Evidence in Yale murder case yet to come

Some court personnel, including Clark&#8217;s attorney, Joseph E. Lopez, had earlier believed the material would be released at 3 p.m. Thursday. They cited language in the ruling issued by Judge Roland Fasano last Friday at 3 p.m.: contents &#8220;shall remain under seal for 72 hours (three business days) from the date of issuance of this decision&#8221; unless the ruling were appealed.

The court official, who asked not to be identified, said Fasano&#8217;s intent was that the material not be released until Friday, absent appeals. The official said the key phrase in Fasano&#8217;s ruling is &#8220;three business days&#8221; and that they are counted in their entirety: all of Monday, all of Tuesday and all of Thursday.

Police looked at the sign-in schedule task sheets from Sept. 8. They said someone signed in with a green ink pen at 1:30 p.m., and then later the same person's initials were in black ink at 3:48. They said the green ink pen found under Le's body had Clark's DNA on the pen cap and a portion of the pen.

On Sept. 13, investigators inspecting a locker room in the Amistad Street building&#8217;s lower level said they smelled the odor of a body. Canine units found Le&#8217;s body behind the wall, which is behind a toilet, the documents read. Clark is accused of removing insulation to make room for Le&#8217;s body. According to the documents, Le was wearing surgical gloves with her left thumb exposed.

The document describes a moment when he went over to a cart, apparently trying to block an officer&#8217;s view. The affidavit said he moved a box of wipes &#8220;so that the blood spatter was facing to the right-hand side of the cart, away from plain sight.&#8221;

&#8220;He then leaned up against the cart and made small talk&#8221; with the officer, the affidavit said.

Police Warrant: DNA Evidence Links Suspect to Annie Le Killing

A white ankle sock which matched one found on the victim, contained a blood stain. DNA tests on the blood matched both Clark and Le.

The sock was found hidden in a drop ceiling, along with a pair of blood-stained work boots with Ray-C written on the back of the boot.

Police also read through sign-in sheets at some of the lab rooms. On the day of the killing, Clark used a green pen. A green pen was found with Le's body. Tests found DNA from both the victim, and her alleged attacker on the pen.

The DNA evidence, previously thought to be the basis for the arrest, was in fact incomplete at the time; lab testing was still ongoing as of Sept. 17.

Instead, police relied on the found clothing and blood stains, as well as a flurry of keycard swipes by Clark around the time when Le went missing and near where her body was found, in a wall behind a toilet in the basement.

Yale Murder Suspect Hid Blood Splatter, Document Says (Update2)

Affidavit: Green Pen, Bloody Sock Had DNA From Le And Clark

Investigators found blood spatters and stains on evidence in a number of rooms in the basement, the affidavit states.

After a few days, investigators detected a foul odor inside a locker room, and officials brought in police dogs, which found "the lifeless body of a female ... concealed within a wall directly behind the toilet," the affidavit states.

Investigators found blood-like smears throughout the opening, behind the door frame, on pipe insulation and the access panel, the warrant states. Also, insulation was removed from the inside opening of the mechanical case concealing the body, the warrant states.

He is due back in court Dec. 21.

In room G13 where Le was killed, there was a "possible medium velocity blood-like spray pattern on the wall," it states. Blood was found on a sock, a lab coat, rubber gloves and medical scrubs. When Le's body was found, she was wearing rubber gloves that she used while working in the lab, but the thumb on one glove was exposed. Her alleged attacker, Clark, had a scratch on his face and one on his left bicep.

In addition, when her body was discovered, much of the hidden area was smeared with blood-like stains, the warrant states. Details about the state of Le's body are redacted in the warrant.

The arrest warrant also notes that in the week before Le's disappearance, security key cards indicated that Clark has suddenly developed an interest in the rooms where Le worked, entering room G13 and G22 as often as 11 times a day. Previously, Clark entered those rooms only three times a day, the report states.

Le Suspect Scrubbed, Made Small Talk With Cops

The man suspected of strangling Yale graduate student Annie Le was busy scrubbing drains and moving bloodstained evidence right under the glare of investigators searching for his victim, according to his arrest warrant.

