I'm confused.:bang:How about tomorrow's hearing -"CA/GA"... On or Off???
 
Me too, confused that is. Why even go to court tomorrow if the whole case can be dismissed?

The Judge said that he will NOT say the case is frivolous!
I believe there is NO chance the Judge will outright DISMISS the case. But, he is struggling with whether or not he should put the Zenaida case on "hold" until after the murder case is finished.
To me, it seems that if the main problem is the questions/interrogatories that Zenaida's attorneys will ask KC in the interrogatories, and Mitnik has volunteered to remove the questions about whether KC killed Caylee, or knows who killed her, then the Judge can let the Zenaida case move forward, and the Judge can rule on which specific questions that KC does NOT have to answer if the Judge thinks the questions would impact KC negatively in her murder trial.
Right now the Judge has to rule on specific questions to decide if George, Cindy, Lee, and Dominic must answer specific questions....... so, the Judge could do the same thing with KC's questions in the Zenaida case.
The Defense is saying that KC cannot pick and choose which questions she answers in the Zenaida case though. They are saying if she answer ANY of Morgan's questions, other than her name, then she has to answer ALL of the questions. That is why Mitnik agreed already to remove some of the tough questions.
 
The Judge brought up an interesting issue which neither side has addressed yet (I guess the attorneys are waiting for it to actually get to trial.)

The Judge said that maybe they cannot piggy back the defamation that CINDY personally committed by saying that CASEY told Cindy to go to the media and say that she had NOT cleared Morgan's client - Zenaida.

I wonder if it is going to be hard for Morgan to prove defamation by CASEY against Zenaida in this situation, since CINDY is the one who did the actual speaking of the words to the media???? Seems like the Judge was pointing out a good argument for the DEFENSE to use in the defamation case.
 
The defense is asking for a dismissal,but they have a countersuit.Shouldn't they drop that? Isn't the countersuit part of the reason JM needed the depos?

In the media thread it says JM considered a case against CA,but decided not to pursue it at this time.That would allow CA to take the 5th ,which would greatly diminish ZFG's case. Wow,this gets complicated.I still think they should be able to use what CA told the media .She did it BECAUSE KC was still perpetuating the lie,and that's the whole point.

IMHO ZG is trying to keep from being thrown under the bus and being blamed for the death of Caylee. If KC's lawyers are going to use the SODDI defense, ZG doesn't want to be the "other dude". Put yourself in ZG's shoes... you are being implicated in the murder of a child you don't even know and you've lost your job because of it. What would you do?

Zenaida's attorneys were allowed to add Punitive Damages to their lawsuit, so they will be allowed to question where allllll of KC's money is - including money that is paying for her high priced defense TEAM of lawyers. If Zenaida wins her defamation lawsuit, and gets a monetary judgment against KC, then if KC would ever make any future movie or book deals or make any money off this case, Zenaida would be able to get some money out of KC.

Zenaida's attorneys also want to clear this innocent woman's time, once and for all.

He greeted Bill Schaeffer - that legal analyst (lawyer) for one of the news stations - I believe WFTV with Kathi Belich.

I missed the hearing this morning, but have watched 40 minutes of the taped version, and if this judge would have just "shut up and listened", that 40 minutes would have been 10 minutes. He (judge) really IS a drama queen. Good Lord, his voice puts me to sleep....and yes, because he keeps interrupting the attorneys, the attorneys keep losing their places. :rolleyes: Thank God that Strickland is the judge in the criminal case, is all I can say!

Yes, the Judge said he would not make a ruling on the Motion to Dismiss - TODAY ..... not sure when he will rule on the Dismiss motion? But, it seemed to me that the Judge was clearly indicating that he would DENY the motion to dismiss.

The Judge especially worried me when he said more than once that he was not sure that he had not made a mistake in denying the previous defense motion to stay/postpone the civil case until after the murder trial ! The Defense attorney jumped with glee at that and even tried to claim VICTORY, but the Judge told him not to assume he knows what the Judge is thinking or what he will rule.

But, Mitnik later volunteered to remove those questions from the interrogatories, if it would help the Judge decide NOT to stay the civil case, and the Judge said he liked that idea and it would weigh strongly in his decision.

I heard his comment to KB, it was when he was outside the courtroom dealing with media that I heard a comment directed to a Mr. Hoover and then the audio cut out. I could be wrong though.

Agreed...KC created and perpetuated the lie, sometimes herself, and sometimes through her mom. I would not agree with the judge that it was piggy-backing, since KC told LE and everyone else she knew to look for ZG at Sawgrass.
KC is the one that volunteered to talk to the police at her house and at Universal, they did not force her to go there and answer questions or give the ZG story. She was supposed to be giving them info to help the find Caylee, which of course would be disseminated.
Then, in jailhouse video, which KC knew would be aired on TV, KC told her mom that she did not eliminate ZG from the photo line-up, that the cops were full of ****.

Thanks for mentioning that again. IMO, that was the ONLY reason for the countersuit, so that no discovery could be obtained immediately on KC's current financial state. JB figured that was more important than any Anthony being able to take the 5th in the original suit.
