Since the Mirror is based in the U.K., I believe that their ‘first floor’ is our ‘second floor.’ So, I’m guessing that:

1: the affidavit is the one we all know so well.

2: Mirror mixed up DM with BF

3: Mirror removed the dark clothes because, well, nakedness makes a better story. Likewise for run vs walk.

MOO, of course

Well then, they're wrong about where BM's room was, then. Her room was on floor zero/ground floor/(first floor American).

No surprise there. I believe someone is using internet rumor + the Probable Cause Affidavit + confusing the two roommates.

Something like that.

IMO.

What affidavit could the Mirror possibly mean, I wonder? The only unsealed affidavit that I know of is the PCA - but that's not in there, or we'd have been discussing it non-stop.

How did the Mirror get a sealed affidavit? It's intriguing and the Mirror is considered MSM here, I believe.

That could explain what appeared to be LE's keen interest in that back slider. But what the hey??

IMO.

That’s what I thought, too, but when I read the Mirror article more carefully, it claims there’s another affidavit. “Mr Bitoni [a PI hired by the defense] wrote in an affidavit...”

I just thought of another possibility: that the article is written by an AI that’s having ‘hallucinations’—just making things up.

Incoming speculation from me. :) THAT could certainly explain alot. And it makes a lot of sense to me. The idea that a second non-resident male ran into the house, killed everyone, then naked from the house while BK was circling the neighborhood in his car is just absurd to me. I suppose it could be argued that a second person entered the house either naked, or stripped off before leaving. Of course, then I have other questions, including 1) how did this person get to the house? 2) were any other cars seen on video circling the neighborhood during that same period of time?

It could also explain the THUD (throwing the bloodied clothes into the trunk) and him driving quickly from the area. And the long drive. Because somewhere he would have to stop and dress without being seen.

Assuming the Mirror is not publishing total fiction today, and BF did see a naked person after DM saw a person in black, I can totally see the defense trying to interpret that into something besides BK stripping off bloodied clothes at the door on his way out. I don't think it will work, but it's a logical thing to try for
There was another white car sighted: Taylor Road 2:45-3:15 which was not mentioned in the PCA.

If he had to strip off his clothes, that decreases the timeline even more.

I am interested in when she saw someone (if the Mirror is accurate).

The when of the thud is not clear (to me). The PCA mentions 4:12 TikT, Thud 4:17, then goes into DM opening the door a third time to see a male. Did she actually open the door the third time before the thud or after?

MOO

The material witness warrant signed by JudgeM mentions the affidavit of RB, investigator. Not sure how they would have been able to see it though (gag order) unless it showed up in the Nevada documents?

It's Exhibit 3 in the Nevada docs....That is the affidavit of the investigator Richard Bitoni....

edited to also say: There's nothing in there about another white car, a naked man, or anything new.....IMO

This white car on Taylor:

In your link there are three exhibits that are blurred out, those are what I was speculating might contain details.

MOO

Those sheets with Exhibit at the top are just cover sheets....nothing is blurred out. And thanks for the link....

So the defense investigator's affadavit mentions that BF was interviewed several times by LE and she described things she heard and saw.

Could be that things she "saw" were later that morning when she woke up and left her room.

Or maybe she told LE about things she saw (and heard) earlier that morning, around the time of the murders.

I have trust issues with the Mirror, so I'm definitely not putting a lot of stock in their report. Having said that, coveralls are designed to be easy to get on and off. :) If he planned and practiced this whole thing, I'm sure he would have practiced removing coveralls as well.

But yet BK's defense team is saying this information of a naked man in the house will be exculpatory to their client, NOT that this naked person was yet another version of BK being the suspect?

I'm with @U.N. Known ...."what in the name of made up nonsense is this".....

THE AFFIDAVIT DOESN'T SAY ANYTHING ABOUT A NAKED MAN, or that BF saw him....

I miss KG's father. We need an insider who is vocal. Too bad free speech has been sacrificed completely for what the judge thinks are more important rights superceding *almost* all rights of the public (we do get those "blind leading the blind" absent-any-context doc releases online - yippee).

And no, it's not just prurient interest that has me longing for sunshine on these legal proceedings.

JMO

IMO, KG is free to speak. His attorney can't, but I think he can. JMO.

I think he'd make too big a mess stripping out of bloody clothes on the way out. IMO, the article only makes sense if we start thinking about some of the speculation in the early days, that there were two intruders/killers. DM saw one and BF saw the other. JMO.
Not with practice.
Stripping fast used to be a timed part of boyscout lifesaving skills, as in coming across a drowing person in your street clothes and how fast can you get to scivvies. Vans slip on and off.

I can only find two MSM articles (maybe only one that's allowed here: Newsweek), published on Jan. 23, 2023. And it says:

So "online speculation" is the source there. The article goes on to say that in Idaho, such a Grand Jury could be convened without notifying the Defense (or, obviously, the press).

The second article is from Fox and does NOT say there's a Grand Jury being convened. Instead, it mentions what Grand Juries in Idaho might be like:

From that article, we learn about what prosecutors CAN do and what they COULD do, according to an Idaho lawyer who is not associated with the case:

Neither article says there is a Grand Jury. So much obliged if anyone can find an actual source for that.

@PrairieWind has cleared up the confusion further, I believe. So No Grand Jury (that we know of).

IMO.
Thanks everyone.

So this article says BF saw a naked running out the sliding glass door? Also says she came face to face with the killer. I’m not sure I believe this. Thoughts?

IMO, a Grand Jury is not off the table in this case, even if only used for certain matters before the PH and trial and not in lieu of them.

There could be traumatized/intimidated/threatened confidential informants and witnesses whose identities need to be protected in the privacy of a GJ setting or LE wouldn't let them give testimony for fear they would be harmed.

Someone familiar with Idaho criminal proceedings, please correct me if I'm wrong, but I didn't think it was "either or", and both GJ and open hearings and trials could be used in a mosaic fashion in a complex case with 5 felony charges, and 1 suspect who refuses to answer LE questions ( Bryan Kohberger stopped police interview after question about Idaho murders ).

JMO
GJ sounds like speculation.
It's possible a grand jury could be convened in secret in May in the Bryan Kohberger case.
"We won't know about it. It will be a surprise if they find probable cause through the grand jury process."
If that happens -- the preliminary hearing in June won't happen.

Stripping with the outside soil ending up rolled up insIde of coveralls as one takes them off is a learned skill.

Depends on the amount of blood, in my experience. If the crime scene was as bloody as we've been told (and I imagine it was given the injuries reported), I find it hard to believe. But I guess we'll see.
