Does anyone else find this BS? In my opinion I don't think it is right that they could smell the garbage from the defense yet HHJP is not letting them sniff the can? I don't know I just kind of find that completely unfair. :banghead:

HHJP probably feels he's pushed the envelope far enough allowing the "smell" in the can to be admitted in the first place (via Dr. Vass). I don't blame him.

Whatever. I just want to get on with it already.

(I do believe the jurors should be able to smell the cans if they want to.)

"Judges are not supposed to be potted plants" and with that #CaseyAnthony jury will NOT be allowed to smell cans back in evidence room
by abcashleigh via twitter at 1:55 PM

Guys, the state was not asking for the jury to be able to open the cans. They were stating they wanted to present evidence that the smell in them would be fainter now than earlier, in case: 1) The judge allowed them to open the cans or 2), the jury opened the cans in the jury room, with or without jury instructions to the contrary.

The state was afraid that should the jury smell the cans, and didn't smell much, it would hurt the state's case.

But the judge said not only would he NOT allow the jury to smell the cans, he would make sure they didn't sneak a sniff during deliberations, by not allowing that evidence back in the deliberation room. Thus, the testimony JA wanted to present would not be necessary. (And, it was not rebuttal evidence).

I'm fine with the jury not smelling the can.. IMO it has well been established that little Caylee's body was In that car..

Her very own mother and father had stated there was smell of human decomp and then SA has drove it home by proving that the human decomp was from Caylee Anthony..

Chief Judge will not allow Vincent to testify.. Says it's not rebuttal.. Ample evidence already presented about smell in car

Believes rather.. He won't send the can back to jury.. So they won't be able to open it

He believe it would violate Casey's rights

i don't think i'm going to watch the rebuttal case. I need a break from it all.

JB has another Gentiva concern

Oh, Geez! The DT does not want this testimony of Cindy's that clearly favors the defense theory to be challenged. Cindy has told (at least) one too many lies and needs to be held accountable. jmo

The judge's decision is correct. It could work against the state as well as the defense depending on interpretation by each juror
