Casey Defense Witness Backs Out Of Questioning

ORANGE COUNTY, Fla. -- A key witness, who could help defend Casey Anthony, backed out of being questioned under oath about falsifying documents, but Texas EquuSearch volunteer Laura Buchanan can't avoid prosecutors forever. She's under subpoena and she will have to answer their questions under oath about whether she made up a document to help Casey.

Buchanan was to be deposed by prosecutors for a second time Wednesday about those records. However, Tuesday, Buchanan backed out saying she was ill.

On October 28, they'll question the son of meter reader Roy Kronk, who found Caylee's remains.

Kronk's son, Brandon Sparks, told Casey's lawyers that his father claimed in November of 2008, he knew where Caylee was.

Defense private investigator Jeremy Lyons is being accused by two EquuSearch volunteers of trying to change their testimony about searching the scene where Caylee"s remains were later found. One has already been deposed by the defense and the other has given a statement to investigators.

Lyons was in court recently examining EquuSearch records. He keeps a low public profile, but behind the scenes, he's talking to EquuSearch volunteers who are not happy about it.

Brett Churchill and Brett Reilly, both prosecution witnesses in Casey Anthony's murder case, feel Lyons was trying to get them to change their testimony.

Churchill had already been questioned under oath by the defense for two and a half hours, but says that didn't stop the defense investigator from going to his house and lying to him about Reilly's story.

"He basically was asking me if what I said in my deposition was the exact story because he had others who fared differently, one of them being Brett Reilly," Churchill said.

The defense is trying a third time to seal Casey Anthony's visitation, phone and commissary records at the Orange County jail.
Casey's defense team says releasing her records serves only to embarrass her and invade her privacy.

DEFENSE SPENDING

The state agency funding Casey Anthony's criminal defense has challenged recent cost requests.

Casey's attorneys, Jose Baez and Ann E. Finnell, filed a motion to set a budget for the penalty phase of the case. The Justice Administrative Commission (JAC) recently filed a 9-page response, challenging items like travel and lodging costs for Finnell. The JAC also challenged various rates and questioned the need for a private investigator or psychiatrist.

The Justice Administrative Commission is authorized to pay "due process" costs in the case. The JAC recently filed a 9-page response, challenging many of the defense team's specific requests.

It argues at length, for example, that Casey Anthony's lead counsel, Baez, should pay for Finnell's travel and lodging expenses.

The response cites the court's May 12 order, which says "out-of-state interviews and depositions shall be done through the use of video conferencing equipment available at the Orange County Courthouse."

It also objects to Finnell's travel and lodging expenses between Jacksonville and Orlando.

The response asks the Court to set a hearing on the various expenses requested by the defense.

Judge Belvin Perry is expected to hear the defense’s arguments next week over two recently filed motions.

One asks for Perry to reconsider previous rulings over the public’s access to Anthony’s jail records, such as commissary purchases and visitors logs. The second pertains to a motion asking for Perry to set a budget for penalty phase costs that new defense lawyer Anne Finnell would incur.
 
Big Name Depositions Scheduled In Anthony Case

Court documents indicate three of the depositions are scheduled for Tuesday (10/26) including Anthony’s former fiancée, Grund, his father, Richard Grund, and Orange County Corrections Officer Sylvia Hernandez. Hernandez was fired after allowing Anthony to exchange secret letters with a jailhouse pen pal.


On Wednesday(10/27), defense attorneys will depose lead detective Yuri Melich.


Thursday( 10/28), prosecutors will question former meter reader Roy Kronk’s son, Brandon Sparks. He lives in Washington state and will be questioned via webcam. Prosecutors this week asked for and were granted an interstate subpoena to require that testimony.

Depositions Cancelled Suddenly In Casey Case

ORANGE COUNTY, Fla. -- WFTV is working to find out why two defense depositions that were scheduled for Tuesday morning in the case against Casey Anthony were suddenly cancelled.

WFTV had reported that Casey's former fiancé Jesse Grund and his father Richard were both set to be deposed.

Meanwhile, one of Casey's defense witnesses, who is under investigation for allegedly falsifying records, has a new lawyer. Texas EquuSearch volunteer Laura Buchanan has hired a Fort Lauderdale attorney.

Buchanan is accused of trying to help Casey by falsifying search records to make it appear that Caylee's body was not in the woods three months before she was found there.

Casey Defense Request To Seal Jail Records Denied

Chief Judge Belvin Perry denied the defense's request to seal her jail records and said he's not going to write them a blank check.

Casey's defense has already cost more than $300,000 and Judge Perry didn't give everything to the defense that it asked for.

"When you start talking about taxpayer money, that's a different story," Judge Perry said to Baez.

The defense had asked for another 300 hours at $40 an hour for its private investigator, Jeremy Lyons. However, after Judge Perry looked at documentation of what Lyons has done on the taxpayers' dime so far, Perry gave him only one-fifth of that.

Casey's new death penalty expert, Jacksonville attorney Ann Finnell, will not be reimbursed for her travel expenses as she had requested

"This case has gone on for quite some time. We just need to do what we need to do. I've tried to make a schedule. I've tried to be flexible, but in January, it will be on my schedule," he said. "It is critical that we try to meet those deadlines."

The hearing ended at 3:27pm.

Among the nearly 1,000 pages released are more letters written to Casey behind bars, documents regarding tracking several people involved in the case, and a correction officer's description of Casey's reaction when learning Caylee's body had been found.

Two days after Anthony's defense team questioned medical examiner Jan Garavaglia, or Dr. G., prosecutor Jeff Ashton received an e-mail from the president of a company called Bluestar. After her deposition, defense lawyers told reporters Garavaglia could not show Caylee Anthony was murdered.

In the e-mail between Ashton and Jean-Marc Lefebre-Despeaux, prosecutors eliminated another possible defense theory that Bluestar could have left Chloroform in the car.

From his offices in Monte Carlo, Bluestar's president wrote, "There is no chloroform or similar product in the manufacture of the Bluestar, and the chemical reaction cannot create chloroform."

Deputy Carlos Padilla is among a group of sheriff's investigators giving sworn depositions in the case. Padilla was the office's spokesman on the case.

On several occasions, Anthony defense attorney Jose Baez has criticized the sheriff's office for leaking information to the media.

Padilla said that preserving the integrity of the investigation was always the office's focus.

"Was there any grand scheme to try to point everyone towards Casey as a suspect to the exclusion of everyone else?" asked WESH 2's Bob Kealing.

"Not at all," replied Padilla. "I think the circumstances speak for themselves."

On Thursday, Judge Belvin Perry will hear arguments on a defense motion that asks for approval of DNA testing for two hair samples.

Each of the tests would cost $1,042, which if approved, would be paid for with taxpayer money.

The hair in question is the sample found in Anthony's trunk that has the so-called death band on it, suggesting Caylee Anthony's dead body was in the trunk at some point.

It's trying to show that someone else could have hidden the body there after Casey was in jail on no bond.

Neal Haskell-He's been studying bugs for more than 50 years and has testified in more than 100 trials.

Haskell insists that while his work may look like something out of a science fiction movie or TV drama, there's no junk science in what he does and it's no newcomer to crime solving.

"The first use of forensic entomology was 1265 in China,"
says Haskell.

In a 30-page report that's key to the state's claims, he noted that microscopic scuttle flies, or "coffin flies" as he refers to them, were feeding on decompositional fluids in the trunk of Anthony's car as well as paper towels that may have been used to clean the vehicle.
