9/6/23 Update: Magistrate Colette LeBeau has ruled that there was not sufficient evidence to bind over a felony child abuse charge against the mother of a 10-month-old baby who died May 21 after he allegedly was abused by his caregiver. Magistrate LeBeau issued her order Aug. 28, 2023, dismissing Count 1, Child Abuse Resulting in Serious Bodily Injury, a Class 3 felony, in Crawford’s case. Crawford is slated to appear in county court 9/25/23 to set an arraignment date on two misdemeanor counts stemming from this case.
9/25/23 Update: A hearing to consider the motion filed by the attorney representing the woman formerly charged with child abuse resulting in serious bodily injury to dismiss her case based on “outrageous government conduct.” The motion filed by Thom LeDoux on behalf of his client, Brook Crawford claims the 11th Judicial District Attorney’s comments made in an Aug. 1, 2023 television interview with KRDO Channel 13 regarding the case are highly prejudicial. Crawford made her first court appearance Monday since her case was bound down to county court. LeDoux said the original motion asked for an immediate hearing on his motion to dismiss. “Absent a motion to dismiss today, we’d be asking for some sort of movement on that motion,” LeDoux said during Monday's court appearance. “I don’t think the facts are contested, but perhaps a hearing would make sense from a procedural standpoint.” Judge Alexandra Robak was not prepared to issue a ruling & Deputy DA Patrick Frye also was not prepared to proceed with a hearing. The basis of the motion is a news report containing an interview given by KRDO to the elected DA Linda Stanley, which includes a transcript of the interview. Judge Robak set the motions hearing on 10/25/23 @ 9:30am.

After listening to a preliminary hearing that was held on four separate dates in October and November, Magistrate Claire LeBeau on Wednesday found there was sufficient probable cause to bind over three counts against the man accused in the death of a 10-month-old baby earlier this year.

William Jacobs, 21, was the last person to care for 10-month-old Edward Hayes who died after being discovered unresponsive in a Cañon City motel room in May.

LeBeau found probable cause to bind over three counts to a jury trial, including murder in the first degree, child abuse resulting in death and child abuse resulting in serious bodily injury.

LeBeau pointed out the testimony that was most impactful to the court findings, including testimony to Edward's traumatic injuries to his brain and spinal cord, a small bruise on his forehead, a bruise on his back and a bite mark on his arm.

The El Paso County Coroner's final diagnosis was blunt-force head trauma.

Crawford is slated for arraignment on Jan. 5. Jacobs will appear for arraignment on Jan. 8.

Judge Thomas Flesher, an assigned judge from Pueblo, accepted a not-guilty plea from the woman previously charged with child abuse resulting in serious bodily injury and set the case for trial while he continued to consider a motion to dismiss the case.

In August, Thom LeDoux, the attorney representing his client, Brook Crawford, 21, filed a motion to dismiss her case based on “outrageous government conduct” by 11th Judicial District Attorney Linda Stanley.

Crawford’s felony charge of child abuse resulting in serious bodily injury was dismissed in August for lack of probable cause. Her other charges stemming from this case were moved to county court as misdemeanors: child abuse and cruelty to animals/neglect.

Flesher heard motions from both sides on Dec. 5, but Tuesday he said he still wasn't comfortable issuing a ruling and needed more time to review the materials. He ordered a transcript from the previous preliminary hearing for himself, the defense and the prosecution.
He also ordered that LeDoux and Deputy District Attorney Wendy Owens submit in writing what they believe an appropriate sanction in this case would be, aside from dismissal. They also must attach reports that pertain to evidence and whether they would be admissible in trial.

The parties have two weeks to submit their reports to the court.

Flesher said his calendar is booking up into June, so he tentatively set a two-week trial beginning July 9.

In the meantime, both parties may file motions while waiting for the judge's ruling. Flesher scheduled a setting for March 18.
