CANON CITY, Colo. (KRDO)-- New court records allege that a Cañon City mother knowingly left her 10-month-old baby in the care of a boyfriend that she knew was being abusive, ultimately leading to the baby boy's death.


20-year-old Brook Crawford was arrested earlier this summer, after her boyfriend, 21-year-old William Jacobs was accused of murdering the child -- who died in May this year.

Crawford has been facing misdemeanor and felony charges of child abuse since mid-June, but these new documents show what led detectives to charge her in the case.

Crawford had a preliminary hearing in Fremont County District Courton Friday, July 28, and arguments are due from both parties by August 16th.
 
Regarding the above article - I do not see Jacobs on 8/16 but on 8/23 in the court site. i shall put Crawford on 8/16 for her next hearing - and will check the court site closer to that date.

Oh - never mind - it says arguments DUE on 8/16 - so I will keep her on 7/28 for the time being... :rolleyes:

May I ask, what on earth would a 10-mo old baby have to be 'disciplined' for? A child that young does not understand that much, and is not capable of knowing right from wrong. Ridiculous!!
And don't get me started on dogs being disciplined.
 
It goes on to allege that boyfriend William Jacobs told Crawford that he had "been too rough", and even bit baby Edward, and despite that, she still allowed him to be the child's guardian.

Investigators also spoke to Crawford's mother Candy, who told detectives that she took care of the baby on many occasions -- and that once Jacobs entered the picture, she didn't feel comfortable with him caring for the child -- an assessment that caused fights between Candy and her daughter.

Other friends and family members in those documents say they expressed concern to Crawford about Jacobs' criminal history, or whether he was a good person to have around her and her baby.

Crawford has her next hearing Oct. 11 and Jacobs' preliminary hearing is scheduled for Sept. 27.


I do see that Jacobs preliminary hearing was rescheduled on 9/27 rather than on 8/23, so I shall change that in my notes.
BUT! The Oct 11th hearing date for Crawford is some juvenile case against her & NOT this case. Still waiting for her next updated hearing date.

According to court records, Jacobs had just begun living with Edward's mother, Brook Crawford, before the baby's death.

"I'm going to be very blunt here. He has zero investment in this child. Zero. He's watching that baby so he can get laid. That's it. And have a place to sleep," Stanley told 13 Investigates. "I'm sorry to be that blunt, but honest to God, that's what's going on."

"I had just had so many buzzers going off when they said the boyfriend was watching him," Stanley said. "There was a whole lot of things indicative of a prior incident with that baby."

"I think she saw a live-in babysitter. Now she can just really pound out the hours, right? She's got a live-in babysitter," Stanley said.

The 11th DA says she was worried Jacobs would be "gone" if they didn't arrest him soon after the baby's death. [snip]
"I said you got to hook him because he's going to be gone. He knows what's going on. He's no dummy to this process and what's happening and he knows what he did," Stanley said.

An attorney representing the woman charged with child abuse resulting in serious bodily injury has filed a motion to dismiss her case based on “outrageous government conduct.”


The motion filed by Thom LeDoux on behalf of his client, Brook Crawford, 20, claims the 11th Judicial District Attorney’s comments made in an Aug. 1 television interview with KRDO Channel 13 regarding the case are highly prejudicial.


On Aug. 8, the Court gave the District Attorney’s Office 14 days to file a response.

On July 26, the court held a preliminary hearing for Crawford, and at the end of the hearing, rather than finding probable cause and binding the charge over for trial, the presiding magistrate, Claire LeBeau, took the issue under advisement and invited the parties to submit briefs as to whether the DA’s Office had met their burden to establish probable cause, the motion states.


“Just five days later, while the Court’s decision is still pending and without any other apparent reason, DA (Linda) Stanely met with a television reporter in her office for the purpose of making public statements about the case,” the motion states.

A Fremont County magistrate has ruled that there was not sufficient evidence to bind over a felony child abuse charge against the mother of a 10-month-old baby who died May 21 after he allegedly was abused by his caregiver.


Brook N. Crawford, 20, was arrested in June in connection with the death of her 10-month-old son, Edward Hayes, who died May 23 after he allegedly was abused by William Jacobs, 21, Crawford’s live-in boyfriend. Jacobs has formally been charged with first-degree murder.


Magistrate Colette LeBeau issued her order Aug. 28, dismissing Count 1, Child Abuse Resulting in Serious Bodily Injury, a Class 3 felony, in Crawford’s case.

6/28/23 Update: Crawford appeared in court for formal filing of charges Wednesday. Crawford is facing charges of child abuse, a Class 3 felony; child abuse, a Class 1 misdemeanor & cruelty to animals – neglect. Next preliminary hearing on 7/26/23 @ 1:30pm.
7/26/23 Update: Preliminary hearing. State witnesses: Cañon City Police Detective Kassi Roquemore. Fremont County Chief Deputy Coroner Laura Allen. CCPD Detective Sgt. Timothy Smelser. Magistrate Claire LeBeau on Wednesday asked both parties to submit written arguments by Aug. 16. She will review those & will issue a written order & put a new court date when she files her ruling regarding moving the case forward.

A hearing was scheduled Monday to consider the motion filed by the attorney representing the woman formerly charged with child abuse resulting in serious bodily injury to dismiss her case based on “outrageous government conduct.”

Crawford made her first court appearance Monday since her case was bound down to county court.

LeDoux said the original motion asked for an immediate hearing on his motion to dismiss.


“Absent a motion to dismiss today, we’d be asking for some sort of movement on that motion,” LeDoux said during Monday's court appearance. “I don’t think the facts are contested, but perhaps a hearing would make sense from a procedural standpoint.”


Judge Alexandra Robak was not prepared to issue a ruling, and Deputy District Attorney Patrick Frye also was not prepared to proceed with a hearing.


The basis of the motion is a news report containing an interview given by KRDO to the elected district attorney, Linda Stanley, which includes a transcript of the interview.

6/21/23 Update: Magistrate Michael Meyrick granted Jacobs a $100K cash or surety bond Wednesday in Fremont County Court. Jacobs was set to appear for a proof evident, presumption great hearing Wednesday, but a Colorado Supreme Court ruling in a separate case Tuesday made him eligible for bond. The case, called ‘In re People v. Smith,’ states that a no bond hold in capital cases violates the Constitution & now is null & void, according to Deputy District Attorney Wendy Owens. Next pretrial conference hearing on 7/12/23.
