Update!

Brandon Toseland - Trial is now going to start OCT 2023 on a continuous basis.

Mason was in the house not only with his sister but with his cousins who were Brandon’s children who the mother of those 2 children are Mason’s Paternal Aunt. Mason’s Mother was married to her younger brother who name is Elijah Dominguez, before anyone gets confused that means Mason’s mother and Brandon’s kids mother are sister in laws! And all 4 children were cousins. Brandon and masons mother were not related they both had ties to Elijah and his sister.

Does anyone know if the Las Vegas police department are looking into the mother! Things don’t make sense especially from reading her grand jury testimony

@MADE333 do you have a link to the info about the trial being set for October 2023. I have been looking and looking for updates about when to expect trial and hadn't found any. Thanks,

His jury trial is now scheduled for October 16.

Toseland appeared in court on Tuesday morning, where his defense attorneys told the judge that they had not received all the evidence from the prosecution's investigators yet.

District Attorney asked the judge to continue the hearing for a few more weeks to complete the process, explaining that the individual responsible had taken time off, causing a "backup" in the discovery.

With no protest from the defense, the judge set the date for the next discovery hearing for May 2, 2023.

LAS VEGAS (KTNV) — Complaints filed against the Las Vegas Metropolitan Police Department by former Clark County public administrator Robert Telles and Brandon Toseland, the man accused of killing his girlfriend's son and putting his body in a freezer, have been dismissed.
Complaints filed by Robert Telles, Brandon Toseland dismissed by Clark County Citizen Review Board

LAS VEGAS (KLAS) — Attorneys for a Las Vegas man accused of killing his girlfriend’s 4-year-old son and concealing the boy’s body in a freezer believe there may be months’ worth of surveillance video from inside the home the family shared.
[snip]
Mason had allegedly undergone months of reported abuse at the hands of Toseland and was taken out of school to avoid teachers seeing his injuries, documents obtained by the 8 News Now Investigators last year said. Mason was last seen alive on Dec. 11, 2021. He lived with his mother, sister and Toseland at a northeast valley home.

In court Tuesday, Toseland’s attorneys said the home had five security cameras recording inside. They asked Clark County District Court Judge Carli Kierny to force prosecutors to hand over all video surveillance in their client’s case, but prosecutors said Cox, which administered the system, said there was no footage.

Toseland’s attorneys also asked Kierny to require prosecutors to provide them with any footage recorded from inside a Metro transport vehicle during Toseland’s arrest. It remained unclear Tuesday if the footage even existed.

“There was a camera pointed straight at me,” Toseland said in court.

Toseland, who often speaks out of turn in court, spoke up again Tuesday because the hearing ended.

“So, how this process goes Mr. Toseland is they make a request, the state responds with what they have, and then your attorneys litigate it further,” Kierny said when Toseland asked to speak. “You don’t just talk about in court about what you believe exists. Thank you.”

Metro police made two attempts at recovering video from the server, prosecutors wrote in court documents. During the first attempt, the device displayed the message: “Camera connection failed.”

Prosecutors said investigators later determined the device itself did not store any video but was relayed to a Cox server, documents said. Cox responded to a search warrant for video from December 2021 to the day after Toseland’s arrest, saying there was no video footage available

Prosecutors said they are considering the death penalty should Toseland be convicted. Toseland has pleaded not guilty to all charges.

Kierny was scheduled to hear arguments about the home security system and any other video on Feb. 13.

“To suggest that detectives failed to collect evidence, knowing full well that the device was collected and that multiple attempts were made to find potentially relevant evidence, is misleading at best,” Chief Deputy District Attorney Michelle Fleck wrote in court documents Wednesday.

Toseland’s attorneys said they have “compelling evidence that the entire Cox system was funded and operational at the time of the defendant’s arrest in February 2022,” documents said. They added a panel on the server was removed, allegedly damaging it.
Las Vegas murder case involving boy found in freezer focuses on home videos

so defense strategy appears to be, there was video that will exonerate my client your honor, but the prosecution won't give it to us. (prosecutor gives them the news that Cox Communications says no video exists) Defense: your honor, if that's the case then LE or the prosecution destroyed the evidence. GMFB

Las Vegas (KSNV) — A local man accused of killing his girlfriend's son and later stuffing his body into a freezer appeared in a local courtroom Tuesday morning.

He claimed in court on Tuesday that the state may be tampering with evidence, saying there were photos reportedly from his phone that weren't his.

Toseland went on to say that he will file a motion to replace his attorneys.

He is due back in court next month.
Man accused of killing girlfriend's son, hiding body in freezer appears in court

LAS VEGAS (KLAS) — The man accused of killing his girlfriend’s son and storing his body in a freezer appeared in court Tuesday after a judge ordered him in her courtroom by any means necessary.
[snip]
Toseland, who has remained in custody since his arrest, appeared in court Tuesday on a motion to continue his trial and replace his lawyer. Toseland had refused to meet with his attorneys three times in March and refused transport from jail to the courthouse last week.

Tuesday’s hearing was private and closed to the public and the media.

Judge Carli Kierny will hear further arguments in the case on April 30. A new trial date was not scheduled as Toseland’s new attorneys will need to review the entire case. Toseland’s original trial was scheduled to begin in May.
