OK, so if the Judge allows this surrebuttal request, and it fails, will the DT then file another one - next claiming JA was sleepwalking? When does it end......DOES it end?

It's ridiculous and the DT is making a mockery of the system with this request.

Didn't Jodi say on the stand in answer to a juror's question that she was not in fear or angry at Travis. Did the DT forget that?

She also testified that she shot TA before he threatened her. The DT must have forgotten that...

I hope the Judge denies the DT. It might be grounds for an appeal, but there's an auto appeal in AZ for DP anyway. After all the evidence especially from shrinks/therapists and the DT had 2...screw 'em. :banghead:

I'm going to edit this a little, based on other sleuths' comments, that reminded me of how the DT has dragged this out FOREVER based on nothing (e. g., ALV). I hope no rebuttal witnesses are allowed, because there's really nothing they can say to refute what Dr. D. testified to. She was very thorough, stuck to validated, reliable scales and results, and her testimony was impeccable!

I'm sure they can find someone to re-refute Travis was afraid, a victim, and to disagree with BPD dx. Now whether or not they're truly an expert remains to be seen.

Has anyone seen the actual motions yet? And yes, there is an animal called "sur-surrebuttal", but I am not an Arizona lawyer. Just a WAG here, but I'll bet they DT is going to have the new shrink testify that since Jodi was abused as a child (allegedly) that she was more likely to perceive abuse in her "adult" relationships, or some BS like that. Regardless, "The Prosecutor" will get a chance to question this dude before he takes the stand (if that is even allowed, which I don't think it should be).

I think they've only known it since Dr.D did her assessment but yes it was years ago. My guess is they chose not to believe it thinking their experts would triumph over the states witness and when that flopped they had to pull a rabbit out of their hat.
If this guy is a friend of ALV, my guess is he'll spend as much time rehabilitating her as he does discrediting Dr D.

I really hope it's denied but my gut says it won't be. :furious:

And even if they didn't know 1-2 years ago, surely they knew once they stole the doctor's laptop.

Although incredibly frustrated at the idea of a Surrebuttal just when we thought we were nearing the end of The Neverending Trial ... and an inclusion of Manslaughter after sudden argument being included in the jury instructions, there's actually some good news there.

1. Defence knows their 'self defence argument' is screwed. They know it all fell as flat as a pancake and it ain't going to fly.

2. They know their PTSD and Battered Woman's Syndrome argument fell as flat as a crepe and those two explanations of Jodi's behaviour leading to the murder, then forgetting most of it DID NOT FLY.

3. They know they can't bring back ALV or Dr Samuals because their credibility has been shot to pieces by Dr DeMarte and there's no chance of a rehabilitation.

Bad news: We know it's going to happen because the judge just will not risk an appeal on this issue down the road, so we may as well just suck it up and get used to it. And it will go for DAYS and it will probably mean more of Nurmi, and our computers are all at high risk of being thrown out a window during testimony.

OT: I was thinking last night that isn't it funny .. remember that story about Jodi supposedly getting 'raped' in Travis' office the day of the murder. Haven't heard much about that one for awhile. Don't remember it coming up in jury questions either. Love how some of Jodi's stories disappear or are practically dismissed. Did Dr Samuals or ALV go into much detail about it, I can't remember .. I don't think they did .. I could be wrong ..

He was a psych professor at the university in my area and ran a Family Violence research project as well. He also was involved with the local Crisis Center and shelter. What I remember is that he was very intelligent, somewhat detached, but also a really nice man. He had a very professional, calm, objective approach and left his emotions out of it. He did work as an expert witness even back then. I doubt in these ways he has changed. I just can't imagine him getting involved in this case. That really troubles and upsets me.

Oh dear. It would be awful if the DT had hoodwinked a really good person. :rocker::rocker:

Well I think technically the BPD diagnosis was new information, even though it was rebutting the PTSD diagnosis.

BBM: Well if the DT or their "spies" were reading here, I have been saying FOR MONTHS that JA's diagnosis is BPD (ad nauseum, of course).

I bet my lily-white-ones that it is JA herself that is demanding this cockamamey surrebuttal of "Manslaughter by Quarrel" nonsense.

And of course Wilm*tt has to give into her "soul sister" JA's demands while Nurm* sits way back and chuckles.

Maybe the DT just wants to make sure the jury has all the options just in case they dont believe she killed Travis in Self defense and actually lied and killed him due to being jealous about going to cancun with another woman. From what I've read online, the rebuttal/surrebuttal process can go back and forth until "both sides are satisfied." I trust Juan will handle this appropriately. :twocents:

Why should another quack doctor who hasn't even met with Jodi (unless he's doing that this weekend) be allowed to testify?

How can it be self defense OR crime of passion?

This scares me. I don't think Juan has convinced every juror this was pre-meditated. He needs to do MORE. He needs to prove 3 gas cans, 3 gas purchases, something. I don't know. I feel absolutely sick.

One thing I am CONVINCED of, is that there is NO WAY she will be convicted of a lesser charge such as manslaughter. I know for a fact there are more than a handful of jurors who will NOT budge off 1st degree. So chances of hung jury have increased in my mind.

BBM Please, please don't say "hung jury". Imagine going through this trial again :banghead: ? Maybe the DT won't be able to find a new jury that hasn't heard about the trial?? I don't think I can go through all the "fog, context, patterns, sex, context, sex, sex, sex, and lies, etc" again.

:scared: There could be, although I cannot see how, a juror who is :fence:. I hope the othjer jurors can convince him/her of the truth.
