Arias files motion to fire lead attorney Kirk Nurmi

Poor Nurmi. He's tried so hard to get off this case, I'll bet he was doing a little dance of joy when the request was filed. Now he's still stuck with having to stay associated with JA for the forseeable future.

Just can't feel sorry for him....perhaps it's karma for defending all those sex offenders.

:floorlaugh:

MOO

Did the Divas spell Juans' name wrong on their bracelet order list? "Junalicious"??????

ooops.....nevermind....they fixed it!

What will be the next step for the defense team once the new trial date is set? Anyone want to venture a guess. If Jodi is not getting visits from her defense team it's obvious they've reached the bottom of her dry well. Maybe Jodi's mitigation specialist is working with her to try and find someone to speak on her behalf. Seems as if the family is the only one left. Bet Juan would love to see the Aunt on the stand. jmo

I don't have any guesses. I'm just not that creative.

From what I know, it seems that CMJA has used and involved anyone who might be close enough to her to speak as a mitigation witness, making it very dangerous for them to be cross examined by Martinez. As you point out, the aunt has blood all over her hands.

Maybe her high school art teacher? I've read about some DP cases where they got so desperate for mitigation witnesses that they had to resort to long lost teachers.

In Darryl Brewer's interview after the mitigation phase, he indicated that there were plenty of friends to speak on her behalf and he did not know why the DT had not contacted those people. Guess we'll find out if that was a smoke screen or not.

I don't believe a word Brewer says. JA did not really have any friends as Juan rightly pointed out during trial. I'm sure there are a few who knew her in passing but their testimony would not amount to very much. Parents cannot take the stand after everything they revealed to Detective Flores.

Perhaps we should dedicate the song 'Eleanor Rigby' to JA. I can imagine her, post-penalty phase, sitting all alone in her dingy little cell, filing her nails, staring at her hands, doing Yoga poses and making a long, long list of those who fall on her 'Revenge' list. :scared:

I sure would not want to be Nurmi or Willmott now, having to make major decisions on the retrial.

CMJA continues to prove herself to be a loose cannon. Someone who will not follow direction. If they put her back up on the stand again, they have no idea what further damage she might do to herself and their case. Seems to me that her motion to dismiss Nurmi just adds to her being an even more unpredictable witness. If people thought that they saw attitude before on the stand, imagine what it would be like if she takes that seat again!

She's already been found guilty. Putting her back on the stand would be an attempt to humanize her and connect on some positive emotional level with one or more jurors. That's all it takes to defeat a DP verdict.

ALV has said that she will not testify again, yet it is unclear to me if she can refuse to do so under subpoena. Because she is not an Arizona resident, I don't think that the courts have any recourse. Anyone know the answer to this?

The one thing that has become very clear to me is the amount of strategy each side will need to utilize during the jury selection process. Its always a gamble, but some say that the case is made or broken with jury selection.

ALV will not be back. Juan impeached her on the stand. Plus the first jury pretty much did not believe her testimony. jmo

Haven't read here much this past week, did we know about this on the docket?

11/6/2013 005 - ME: Hearing - Party (001) 11/6/2013

Or any details of what it was about?

Good Sunday Sleuthers,
So I was supposed to be having relatives from Canada over our Thanksgiving and found out Friday they are coming today instead. I hate when that happens but will have fun seeing and hosting some of them.

Regarding the retrial, I get a chuckle imagining the discussions (fights) over CMJA wanting to take the stand AGAIN and KN ans JW all but tearing out their hair as they try to discourage the felon from another 18 days of blathering. Oh to be a fly on the wall!!! She is her own worst enemy much to my delight and it will almost be fascinating to see her take the stand post conviction and see how or if the verdict changed her any.

Won't be on much this week, but will catch up after next weekend. Stay safe and happy.

She didn't get rid of Nurmi. On the other hand, according to the news today, it appears Sheriff Joe is making sure she salutes the flag everyday and that she will be eating a health, strictly vegetoarian diet. :D

Hope it's not a repeat and it's not really about the motion to fire Nurmi. It could be a plug for her art teacher as a mitigating witness? How desperate, "yes, Jodi was a wonderful student, so caring, so much attention to detail, truely a Rembrandt" snicker...

