A judge rejected a prosecutor's contention Friday that authorities can indefinitely hold guns, cars and other items taken from Drew Peterson's home.


Will County Judge Richard Schoenstedt did not order prosecutors to return the items seized in November during the execution of a search warrant at Peterson's home.

But, he told them, "I don't believe as I sit here today the words 'pending investigation' was meant to convey 'forever,' " when it comes to how long the items can remain in authorities' possession.

Andrew Abood is part of a team of lawyers retained by Drew Peterson, the retired Illinois police sergeant authorities have named as a suspect in his wife's disappearance.

2 more Savio relatives ask to reopen estate

[SIZE=-1]The father of Kathleen Savio and one of his children have filed notice of their intent to reopen the estate of the former wife of Drew Peterson.[/SIZE]

Attorney Martin Glink filed notice in Will County Circuit Court this week on behalf of Henry J. Savio and Susan Doman.

Their motion would be both a petition to reopen the case and a response to a Jan. 31 petition by Kathleen Savio's sister and brother, Anna Doman and Henry M. Savio, which sought to block the father from being named executor of the estate.
 
Bolingbrook, IL - A hearing on two requests to reopen the estate of Drew Peterson’s third wife is set to go before a Will County judge briefly Wednesday morning.

Attorneys for both sides expect the judge to schedule another hearing for Monday, March 17, to give both sides more time to prepare before presenting their petitions and arguments.

JOLIET -- Lawyers representing Kathleen Savio's family were in court for the first time Wednesday morning as they try to take control of her estate from Drew Peterson, her former husband, and one of his relatives.

But the hearing was brief.

Joliet lawyer Lawrence Varsek simply asked Will County Judge Carmen Goodman if they could return to court on March 17.

The parties involved in the case need time to organize various issues, he said.

The judge quickly agreed.

The Savio family believes that all of Savio's assets should go to her children.

convicted cop killer reputed to have organized crime connections was subpoenaed to testify at the grand jury investigating the fate of Drew Peterson's last two wives.

State police served Anthony "Bindy" Rock, 68, with his papers Friday, a source said. Contacted Friday night, Rock declined to comment.

Rock was a central figure in an unsanctioned undercover investigation Peterson undertook while he was on loan from the Bolingbrook Police Department to the Metropolitan Area Narcotics Squad in 1985. That investigation led to Peterson's indictment on charges of official misconduct and failure to report a bribe.

"We have been investigating this as a murder since reopening the case in November of last year. We now have a scientific basis to formally and publicly classify it as such," said State's Atty. James Glasgow.

"I'm scared," Peterson said Friday from the doorway of his house. But soon after he offered to come outside for an interview if a female television news reporter agreed to don a bikini. Last year, TV reporter Amy Jacobson was released from her job with NBC 5 Chicago after she was filmed in a bikini while visiting the Plainfield home of Craig Stebic, whose wife Stacy disappeared.

New autopsy results show his third wife was murdered, but Drew Peterson said Friday he doesn't believe the release of the medical report is a signal that he soon may be charged in her 2004 drowning death.

Still, Peterson, 53, said he's ready for whatever happens following the new conclusion that Kathleen Savio's bathtub death was not an accident.

"I'm just riding it out,'' Peterson said from the doorway of his Bolingbrook home.

"It's just more controversy, more bulls--t.''

The death of the third wife of former police officer Drew Peterson has been officially declared a homicide after a second autopsy revealed she drowned, the Will County state's attorney said Thursday.

Kathleen Savio's body was exhumed in November after Peterson's fourth wife, Stacy Peterson, disappeared and questions arose about Savio's death.

Peterson's family members said the findings confirmed every suspicion they already had about Peterson, Ponce reported. Peterson declined to comment on the story.

"There's not a doubt in my mind," said Kerry Simmons, Stacy Peterson's stepsister. "I think he had something to do with it, and he had something to do with Stacy being gone."

Simmons also said that "there were mistakes" made in the autopsy four years ago.

This is what Kathleen Savio wanted: Someone to know that she was murdered. But now, as authorities this week classified the death of Drew Peterson's ex-wife as a homicide and not an accidental drowning--as it was in 2004 when her body was found in her bathtub--the question is whether investigators are any closer to finding her killer.

The Will County state's attorney's office and the Illinois State Police are not calling Peterson a suspect as he's been called in the disappearance of his current wife, Stacy Peterson. But to some who have followed the case, authorities--who only took a second look at Savio's death after Stacy Peterson vanished last fall --are sending a clear signal they are onto something.

Family and friends of Stacy Peterson will hold a fundraiser in Bolingbrook on Sunday. The money will be used to resume the search for Stacy. She has been missing since last October. Her husband Drew Peterson has been named a suspect in her disappearance, but no charges have been filed against him.

The search for Stacy fundraiser will be held at 115 Bourbon Street in Merrionette Park and the doors open at 1 p.m.

Drew Peterson is scheduled on Thursday to fly to New York City for another national media appearance, he confirmed Tuesday night. He did not say exactly what that will be about.

Although it's been nearly four months since Stacy Peterson was heard from, her friends and family have not lessened their resolve to find her once winter releases its hold on area waterways and fields.

Volunteers work tirelessly to get the word out. Over the weekend they passed out 1,500 fliers with information about a fundraiser this Sunday to pay for the search. A non-profit group was established in her name. A Web site dedicated to the case remains active.
