Wow the statement from the eldest daughter is so telling. I'm in the UK so it may be different, but I imagine there will now be information shared by social services/family court and the police/prosecutor?

I'm so sad for all these poor girls, their lives blighted by a father who chose to leave them in a car rather than parent them. I don't think he should be in the home with them whilst he faces these charges, he has a completely free rein to tamper with witnesses and the emotional power over them as their father to do so. JMO

Agree he should not be in the home but that is on their mother.

There will be other forensic evidence, and the oldest girl, so perhaps the younger ones will not be relied upon, their info was most key the day of, it seems to me.

Isn't he back in court again today? Wonder if that will be available on YT as well, like the bond hearing? Would be happy to hear he is being held, esp with the new info re: his treatment of oldest and her removal. But don't expect a change, alas.

IMO it should NOT be up to the mother if he is allowed to be in the home with the surviving children. Time and again we see suspects and/or people under investigation by child protective services and/or LE that are specifically NOT allowed to be around the children.

Technically it is up to the judge. AZ argued that he be held. His attorney and the mom argued released to home. Judge released on the condition he not be alone with the kids. He has plenty of documented evidence re: not following rules/court orders. The doctor took a leave so no one is working. How is that sustainable never mind that the girls are witnesses against him and he may have some feelings about what they told LE? Never mind that doc has a documented history of failing to protect his oldest kid, and her 3.

There was no preliminary hearing yesterday.

I’m happy to see MSM has started reporting on some of the terrible past history of this guy. I did some of my own research early on and was able to find some of the background pieces that are now public, but still felt bad saying that I didn’t have a lot of sympathy for the mom, since I couldn’t bring that info to WS. I still do feel bad for what she must be going through, but it’s hard for me to reconcile her actions (pleading for him to be released home after likely having prior knowledge of him leaving the kids in the car, including his first daughter w/ T1 diabetes) with those feelings of empathy.

I just really hope he is held responsible for his actions in a court of law. He was reckless and irresponsible for what sounds like many years and it finally caught up to him in the worst way possible.

MOO.

When I initially searched, a local AZ tv station link came up that mentioned autopsy and TOXICOLOGY results, but the link is broken or story was taken down. I did not see anything about toxicology in the link I did post about the autopsy coverage above. Has anyone seen that info?

Here is the link to the actual DM article. Comments there are pretty outraged. We'll see what the AZ grand jury decides. Intent is not an element of 2nd degree murder.

Why wasn’t there a hearing? I thought it was scheduled for yesterday.

Change of plans, the case is going to the Grand Jury:

The criminal case of Christopher Scholtes, who is accused of leaving his daughter to die in a hot car in Marana last month, will be sent to a grand jury.

Pima County Attorney's Office confirmed the decision not to advance with a preliminary hearing on Thursday.

I doubt he will even get any sort of time. Apparently, leaving kids in cars is acceptable. This father in Las Vegas, got 30 days...https://www.reviewjournal.com/crime/courts/father-sentenced-to-jail-in-toddlers-hot-car-death-2562939/

Alerts for Occupant's Safety? HOW MANY Are Sufficient?

If, when interior reaches a certain temperature, a car’s system is designed to ---
1. Notify vehicle owner/driver by PHONE.
2. Activate emergency LIGHTS.
3. Activate SIREN.
4. Sound car HORN.
5. Activate cooling FANS.
6. Roll down car WINDOWS.
--- is that sufficient basis for parent to rely on? SIX desirably REDUNDANT features to prevent injuries & deaths. How could parent/driver and/or others close-by not NOTICE these alerts? Doesn’t it seem this system would be FAILSAFE?

No, another hot car death earlier this week.
A 4 y/o who was left in car in a vehicle w the ^ six safety features is now dead.

Not a child but a K-9 member of Arnold, MO. PD. Not trying to equate death of dog w death of child, and not delving into merits of Arnold PD’s dog policy per its Facebook page. More below.
STUFF HAPPENS regardless of whether car occupant is child or dog.

My point? Even when numerous automated, computerized, pre-programmed, or self-activated safety features are incorporated into a system to prevent hot car deaths, they can fail or be ignored. Or both.
Admittedly features like these may have prompted parents in some ALMOST Forgotten-Baby-Syndrome cases to remove a child (thank goodness), but even six alerts may not ALWAYS save a child in a car w these features.

Ultimate responsibility for children's safety lies on PARENT/guardian/driver to remove them from vehicle in a timely fashion. No ifs, ands, or buts.
Exactly what Mr. Scholtes failed to do.
imo
================================================
"Belgian Malinois in the K-9 unit, died from heat exhaustion after his handler left him in a running patrol car Wednesday with the air conditioning on, according to the police department. When Vader's handler returned to the car, he discovered the air conditioning had malfunctioned."
The car was "equipped with an air conditioning alarm system that is supposed to notifiy [sic] the handler by phone, activate the emergency lights and siren, sound the car horn, activate cooling fans and roll down the car windows if the car temperature increases to a certain level."

More info about PD policy re leaving K-9s in running patrol car, as "necessary and common practice when K-9 partner is not actively engaged in police work,
Imo any discussion of that warrants a SEPARATE THREAD to avoid muddying up this case & thread. Again my point: mechanical or technical errors happen, and ppl (can) ignore safety features. Even multiple features.

Such a sad and awful case. Police were there for 40 minutes before breaking a window and thought she was sleeping, but when they pulled her out, she was in rigor mortis. How they couldn’t sentence him for much longer, I can’t imagine, because he lied about how long she’d been in the car (dead 2+ hours due to rigor mortis) and he reported that when he realized she was locked in, she was clearly still alive and moved to the backseat. Preventable and awful. Moo

Good luck trying to read it through all the ads.

Case will go to a grand jury rather than preliminary hearing.
Information re: autopsy here MSN
@LifeIsAMystery Thanks for your post. :)
The autopsy info released seems straightforward.

From azcentral.com Aug. 1*
"The medical examiner indicated that the cause of death was environmental heat exposure and the manner of death an accident, according to the autopsy report."

I had no idea that people would deliberately leave their children in a car with the A/C on as a babysitting technique. In my vehicle, you would have to leave a key in the engine because the A/C would not run if the ignition was not on. So you would be leaving a child in a vehicle that has an elevated potential for theft itself as a hazard, far less the considerations of heat stroke, dehydration, or the psychological effects of being left without communication means or a comforting person around to assure the child of a familiar and safe presence.

Is this something that people do but just don't talk about?

I've never heard of people doing it, but I don't think the car is at risk of getting stolen. It's a remote feature so the key isn't in the car. Someone could take the baby, though.

I am definitely NOT condoning what this guy did, but if he did it frequently as alleged by his wife, AND knew the car shut off after 30 minutes, how hard would it have been for him to set a dang alarm on his phone or say a simple, "Hey Siri/Alexa, set a timer for 30 minutes." He couldn't even be bothered to take 5 seconds to do that. JMO.
