I believe one big loss for the defense today, was when JB asking for funding other forensic experts Judge Perry stated that he had just approved funding for Dr. Henry Lee, and that thus one forensic expert was all they needed. But, since the judge in Phil Spector's murder trial ruled that Lee removed something from the scene where actress Lana Clarkson was shot and withheld it from the prosecution, the SA will be free to bring up that fact during his cross examination. Since he will be he only defense forensic expert, and his testimony will easily be called in question …

And Dr. Lee will not be allowed to testify none what so ever about the decomposed hair since JB stated in open court that he was not an expert in that area.

I hope the whale won.

Either way, you get to see a lot of blubber. OMG, I'm sorry, it had to be said.
To stay on topic, I also really like this judge, this is going to be very interesting, hope I live long enough to see it through, LOL

No meds. I think this was inmate Anthonys first full in her face wakeup to the serious of her actions. I think she was having flash backs as well as flash forwards of her life. She knows what the side bar was about. She knows why the A clan wasn't there, she knows what her fate will be.

Also I think she was being self contained with the new rules she was told to follow. She had deep breaths as well as lots of swallowing. It was evident when CM asked that she not have to attend hearings anymore.

She knows ..... I feel a plea coming down the road. ........ bus coming for the A compound residents.

I think her unnatural stillness is in her mind just another game she's playing in cahoots with her 'boys' (reminds me of a little kid who's been told to remain very, very still and quiet). This is her twisted version of following court and defence orders. She doesn't know how else to do it, either, because she doesn't have the emotions of a normal person. It's way over the top. But for her it's a victory. The only true giveaway about her is that mostly her eyes look dead.

O.M.G. I have witnessed a lot of "lawyers leaving the courtroom" interviews in my day, but I have never seen anything quite like little-boy-Baez throwing a hissy fit when encountered by a few tough (fair!!) questions by WFTV's Kathi Belich! Unbelievable!!

snipped respectfully

I think CM looked a little dazed and confused by JB's behaviour. He seemed to be trying to respectfully answer questions, if I am not mistaken. The funniest part of it all was when JB took CM aside and whispered in his ear, and then they started walking again. Straight from the grade 3 school yard playbook. Poor CM, can't fault him here.

Now, THAT was funny - bless!

I watched the hearing but am no good at posting and listening at the same time so I have a couple of after thoughts I would like to ask others their opinions of.

First the way JP keep bringing up that this being a DP case when he agreed to things. During the first hearing I thought he brought up the DP so much as he was trying to stress the seriousness of the charges to KC but today I got a different impression. Today I got the impression that he was almost admonishing the SA for seeking the DP on this case each time he said it.

Second when they was discussing the need for a cell phone expert and the pings. It almost sounded like JP was saying that testimony may not even be permissible as you couldn't prove who was in possession of the phone.

Please tell me I am wrong on both accounts and that it was just me today after trying to watch such a long hearing with only a little sleep last night.

A few of JP's statements didn't set well with me today. Yes, he did continuously reference this being a death penalty case when ruling. My mouth dropped open when he made the comment about the cell phone testimony. Sorry, but, I don't feel this was appropriate. He also threw the word "extraordinary" around frequently. At one point, I think he said the case was extraordinary because all the evidence is circumstantial. Since when is a circumstantial case considered extraordinary?? :waitasec:

When JS recused himself, it was my opinion the Defense had a good reason for wanting JP to reside over the case. That opinion has not changed.;)

Do we know what the 4 new motions are that CM said he filed today?

05-06-2010 Motion
Defendant's Motion for Reconsideration of Certain Prior Rulings by Disqualified Judge

05-06-2010 Motion to Intervene
for the Limited Purpose of Opposing Defendants Motion to Seal all Justice Administration Commission Documents

05-06-2010 Memorandum
in Support of Request for Reciprocal Compliance

These are the only new ones that appear on the docket today

thank heavens the defense is asking to bring an expert to debunk the cadaver dog testimony/ i.e. the scientific reliability of cadaver dogs being used to identify human decomposition. I've always had questions about that. No criticism of the dogs, my problem is with the fact that it's so subjective, so many layers of human interpretation and potential human influence are involved IMO. Baez mentions the expert will discuss how cadaver dogs can identify other chemicals as human decomp (other than those actually present in human decomp).

Based on what? They are very effective in recovery efforts in tragedies.

OMG, I just got to watch the after interview. All I kept thinking is how awful it must be to be JB's wife. He was clearly angry and having a tantrum.

As far as the "extraordinary" remarks, the only thing that makes this case any different from any other circumstantial case is the Media Circus that Jose created himself. Now he has to live with it. This is just a simple murder case. Nothing unusual or extraordinary. It is sad, but all murder cases are sad.

I'm so looking forward to this interview - I'm saving it for later :)

Oh that is not what I want to hear or think. Any reasoning you feel like sharing.

I got that impression too but here's my take. Perry said something like 'you can't tell who had the cell phone so you can't tell where Casey was at any given time or that Casey was in possession of that phone.' True but, perhaps Perry isn't very wise in regards to texting. In particular, the amount of texting Casey did. I can't remember the # but the average number of texts that she sent was astounding. I hate to say this because I really like this judge but he may need to be schooled on texting. You can tell who has the phone unless the defense wants to go go down the road that leads to someone stole Casey's phone then impersonated her to her friends.

IMO

Regardless, I think he was out of line. He should wait until the appropriate time to remark on the evidence. His comment allowed JB to get in a little snide remark directed at the SA.

Respectfully, I disagree. I noticed the admiring, "confident" gaze KC gave Mason when JP threw a couple of compliments his way. I think KC believes her defense team will get her out of this.

That's ok ...... inmate Anthony can change her demeanor in a NYC second. JB smiled a couple of times when he got the approval of his experts too. Doesn't mean she getting out this charge and on her merry way rv'ing it down interstate 4 to Tampa either.

At this point in time, almost two years later, inmate Anthony knows she can't change attorneys. She knows, but for all of JBs proffering today, she does not have a chance. The mitigation specialist discussions basically says it all, without making a specific statement of how they are proceeding. JB made critical errors today. CM knew it, we knew it. Not rocket science.

Next weeks hearing will be interesting.

I'm way behind, but I just saw JB's interview afterward. Wow...what a big freaking baby...my, my, my isn't he in a foul mood today.

This might be OT for this thread, if so please advise or move me! Why do I not see George or Cindy on the InSessions recording I did today? Were they not there, and if so - why or any ideas why?
THANKS!

I DID NOT say he wasn't being unbiased and thoughtful in his decisions. He is being more so than I expected. But I was watching his face and his reactions when he is listening to Baez.

I also feel this is a very very professional person who can remain detached from his belief system, and particularly to his own assumptions and logical thinking based on his experience as a judge, and focus completely on the law. But he did grant the defense an unusually high number of out of state experts.

This is just my opinion, not a fact.

logicalgirl ITA with you 100%!

I am certain that his honor Judge Perry has presided over plenty of murder cases in his time, an enough of them to be death penalty cases. I am certain that he's made himself more than familiar with this case and some of the evidence by now. As you so eloquently stated above although I also believe he thinks she will be found guilty he's very good at his job and remains unbiased.

I believe he's being even more so thoughful on the decisions and orders so that once she is found guilty there will be no reason for an appeal of any kind! Kind of like how it's been for Darlie Routier!

O/T a sec the other night I heard a story of a woman accused of murdering her child. They had less than half the curcumstantial evidence they have here for Casey and although it took 3 trials she was eventually found guilty and got LWOP!

LOVE this new Judge !!!! The dream team dosn't look quite so smug today, do they ?? LMAO
