Aah, I see what you mean. I think in that case the judge decided that the way they went about getting him to talk was unethical. From what I understood he felt that police hadn’t honoured Lynn’s request to not answer their questions by keeping trying for so long and using (what he viewed as) manipulative tactics to eventually get him to speak.I totally agree with you, from what I know. Which is why I don't understand why some portions of that (2nd) interview were disallowed by Croucher.
The appeal judges actually cited precedent for overriding Croucher where they overrode him. They said that (named) precedent still applied.
Anyway, I will drop it now. I feel that I am going in circles.

A shame, yes but I guess it could be argued the police would never have gotten those answers out of Lynn if they had followed the rule book.It’s a shame they weren’t able to use stuff that would have shown the jury an alternative to the defence claim that Lynn had answered everything truthfully. It seems wrong to me too.

Was he saying that everyone’s looking for them in the bush when they’ve probably run off to a nudist beach? And didn't Lynn also say that Hill had his left hand clenched . If that is correct to me that says Hill was readying himself to punch Lynn with his left hand. That then implies to the way I see this, that Hill was left handed. Racked the bolt action is just pulling the bolt back like you would do with lots of shotguns is that correct? then kocked it. Then all is left is to press the safety switch button which would be near the trigger and then pull the trigger. It seems like a complicated process but it is not that complicated at all for anyone that has an inkling of experience with shotguns which I consider RH had pretty good sound all round knowledge being a well founded country boy at heart. it’s weird that they were allowed to suppress that he didn’t answer questions for 2 days given that Defence put forward an argument that he gave a full account and answered questions honestly etc and it would seem to me Pros could rebut that as character evidence by saying “only after he stonewalled them for 2 days.” But maybe they didn’t push it, in case Pros. continued pushing on the grounds that the police were unethical and they whole thing should go.