He also helped lay out a timeline for Sept. 8:

Clark arrived at work around 7 a.m. that day and used a key card to enter several rooms were animals are housed in the basement.

Around 10:30 a.m., he said, he saw Le working in room G13.

At noon, he left for lunch and returned at 12:30 p.m.

At some time between 12:30 and 12:45 p.m., Le was gathering her notebook and two bags of mouse food and getting ready to leave, he said.

At 12:45 p.m., he said, he left the Amistad building.

The fire alarm went off at 1:55 p.m., set off by steam from equipment used to sterilize lab equipment. Clark said it went off between 2 p.m. and 2:30 p.m., police said.

Yale suspect's floor scrubbing raised suspicions

Authorities said they also found in the building a pair of work boots labeld "Ray-C" that had blood-like stains on them, and a hospital scrub shirt with blood-like stains that was similar to the shirt Clark wore.

Le entered her lab, known as G13, at 10:11 a.m. Sept. 8. Clark's card shows he accessed the victim's lab at about 10:40 a.m. and again at 11:04 a.m. and no other locations for 46 minutes.

Clark's key card was the only one used to access a room where blood was found after Le entered the building, according to the affidavit.

"Clark's movements after this entry are considered uncharacteristic for his normal movements throughout his work day," the affidavit states.

He used his key card to gain entry into the room where Le worked and another room 55 times from 10:40 a.m. to 3:45 p.m. the day Le disappeared, according to the affidavit.

On Sept. 10, two days after Le went missing days before her wedding, Rachel Roth, a graduate student she had worked with, approached Yale Police Officer Sabrina Wood and showed her a box of sanitary wipes that appeared to have a blood spatter on it, according to arrest warrant affidavits.

Wood told police she had found the box on a steel push cart outside the room Le was last known to have entered. Meanwhile Clark, not yet a suspect, entered and exited the room several times, and at one point stopped and looked at the box of Wipe Alls. Subsequent DNA tests determined the blood on the box was Le's, according to the documents.

Clark's behavior turned even more questionable. Back in room G13, he positioned himself between Officer Wood and the metal cart and, while turning toward the police officer, "moved the box of wipes from the corner to the far right corner and turned the box so that the blood spatter was facing the right hand side of the cart away from plain sight," the court documents say.

As investigation unfolded, suspicion of Clark grew

Though police began interviewing Le&#8217;s family, friends and colleagues soon after her roommate, Natalie Powers, reported her missing on the evening of Sept. 8, nothing appeared to involve Clark until Sept. 10. That day, pharmacology postdoctoral fellow Rachel Roth, who worked with Le, approached Yale Police Officer Sabrina Wood, showing her a box of Wipe-All hygienic wipes with what appeared to be splattered blood sitting on a steel pushcart in one of the laboratory rooms Le had worked in G13, prompting Wood to call FBI agents to the scene.

As she waited for the FBI to arrive, Wood watched Clark come in and leave G13 &#8220;several&#8221; times, according to the affidavit. He walked over to the pushcart and shifted the box from one side of the cart to the other, turning it so the spatter faced away from Wood, then leaned on the cart as he made small talk with the officer. Later that day, Clark began scrubbing a drain in G13, even though Wood said it did not appear to need cleaning.

On Sept. 15, police obtained a search and seizure warrant to collect mouth swabs, body hair, fingerprints and fingernail clippings from Clark. DNA tests showed that stains on the sock had a mixture of Le&#8217;s and Clark&#8217;s DNA, while the pen
contained Le&#8217;s blood but Clark&#8217;s DNA inside the pen cap and on the barrel. Over the next few days, more hair fibers and blood stains turned up in various lab rooms.

Judge extends sealing of warrants in Yale killing

A Connecticut judge has agreed to keep sealed for another two weeks search warrant affidavits in the case of an animal research technician charged with killing a Yale graduate student.

New Haven Superior Court Judge Roland Fasano granted a request by prosecutors Tuesday to keep the documents sealed until Dec. 1. Fasano last week unsealed the arrest affidavit in the case.
