of my mind for a few weeks.
