The attorney is the agent for his clients. He put out a public statement, there is no attorney client privilege there.

It's unlikely he will be forced to testify, because most of their communications will be protected by Privilege.

If Bertolino didn't put out this statement, there may not be a hearing right now. (MOO)
Would he be free to testify that the statement was his own and not from his clients?

I need to say this, after reading the first Complaint, I didn't expect such an intelligent lawyer in the courtroom, but I'm impressed by him. MOO.

If this goes to trial and the plaintiffs do not produce any evidence that supports their claims about what the Laundrie's knew and withheld, could they be sued for defamation?

If his clients allow him to, yes. However, the Judge has already said that the attorney is the agent for his client, so I'm not sure how far that would go.

My opinion, I don't think so. But anyone can sue for anything - they just don't always win.

During a Motion to Dismiss, you won't. They just re-argue the motions that are already public and answer questions from the Judge.

Unless BL mentioned something specific in his diary, I doubt we will ever really know "why". All we really know is that somehow he confesses to killing her in the diary, but I have never seen a quote, or even paraphrase, of what he wrote. We don't even know when he wrote it: Was it early after his return to Florida, or was it written after he became suicidal? I question if, in his state of mind at the time, his confession accurately describes the event.

BL and GP are somewhat peripheral characters in this lawsuit. Assuming this goes to trial, the case will come down to what the Laundries knew, when they knew it, what they did about it, and what was their intent. Only the L's know for sure, and it is unlikely they will volunteer much information.
