The plea and arraignment hearing for a man accused of kidnapping and killing a woman who was jogging has been continued.

Quake Lewellyn’s hearing is now scheduled for February 16, 2021.

Lewellyn’s attorney is asking for a jury trial.
Yea I’m confused on that date... the date was with the first article, then he waived his right.. does that date still stand?

Quake Lewellyn’s attorney turned in paperwork Thursday morning that waives his arraignment hearing.

Lewellyn pleaded not guilty to capital murder, kidnapping, rape and abuse of a corpse in connection to the death of Sydney Sutherland.

Public defender Bill James was assigned to the case and is asking for a jury trial. He said there are a lot of rumors surrounding the case.

Now, some of those theories are being put to rest as newly released court documents detail the evidence mounted against the man accused of kidnapping and killing Sydney Sutherland.

According to search warrant affidavits:
•Quake Lewellyn was known to be the last person who saw SS alive
•QL confessed to running her over with his truck, raping her then burying her body. That confession is yet to be seen by James.
•LE found shoe prints near where her body was found. The affidavit shows the shoes QL was wearing during the time of his arrest did not match.
•QL’s mother Kerry Lewellyn called law enforcement one day after her son’s arrest about a surveillance video they needed to see. In the document, it says Kerry and Lewellyn’s wife Gracie pointed out a dent on the hood of his truck that wasn’t there when he left the morning Sutherland went missing.
•LE also noticed in the video QL wearing shoes they believe matched the shoe prints. In a search warrant, those shoes were found in his home.

Along with the shoes and surveillance footage, State Police also obtained nine articles of clothing.

Lewellyn’s next court date is February 16th.
 
It seems to me that somewhere between 8/20 when Sheriff Lucas stated they were confident SS was not hit by a car because of lack of evidence, and 10/15 date of the affidavit, authorities found evidence that QL rammed SS with his truck.

The search warrant confirms QL's mother provided video evidence of the defendant's truck before and after SS reported missing where the truck had a visible dent after SS missing.

The latest explains the change in the information reported in the affidavit on 10/15 compared to 8/20 to report by Sheriff.

Court filings detail evidence against Sydney Sutherland's accused killer

LITTLE ROCK (KATV) — Newly-released court documents show that the family of a man who admitted to killing Arkansas nurse Sydney Sutherland has helped detectives with their investigation.

Police found the geo-locating app Life360 on Lewellyn's phone after he agreed to let them search it. The app placed him three yards from the scene of the crime the day Sutherland disappeared, a court affidavit states.

Lewellyn told agents with the Arkansas State Police that he ran Sutherland over with his vehicle, drove her to a nearby field and raped her on the tailgate of his truck, according to an affidavit released earlier this month. He said he then dug a hole with a shovel and buried her.

The Newport farmer told officers during an interview that he barely knew Sutherland, authorities said. But according to an affidavit, they graduated from the same small high school in Tuckerman, which typically has less than 200 students. The two were also Facebook friends at one point, police said.

Seven search warrant affidavits were filed in Jackson County Court on Wednesday afternoon. The records list clothing taken from both of his parents’ houses, data taken from Facebook and Life360 and surveillance footage given to detectives by Lewellyn’s mother.

Lewellyn told investigators that he ran over Sutherland with his pickup, drove her to a nearby field, had sexual intercourse with her on the tailgate of his truck, used a shovel to dig a hole and placed her body in the hole, according to police records.

The clothes Lewellyn was wearing also were confiscated during the search of his house, according to an affidavit.

Lewellyn is charged with capital murder, which means he could face the death penalty if convicted. James said no one from the prosecutor's office has told him whether the death penalty will be pursued.

In addition to being charged with capital murder, rape and kidnapping, Lewellyn was charged with one count of abuse of a corpse.

Lewellyn remains behind bars without bail at the Randolph County jail. He was transferred out of the Jackson County jail for safety reasons, authorities said.

James said Thursday that there was no reason for Lewellyn to appear in court for his arraignment, especially considering he is being jailed 60 miles from the courthouse.

"He's being held up in Pocahontas, and there was no reason to drag him down to say that he is not guilty," James said.

The 28-year-old initially told state police that he mowed the 25-year-old nurse down, drove her to a nearby field, then raped her on the tailgate of his truck, according to an affidavit released on October 16.

After the rape, he said he used a shovel to dig a hole, then dumped Sutherland's body in it and buried her, police records obtained by KATV show.

Lewellyn's attorney, Bill James, said he was concerned people were too focused on rumors instead of allowing the trial to play out.

"Everyone is so anxious for information on this case, and it seems that whatever is being said about it is getting printed," the attorney said.

The state medical examiner determined the young nurse had died from multiple blunt force injuries.

Lewellyn's mother, Kerry, handed over security footage from her home to the police, according to KATV.

His wife, who reportedly filed for divorce last month, helped detectives review the footage and pointed out a dent in her husband's truck that showed up the day Sutherland disappeared.

Having reviewed the search warrants, I can only account for clothing and shoes that were collected by investigators for evidence.

Seeing nothing thus far about the alleged shovel used to dig a hole where SS was buried. I'm more interested in whether something like the shovel was used to inflict blunt force injury on the victim (in addition to vehicle impact).

IMO, the question remains when SS died and/or whether she was still alive when raped and buried.

Maggy feels Lewellyn is deserving of the death penalty and hopes he gets that sentence during his trial next year.

Maggy shared that she frequents the various areas where her daughter was last seen and where Sydney's body was found, just days after she was reported missing.

Lewellyn initially told investigators that he barely knew Sutherland, but investigators soon learned that wasn’t the case.

Witnesses told investigators that the two had gone to the same, small Tuckerman high school.

Sutherland and Lewellyn, 28, had also been friends on Facebook, until Lewellyn “recently” unfriended her, authorities said.

“Information that is being requested by Facebook with this warrant will give us the exact time and date of when Llewellyn de-friended Sutherland,” Arkansas State Police Sgt. Ramey Lovan wrote in one of a series of affidavits filed in the case last week.

Sutherland’s iPhone was located in a field about 1.3 miles from her home. Investigators also found a pair of broken sunglasses linked to Sutherland in a barn “a few hundred yards” from where the phone was found, according to an affidavit.

QL agreed to let authorities search his truck. LE located what appeared to be blood inside the cracks of the tailgate and on the tailgate.

The same day Sutherland's body was found, Lewellyn allegedly told authorities that he had run her over with his pickup truck, loaded her into the vehicle, drove her to a field nearby and then sexually violated her “on the tailgate of his truck,” according to an affidavit in the case.

After he was finished, investigators said he used a shovel to dig a grave and bury the body.

I guess we should not be surprised about the notice delivered by the defense. Just hope this evaluation doesn't have any hiccups like the Gannon's case.
