CHARLOTTE COUNTY -- Prosecutors are weighing whether to seek a first-degree murder indictment against Scott Huss, who is accused of killing his wife, Yana Huss, in front of her 8-year-old son earlier this year.

Huss is charged with second-degree murder, punishable by up to life in prison.

A first-degree conviction would make him eligible for the death penalty.

Assistant State Attorney Daniel Feinberg set no time frame for when prosecutors would decide whether to seek a first-degree murder indictment from a grand jury.

The main difference between a first- and second-degree murder charge is premeditation, which the state must prove for a first-degree murder indictment.

Nearly 1,300 pages of court documents made public last week include some indications that Huss may have planned an attack on his wife.

In a letter that was apparently written before the killing, Huss wrote that he could not forgive his wife "any more."

"I pray that you have a relationship with Jesus and he forgives you for what you have done," Huss wrote. "I hope to see you on the other side, perhaps there you will see my love for you."
 
Isn't it the mantra of the abuser to always blame the victim, and accept no blame and responsibility for his actions. Especially with this family. I would not let any kids within 20 miles of any of the relatives of Scott. Not a chance.
 
Granny Huss wants to keep the little girl and not her brother. And she withheld info from police about a murder for several hours. I wonder how she explained that to police? She had a letter in hand that gave the appearance that her son was going to commit suicide and still didn't call police. And she thinks she is the best canidate for keeping the child? She sounds like she is almost as bad as Scott.
 
She can want away! No one is going to give her a two year old child. The woman is 75 years old :banghead: I can't imagine knowing that my son murdered my daughter-in-law and my just letting her lay there all day and not calling and turning my son in. Being old isn't any excuse either. Doesn't sound like she is senile.

Ohhhhhh no - Granny Huss DOES want both children ever since it was recommended that the children be kept together. As far as I am concerned, she can spend her last penny trying to get these kids because it will NEVER happen. Karma is a MF'er and Granny H is going to find that out as she continues to enable her son, Scott.

She explained nothing to the police - but she did lie to them. The evidence in this case has been made public and I can promise each and every one of you that when you hear what comes out at trial, you will be even more dismayed. Prayers for her children are always welcome and needed.

Exactly! What I have not shared yet is the fact that Granny Huss was trying to evict Yana and the children from the home, so she sure was not concerned about anyone except for Scott Huss and his repeat alcoholic violent actions.

The child was covered in blood. She did nothing. It must suck to be her.....

CHARLOTTE: Accused killer could face first degree murder charges

CHARLOTTE COUNTY - Scott Huss's lawyer expects a grand jury will return a first degree murder charge against his client.

Huss is accused of killing his wife, Yana, in their Port Charlotte home in April.

Monday, Yana Huss's mother listened to the lawyer argue for more time to prepare a defense.

The lawyer, Thomas Marryott, says he expects to go overseas to obtain international depositions. Both the victim and her eight-year old son are from Russia.

As WINK News was first to report, court documents say the 8-year old boy witnessed the killing.

New court documents released reveal Scott Huss took his step-son to his mother's home in Central Florida. Reports say the boy was covered in blood and was carrying a suitcase, which contained a 12-page manifesto, written by Scott.

Documents also show, that it took the suspect's family several hours to contact police after the 8-year old showed up at their door.

"Yana Shalina met her future husband, Scott Lee Huss through an online dating service in 2002. She lived in Saint Petersburg, Russia and he lived in Port Charlotte, (Charlotte County) Florida in the United States. Media reports are that Scott traveled back and forth to Russia to met and get to know his future bride-to-be. Yana was a widow with a young son Peter Shalina, whose father was murdered in Russia. Scott had prior marriages and had several children of his own.

Yana and Scott were married February 7, 2003 in Murdock, Florida. Within two months the abuse started when Scott fired a gun several times in the front yard and told Yana he was going "feed her to the alligators." That same year Yana enrolled in a nursing program at Manatee Community College. Scott was working for the Charlotte County Fire & EMS as a computer specialist but he was fired in 2004. The next year was peppered with more abuse and restraining orders but Yana was afraid and she kept rescinding the injunctions. In 2005 their daughter Katrina Shalina Huss was born and Scott bought a house in Charlotte County Florida.

The abuse continued and Yana Huss called the Charlotte County Sheriff's Office 19 times since the couple moved into their Rickover Street house two years before. On April 25, 2007 Yana was murdered in her home. Reports are that her son Peter witnessed the murder. Scott then drove eight year old Peter in a shirt covered with his mother's blood for three hours to his own mother's house in Longwood, (Seminole County) Florida, 170 miles away.

Several hours had past before Scott's mother notified the police while she took young Peter to lunch and to Walmarts to buy him a clean shirt. In the meantime, Scott's mother was in telephone and e-mail communication with her son who added another 264 miles to his escape destination of Tallahassee, Florida. Scott Huss was captured in Tallahassee at a Greyhound bus terminal buying a ticket to Texas and charged with Yana Huss' murder.

This seems to happen to alot of Russian mail order brides. I guess in the beginning they are submissive to their American husband but as time goes on they start asserting some independance and it pisses the hubby off.

ok i just looked at post 21 on those forums. my heart breaks for what that poor baby had to see. i can only imagine the fear he felt as he was chased around the home tracking his mothers blood.
 
PUNTA GORDA -- A man accused of murdering his wife lost his parental rights to the daughter he had with the victim, and she and his stepson may move to Russia with their new guardian, the victim's mother.

At the Charlotte County Justice Center Thursday morning, 20th Circuit Judge Donald E. Pellecchia granted a petition to terminate the parental rights of Scott Huss, 49, who is charged with the second-degree murder of his wife, Yana Huss, 31, at her Port Charlotte home in April. Scott and Yana had a 2-year-old daughter, Katrina, and Yana had an 8-year-old son, Peter Shalin, from a previous marriage in Russia.

Pellecchia appointed Yana's mother, Elena Kuchinskaya, the guardian of both children. Kuchinskaya is a Russian citizen temporarily residing in the United States and caring for the children, according to testimony by Department of Children and Families officials, but her visa was due to expire on Oct. 26, at which point she will be required to leave the country. DCF officials could not formally recommend the children be placed with her because a home study could not be conducted in St. Petersburg, Russia, as per agency rules.

Huss signed a document terminating his parental rights at the Charlotte County Jail on Sept. 14. According to court records, Yana's murder followed a long history of domestic disputes between the pair; at the time of the homicide, Yana was trying to divorce Scott.

"To not accept this voluntary termination would move (the children) back," testified Frank Harder, the guardian ad litem for the children.

Harder said Peter was initially concerned about the possibility of moving to Russia to live with his mother's relatives, believing it may be too cold for him. However, Harder said the boy, who allegedly witnessed his mother's stabbing, had changed his mind and was eager to move.

"Anything we could do to make that happen, we would do," Harder said.

DCF officials said home studies had also been conducted with members of Scott's family.

I have just happened upon this thread. What a very, very sad story. That poor, poor little boy. I hope and pray that the children will be placed with Yana's mother. My thoughts and prayers to this family.
