2011.04.01 Frye Hearing (DISCUSSION THREAD) - PM edition

So basically this trial is never going to happen, and KC will end up walking because the State can't hold her in jail forever. She'll be out until the State can afford to prosecute her, because the defence has been allowed to suck the taxpayers dry while delaying any real work in this case.

IMO that will NEVER happen. This trial will come off. No murder trial will go this rout, it might happen to a petty theft charge, but this is not petty theft, and there WILL be justice for Caylee. Neither the state nor the nation can afford to let something like this happen, it would signal open season on human killing in the US. Will not happen.

I know everyone is upset, but I think Judge Perry's hands are tied to a certain extent. He can not risk this trial having to be redone. You see the financial strain of this trial is already factoring into him having to go back on his previous statements. I do not believe he intentionally says things and backs out. I truly believe he would love nothing more than to have stayed there late... came in tomorrow and Sunday if need be.

On that note. I do think the hearings will be finished by this week. Judge Perry, imo, already has his mind made up and we all know he does his own research. He is allowing these witnesses to state their opinions for the record so when he does reject them testifying to certain issues or testifying at all... he has a very valid reason to.

I agree - and he tipped his hand when he said, 'I will let it go now but trial is another story.' Or when he said, 'I will allow it for other reasons.' etc.

In the long run, avoiding all the appeals now is cheaper and will make trial smoother. I don't think we will see as much rambling being allowed in at trial. He is very aware a seated jury is not in the room. JMHO, etc...

Why in the world would the DT want this gravy train to end? Taxpayers of Fla. have no choice but to keep paying their salaries. ICA is snug as a bug in county jail....no big bad prison for her!!

Judge wants to talk about money?? Really?? He could speed this up if he wanted to. ICA is smiling a lot because she sees all this attention about HER rights....all those people around her...protecting her....petting her. And just look! Even the judge seems smitten!! Pfft....look at Caylee's side. Only 2 people. ICA is STILL more important than Caylee!! Cindy, George and Lee have proven that!

I believe she is particularly happy today because she thinks this whole charade is working.
I know it is silly and I am constantly :deadhorse: on the subject, but I just cannot wait for the civil trial. I think the criminal jury, who will be done with their work, will be in awe of the things that come out in that trial that they do not get to hear in her criminal trial-If they convict, they will feel affirmation when M&M get through with KC. They're gonna lay her whole ball of lies out for the world to see, and hopefully there are little clear plastic TV's playing in KC's prison with inmates in every cell watching the civil matter.
Better keep her in solitary if that happens.

I do realize HHJP's hands are tied.What bothers me are the empty threats that he must KNOW he can't follow through on. CM sure knew ,back when LDB brought it to the Court"s attention that CM was flouting the deposition deadlines. He KNEW. So what's the point? Empty threats only encourage bad behavior.
Say something you really CAN do.

Sure, but...

It's his courtroom, he should have never allowed Logan to testify, or the "expert" JA challenged as being in violation of discovery. The defence is running amok and HHJP is not taking the time saving outs that's pretty much handed to him on a silver platter: expert witness that wasn't, discovery violation witness.

He could have taken the out and told the defence: No, these witnesses can't testify. Next!

The defence is like an out of control toddler who has never heard the word no, so continues to smash the crystal.

My opinions only.

This is all I can say. I am not a Judge. I have no idea what goes into being a Judge and the very serious decisions that they have to make. I will say that since Judge Perry has a very impressive record... I will trust what he is doing is in the best interest for everyone involved in this case.

I have faith in him and I think he has done a good job in getting this case to the point it is at today. I don't think Judge Perry simply goes home and relaxes when he leaves the courthouse. I believe he spends many, many hours going over all the testimony, case law, and whatever else it is that Judge's do.

All I can say is... Keep the Faith!

Hotel reservations have to be made soon. They haven't even picked a jury and they're still stuck on the Frye hearings. I doubt they'll finish them next week. I'd like to send over a judge from Texas to get this to trial.

There is no way this trial can start in May.

I'm glad you brought that up, I was just thinking about that. HHJP brought up the hotel reservation deposit as being non refundable correct? In Texas they have an express lane for Casey and her ilk :great:

This was posted by the mods(thank you 'Beach! ) in the summary thread for today's hearing. I watched the whole hearing, and after seeing what has been put together I can say it is 'right on.' Really, its amazing. If you want to know what happened and be entertained this is it~ :cool2:

I am going with those who say this was a Frye hearing, not the trial-it will be different. I think the judge did get his gavel on, although I do worry the trial might not start on time. I am not ready to believe that yet. :sigh:

by my calculations (08/09/2005 -06/16/2008) Caylee was here 1042 days

If we go to jury selection May 9, 2011 (from 06/16/2008), she will have been gone 1057 days

I'm think the defense wants to delay the trial because they are scared that Casey will be sentenced to death on Caylee's 6th Birthday.

In past hearings, once the main hearing thread is closed, IME we all scamper off and bump the requisite thread.

But after this one, not so much. No new threads started, no old threads bumped.

Are we just all getting tired?

Or was there really nothing new to add after today's presentations?

ITA, they can only avoid the piper for so long. It's going to happen. And once it does happen, they delaying and prolonging via the appeal process can begin anew.
No worries, KC, you won't see the needle for at least a couple of decades...and to think, sweet Caylee lasted only a fraction of that.

And might I add that Caylee never got the opportunity to have an appeal court review her death sentence.

It's ok, those who want to see justice for Caylee are patient. I can wait. Because no matter what means that Casey dies, if it be by natural causes or getting the death sentence, she will eventually have to enter the next life. And that, that my friends, is when she will truly face her punishment. She will have to face her maker in the next life. There's no running from that Casey.
