Thinking of all jury members... and hoping for a conviction.

Is anyone thinking there will not be a conviction?

I am thinking the evidence is fairly convincing, i mean you can't really confess, take them to where it all happened and then say wasn't me and expect people to believe that can you !!! But that is what he is trying do do...:banghead:

The trial is a formality. There is no way of creating reasonable doubt.

Re the not guilty plea - no one ever accused Cowan of being smart. He's probably just enjoying the attention.

Justice Roslyn Atkinson asked Cowan to stand in the prisoner’s dock shortly before midday.
“Brett Peter Cowan, also known as Shaddo N-unyah Hunter, the prosecution having closed its case against you, I must ask you if you intend to adduce evidence in your defence,’’ she said.
Barrister Angus Edwards answered in his stead...“Mr Cowan will neither give evidence nor call evidence.’’...

"Both counsel tendered admissions in the case of matters that could be accepted beyond reasonable doubt"...

Justice Atkinson told the jurors Counsel would begin their closing addresses on Monday.

Under cross-examination, Snr Sgt Blanchfield said he put to Jackway that he had lied in a previous version to police and Jackway agreed"..."He said there were no other reports or complaints about abduction or violence to children on the Nambour Connection Road on December 7, 2003"...

"Mr Cowan's defence team will then make their closing submissions before Justice Atkinson summarises the case to the jury and outlines their role. She told the jury they should not make any plans next Friday in case their deliberations continue all week"...

Daniel Morcombe murder: Police describe accused killer's arrest

"A police officer has described the day when the man accused of murdering Queensland teenager Daniel Morcombe was arrested...Detective Senior Sergeant Stephen Blanchfield was in charge of the investigation... Cowan was arrested at a Glass House Mountains site about 11:15am on August 13, 2011".

The jury has now left for the week and is expected to return on Monday when crown prosecutors and defence lawyers are expected to give their concluding statements.
 
Jackaway will never be released from prison.

I'm thinking the Prosecution have told the Morecombes privately what they believe happened, that both were involved, but that it is probably NOT in the public interest to proceed with trial for Jackway because he's already locked up for life and this operation has already been (possibly) the most expensive in Qld history.

If it's any consolation MAKO tells us when Jackway was first linked to Daniels disappearance his fellow inmates meted out some justice, enough that he was removed from that prison and placed in another, higher security one for his own protection.

I would've left him there myself but you've got to hope the new prison had much stricter conditions, no sunlight, no access to phones or the internet.

Then again, they could be using Cowan's trial as a discovery to bring J to trial afterwards.

Thanks for all your updates Fuskier. Hopefully this time next week we will have a guilty verdict. Does anyone know what possible sentence Cowan could get if he is found guilty?

I hope this monster gets more than 20 years he is very dangerous to children.

Fuskier if Cowan's counsel convinces the jury that Cowan was just 'big noting himself' beyond reasonable doubt and just observed Daniels murder then Cowan could get accessory after the fact or perverting the course of justice? I'm not legally savvy but I guess either way Cowan would get time but then it all starts again against Jackway?
If that's the case then Jackway will be fuming that Cowan has let out their secret for his advantage. I imagine Jackway is more evil minded than Cowan, if that's possible.
I can't get my head around the turmoil Mr and Mrs Morcombe and family must be experiencing. I hope they are just steps away from closure.

The Courts have the power to stamp "never to be released" despite the 20 year thing.

If a crime is heinous enough, which this is, that is what will likely occur.

Leonard John Fraser is an example.

The sentence proper is served but future parole boards are extremely unlikely to allow release. Ever.

We had a case in south aus where the Attorney General appealed a sentence as being "too lenient" and won thereby forcing a longer sentence.
