My question is.

Why is this Florida court system sooo into giving Mark this carte blanche podium while not speeding up the murder trial?

What is the hold up?

Jimmy should have been tried and found guilty months ago.

But he still gets to linger around as well. Wth

Btw. Jimmy had the evidence on him with several people tying him to the murder.

So why hasn't jimmy been tried and found guilty already?

Its not like he is a billionaire with big connections. Jmo

This court is just dragging things out and Teresas family should be hopefully mad at the judges decision to allow Jimmy lawyers to prolong his trial. Just as well as Marks lawyers. Jmo

Lots of evidence and many depositions to be taken. Add to it the upcoming holidays and we are hurried to being patient. ;--)

Proper ruling. I can hardly believe the defense team filed this motion. They had to know it wasn't going to fly.

I wonder if MS is reading up on law and then directs his attorneys to file certain motions....it would make sense to see such things as this. In MS eyes he is smarter then everyone!
 
Two things -

First, there is a Case Management hearing (aka status hearing) scheduled for tomorrow 12/15 at 8:30 am (eastern) .

Secondly, what piqued my interest was on 11/28/2016 the State filed their Answer to an Amended Demand for Discovery (filed by the Defense). See PDF attached below.

Here is a MSM link regarding the "Confidential Witness" cited in their Answer. (it appears this discovery is sealed but not sure). If anyone has time to try to find our more regarding what led to this Commander's hasty retirement that might be enlightening. :angel:

I can see it now. MS supervising his attorneys. He thinks he is so smart. Studying up in jail. Mr. Expert. Uh huh. If I were him I would slap myself on a regular basis.

I don't know if Mark is qualified to supervise his lawyers but some one needs to shake his lawyers. According to documents that were filed 12/22 on the court website, it states that the lawyers for Mark did not include the $300 filing fee for the appeal or include their personal bar number on the correspondence. For a professional to "miss" or "forget" those things is unprofessional for a high profile case.

I agree...has MS ever been declared 'broke' and the state will pay for everything? If he was, does the appointed attorney have to pay in check or cash or does it go against an account in MS name? The lawyers forgetting their bar number tells me incompetence on several peoples part and delay tactic.

I've been thinking about the trial of MS and I think he will testify because he thinks that with all of his charm (puke) that he can be acquitted. Who on earth would also testify that he's this great guy that would never arrange a hit on his beautiful wife? He's the only person I can think of. [emoji41]

Maybe his lawyer will remember the filing fee and his bar number this time
 
On 1/30/17 (yesterday) the court filed a order for Mark's lawyers to pay filing fees. $300 . So unprofessional not to pay......

In recent days, Judge Bruce Kyle handed down his decision on the plans to appoint a death qualified attorney for Mark Sievers to work alongside Faga Law Group.

Kyle is asking that Sievers, qualified as indigent, go through the process to have a death qualified attorney appointed to him, as opposed to selecting the attorney he'll receive.

The next court date for both defendants is scheduled for May 4.

In reading the above posts....if there is a trial this year, it maybe in the fall. However, the DP lawyer needs to be caught up to speed and I see delays and delays by this laywer. There needs to be a DP lawyer. The Judge needs to appoint one...ASAP, since MS has been declared indigent.

It appears from the sidebar thread, Sievers lawyers still have not paid a filing fee. Why not? They are getting paid by the state....they pay, file paper work and will get reimbursed....or I would think. So yes, I think not paying is a stall tactic. Again the Judge needs to act on this.

Any legal WS care to enlighten as to why the current lawyers have not paid filing fees? Why such a delay in the DP lawyer appointment, as I understood, MS had been declared indigent for some time, since Nov, 2017. One should have been appt. back then. I do realize that MS lawyers wanted to hand pick their own DP and it was denied....but one should have been assigned by now, yes/no?