O/T, I viewed pictures of Christie's auction that netted $691 million today. One of the top pictures was of course a famous artist & the painting looked as if they took a rolling pin and put different colors of paint dabbed on it and rolled it across the canvas two or three times. I'm going to be painting tomorrow...

I'm hoping JSS is looking at this and saying to CMJA and her defense " you were ready and willing to go to trial as of last Jan. nothing has changed other than a hung jury in the penalty phase. You're work and defense was already prepared for BOTH phases or else we wouldn't have started trial. This is NOT a brand new trial. You should be as ready to go now as you were in May with the SAME evidence , attorneys etc, defense ad nauseum. Stop the nonsense and present the case you had ready in May".

On the MK note, it's real simple. He chooses to defend a woman who stabbed a defenseless, wet man, SITTING in the shower ( which we all know she fooled Travis into doing) and then almost decapitated him and lastly shot him in his beautiful head. I don't give a rats azz what Juan Martinez may have done in his tireless effort to put this kind of waste of human flesh behind bars, he certainly didnt do what she did. I put Michael Kiefer in the same sicko boat as Jose Baez. Ship em off to a deserted island where they can defend each other, oh and while you're at, ask him the golden question" hey Mikey, if Jodi Arias gets out of jail, want us to fix you two up for a date?" No?? Hmmm didnt think so, , this isn't about Jodi at all is it for you. It's about skewering Juan Martinez the defender of the innocent victims. Rot in hell :banghead:
Ok.... Phew, I'm done!!!!

One of the two retrials will be happening by the end of Jan., looks like RC's at the moment, AZLawyer can probably tell us if this means Arias' has to come after because RC's is now scheduled to begin 1/27/14.

Just wanted to add from ACandyRose post on FB (my bold):

Juan says the retrial date for Jodi Arias is TENTATIVE......it may change...... but for now jury selection begins in December.

Having said that, if the Jodi Arias trial DOES begin on this schedule the Chrisman trial would have to be reset to accommodate the JA trial. So.....this is the FIRST that we've heard of a 'window date' for Jodi Arias' penalty phase of her trial. As we all know......anything can happen and postponements are a huge possibility in the courts.

:great:

I don't think it would start the 1st of jan that is a holiday.. So the 2nd then??

Im just glad we are getting closer!

Jodi.... Jodi.... Jodi........ not another :tantrum:
You are stuck with Nurmi and he's stuck with your ugly soul. You got convicted because you're guilty. You have no mitagating factors because you are an conniving, mean ,maniputive, liar, souless, human killer.IMO

I'm wondering if Juan is still:floorlaugh: Will he get to make a written response? I hope so, I'd love to see him legally b*slap her down.:please:

Great Post!!! :)

I think her original trial began Jan. 2nd of this year so I wouldn't be too surprised to see that happen again, if they can get jury selection completed before the year ends.

geevee, yah she gets her way again. What kind of hold does she have on this case? I wish she had a Judge like the one in the Trayvon Martin case. She was no nonsense! bring 'em in and ship 'em out!! I am glad judge said no to firing Nurmi. I honestly think she wants to defend herself on this end dumb *advertiser censored*z..look at MacNeill, not a lot to work with on either side but in and OUT. 3 weeks. We can figure if it starts in Jan..... maybe March? Jury selection shouldn't take more than a month, oh wait! time out for Christmas. :laughcry::what:

This makes no sense!

IT IS ORDERED granting Defendant’s Motion to Preclude or Limit Live Media Coverage of Sentencing Phase Retrial.

Still photographic coverage will be permitted unless an objection is
made by a specific witness prior to testifying. Use of electronic devices will not be permitted in the courtroom.
Any media coverage must comply with Arizona Supreme Court Rule 122 and the policies of the Maricopa County Superior Court. Consistent with this ruling, FTR disks of the trial proceedings will be available to the media and public after the jury has reached a verdict.

http://www.courtminutes.maricopa.gov/docs/Criminal/112013/m6041522.pdf

I really don't understand why media coverage will be limited this time around. Surely if the Judge finds this to be a sound decision then it should have been done for the guilt/innocence phase as well. Why only now? Furthermore, the defendant has thrown herself in front of the camera with interviews etc.

Really don't like this. Not only won't we get to see our Martinez go after his prey like a Bengal Tiger but it seems like an unreasonable motion to grant as well.
