She keeps tweeting about all the evidence she has. Getting him out on a technicality goes against everything she has claimed up to this point.

CoolJ stated no one has to be proved innocent, which is correct legally. Zellner could get him out on a technicality or proof he is innocent. We all have to wait and see what happens.

I know that a "technicality" is a possibility. I NEVER said it wasn't. I am stating that it flys in the face of what Zellner has been claiming for months now.

As I understand Avery's current status: Zellner's appeal is being presented before the Wisconsin Court Of Appeals for District II. That district has four elected judges, and this is Avery's second appeal before that body. However, there will be only three judges who have a decision to make, or to refuse to even hear his case. If they refuse to hear his case, then I do not know what Avery's next move allows: The Supreme Court Of Wisconsin has already refused to hear it.

This second time around, the issue of new evidence regarding third-party involvement will need to be far more challenging than any time before. Zellner will need to place a "qualified Denny perpetrator" at the immediate murder scene at the appropriate time (which seems to be sometime between 2:41 - 4:00 pm), or somehow provide a completely different murder scene which allows for all the compelling evidence found on the Avery property. That seems to me to be a really tough challenge.

With regard to any technicalities of law, I doubt seriously that the three appellate judges are understaffed with insufficient legal talents. In addition, the Wisconsin Attorney General, and the Governor, will be there to offer all assistance. So behind the scenes of "Making A Murderer: Part 2", there will be a lot going on. Politics and money speak loudly. Kathleen Zellner has said that she is a sprinter. It will be interesting to see if she also is willing to wage as much financial support on her race horse as she is with her bombastic tweets.

Shanes said he has a stack of legal filings "a foot and a half" high to go through before he rules, but he set another hearing for June 13.


I can only imagine that the filing for SA will be much bigger LOL

I remember this case also. KZ is from my area, so you hear alot more about her here. If there was ever a case that I though there was a wrongful confession besides BD, this would be that one. I hope she does get Melissa out because I think she is innocent.

I don't know much about the case, but what I read yesterday is crazy, the x-rays being blurred, the coroner changing the cause of death or manner of death. Hopefully she is out soon if what I read is true.

I believe this is somewhat in reference to this article about Ryan Ferguson's lawsuit and how the police officers argued they should have qualified immunity. People have probably been asking her about this case.

The tweet may also be in reference to the the civil complaint against Thomas Kocourek and Denis Vogel. Zellner may have some way of pulling the rabbit from her hat.

I hope we don't see another dead person responsible for the crime as we did in the Mario Casciaro case.

If Zellner can bring the civil suit into the Avery case, she establishes a sound foundation beneath the framework that Strang and Buting began. The Honorable Judge Willis would not permit the connection, for it did not meet the Denny standard.

On the other hand, Zellner may have found the key that opens that door.

She will be in season two whether she had 56 tweets or 5600 tweets, with or without a hashtag. Kinda common sense as she will most likely be by his side as he walks out of prison a free man.

But, I wonder what she will do if she finds out SA really did do it. Would she walk away~~would she work a little less hard on the appeal? Would that be unprofessional for her to not give it her all on the appeal?
