Hmmm I posted a defense theory a week or so back that would require a state of mind witness, and would NOT be a mental health defense and would also NOT be a diminished capacity issue...

And if that's the one they go with I will have to commit hari kari. :banghead:

Any chance of getting a summary of that theory? Or a link to that post? I seemed to have missed it.
 
Oh my. I hope nobody turned off the stream before they showed ICA looking back at somebody with a nasty look on her face and bunching her fists right before she walked through the door with the bailiff.

Any idea about what it could be about?

Ugly coping is my guess. To explain her behavior. Partying, stealing, lying, tattoo, etc. Problem is Casey was already doing these things long before Caylee went missing. So imo her behavior was the same before and after.
 
Diminished capacity is low IQ, or brain problem where the person didn't have the capacity to understand the full consequences of his own actions. (ie: not understanding that if you kill a child they dont come back - sort of)
IMO, that won't work in this case because she was aware enough to package and hide the body. I would think that for this theory to work, Caylee would have still been in KC's trunk when LE responded to the 911.
 
Boy what a day! I'm really grateful that there is no hearing tomorrow because hubby thinks there is, so expects leftovers, and I can spend the day tomorrow catching up on this thread and watching Jose's meltdown again and again! :giggle:

Yep a long long day, ready for a nap now but it is time to start my proper day. Will have to go back and watch the "Baez Break Down" that should not be missed.

If she is speaking of the same theory, AZ's theory is in the legal thread. For further fun :), I moved the theory and RichardH's POV into the 1st degree or lesser thread so that we could bat around her theory and poke holes if possible.

Then she should have left Caylee with GA & CA and walked away. It would have been so easy.

Can someone confirm for me that the defense team stated the state of mind issue was NOT about diminished capacity?

Here's a cut and paste:

I suppose I would go for the theory that Caylee died in a terrible accident, not caused by any culpable negligence on Casey's part, following which Casey engaged in an idiotic cover-up attempt out of mortal terror of her mother, during which she was able to present a "happy face" to the world by suppressing her emotions deep into her subconscious, a symptom of her mental illness caused by the emotional and sexual abuse by her parents and brother. The "Bella Vita" tattoo was to help her remember the beautiful life of her baby, because the emotional suppression caused by her mental illness scared even her. Caylee was the only thing in Casey's life that ever broke through the mental illness and brought out normal emotions in her, so after Caylee was gone Casey's illness got even worse, explaining her horrifically ice-cold statements to police.

THIS is what the defense is going to try to use at Trial ? ?
