I see that the Macon PD has issued a media release with basically the same sparse information as reported today on 13WMAZ.

See it at this link: http://maconpolice.us/?p=1427

I wonder if Macon's The Telegraph will report this and, if so, whether they will be able to sleuth up any additional information.

Another local TV station also reporting similarly:

QUOTE: ...New evidence results in the Lauren Giddings homicide investigation are in from the FBI and Macon Police Chief Mike Burns says they are "encouraging" in terms of building a case...

...and apparently an earlier version (not much different) at same site:

That's okay, Backwoods, at least it's an indication that the case is going to proceed forward. We might hear more by the weekend. :crossfingers:

Macon Police Department Press Release: Update on Lauren Giddings Homicide
According to the Chief [Macon Chief of Police Mike Burns]:
1. Some evidence has been returned by the FBI, which he calls “encouraging” in terms of building a case. He will not elaborate on the information gleaned in the report and expects to continue receiving information in the case. However, he does not intend to comment on each piece of evidence returned. “When it’s appropriate or necessary, I will make a statement and discuss the progression of the case.”
2. The Chief and Bibb County District Attorney Greg Winters intend to meet about the case in the coming weeks. The meeting hasn’t been scheduled yet.

After a quick look at this article on www.macon.com, it's pretty clear that THIS IS NOT LAUREN ... but it shows, as we discussed a little earlier, that with the cooler weather and with hunters about, these kinds of discoveries happen.

I hope they can solve the mystery of this body's identity quickly and bring answers (though sad ones) to some family's questions.

McDaniel attorney files application for bond
By AMY LEIGH WOMACK and JOE KOVAC JR. - Telegraph staff writers

The Macon attorney representing Stephen Mark McDaniel, charged with the June slaying of his Mercer University classmate and neighbor, has filed an application for bond.

McDaniel, 26, has been held at the Bibb County jail since his arrest on burglary charges July 1. He also is charged with murder in the death of 27-year-old Lauren Giddings. Giddings’ dismembered torso was discovered June 30 outside the Georgia Avenue apartment building where she and McDaniel were next-door neighbors,

NEVER, will McD see the outside of a jail or prison again. My hope anyways ...

In his application for bond, Buford argues that McDaniel doesn’t pose a “significant risk of fleeing” or a “significant threat or danger to any person, or the community or to any property in the community.”

Really? Why wouldn't he run? No job, no business, no school, no home or dependents. He has nothing to keep him from fleeing except those seven pesky counts of sexual exploitation of a minor and that little ole murder charge.

Coverage from Macon television station 13WMAZ:

QUOTE:

McDaniel's Lawyer Asks Judge to Set Bond

...Buford said he's ready to ask for bond for McDaniel after an "extensive investigation" by the defense. He would not discuss details. ... If released, he said, McDaniel will live with his parents in Gwinnett County.

I don't think our boy will be out any time soon, just my humble opinion. He was denied bond on the burglary charge, and now he has murder and child sexual exploitation on top of it . He is just nutty enough he would fly off to Thailand where he could live out all his little evil fantasies.

He can't seriously think they're going to let SMD out on bond. Is there some ulterior motive to doing this now?

Momma wants him to try everything he can, I'm betting. What's there to lose by trying, other than the $ she's willing to put out?

bbm: The difference now is that 90 days have passed from the time some of those charges were brought (and the 90-day mark is fast approaching for the most recent charges) with (apparently) no presentation of a bill of indictment to a Grand Jury. Georgia law, I think, provides that when the 90-day period passes with no indictment, the accused is entitled to bond (with one possible exception -- see below).

And so (not directed at you especially, AgentFrank) this is simply the next appropriate step for a defense attorney under that circumstance. Kaitlyn Wheeler, Lauren's sister, seems to recognize that, as she was quoted in the link from last night at: http://www.macon.com/2011/11/09/1777764/mcdaniel-attorney-applies-for.html

QUOTE:

“I think I just expected it,” said Wheeler, 24, who lives in Maryland, her family’s native state. “As an attorney for a client, that would be your next step.”

One thing to keep in mind now that possibly could come into play is that, according to a link provided to us a little while ago by oldercitizen in reference to another case, there appears to be a provision in Georgia that a judge can extend the 90 days by an additional 90 days in capital cases.

(Read more at oldercitizen's link at http://www.ajc.com/news/clayton/alleged-clayton-deputy-killer-1211557.html about another case in which 90 days passed without review by a grand jury.)

I don't know much about that provision (meaning the one for addition of 90 more days in capital cases) -- perhaps one of our lawyers could enlighten us -- or whether it would happen before a petition for bond was filed or at a bond hearing. And, for that matter, what form of response will the application for bond bring about -- will it be a hearing? Does anyone know?

In reference to the case oldercitizen brought to our attention that I referenced in my post above, a later report says that the accused has a bond hearing set for Nov. 11.

ETA: Whoops, there's a further update; apparently the prosecution got on the stick and took the case to the grand jury -- which indicted the accused.

Also: It seems that, after the indictment in that case, there remained some disagreement about whether the defendant was still entitled to his bond (because of the 90-day thing) ... and I'm not sure if that has been decided or, if so, how it turned out.

The article from The Atlanta Journal Constitution at that link is quite interesting and includes this:

QUOTE:

... UGA endowed law professor Ronald Carlson told the AJC this particular aspect of Bun’s case will drive significant legal debate.

“However, the courts seem to be very strict on this 90-day statute, and very strict on enforcing it on its terms,” Carlson said. “Justice delayed is justice denied.”
...

This article is certainly worth a read and the debate could be one to follow, in case similar circumstances arise in Lauren's case.

Another Macon television station, FOX24 this time, reports the application for bond, saying it is only in regard to the felony murder charge:

QUOTE:

McDaniel Attorney Files for Bond Hearing

... Floyd Buford says he believes its a good time to file for the bond hearing. ...

That paragraph about understanding the charges better is interesting...wonder if it has anything to do with the recent evidence results?

Plain Jane Doe's 11/10 post about newer evidence made me scurry up the thread, to where I saw the 11/2 post #833.
PD Chief said they had some results which were encouraging, but which he w/not further describe.

Did I miss something in the meantime?

Maybe McD's request for bail w/let a bit of evd come to light.

Greetings, fellow sleuthers waiting patiently for anything to happen on Lauren's case. Well, your patience is about to be rewarded as next Tuesday the Grand Jury will be presented with the McDaniel case. It does not look very promising for our young SoL. While the prosecutors will only show enough to get an indictment ( not much ) they have a bunch of stuff, and I mean a bunch. They know exactly how McD was able to subdue Lauren. They have lots of forensics. What is kind of funny, if there is such a thing in this case, is the answer to the question, what is taking them so long ? It has nothing (or little) to do with McD. The judges of Superior Court had to "settle their calendars" and this did not occur until this week. Not sure how the process works , but the clock does start ticking once an indictment comes down, and apparently the calendars had to be "settled" for this to take place or McD could have talked about his poor constitutional rights to a speedy and fair trial being violated. None of the judges wanted this trial, but Howard Simms wound up with it. Another tidbit gleaned ~ Lauren, quoted as saying about McD not long before her death, " Well I am going to be nice to him, because I am scared he is going to go all Columbine on everybody" Let's keep Lauren in our thoughts and prayers as this process plays out. Justice is coming I believe
