Boucaut: "As much as you might hate the accused, as much as you might dislike his morality..."

"... if the intent to rape is not proved, you would have to find him not guilty of kidnapping."

[20 minutes have elapsed and we’ve heard nothing]

Boucaut says German's scalp lacerations are "spectacular", but the amount of blood shed doesn't reveal a person's intentions.

He says a person whose intent was to kill would've hit with the hammer as hard as they could - and there's no skull fracture.

"Yes, you have spectacular bleeding but the absence of any serious injury simply doesn't sit with a desire to kill."

[I wonder whether RH was singing to himself ‘Killing Them Softly’]

Boucaut: "If he mowed her down with that big car, she would not be here today to tell the story."

"While you might not like it, when you look at the reality of what (the German) has to say..."

"... there are some aspects of it that are not so compelling as the prosecution might have you believe."

Boucaut says German's evidence about hanging on to roof of accused's 4WD "defies common sense... it's incomprehensible".

He says #SaltCreek may be isolated, but a 4WD "driven like a madman with a bloody woman on the roof" would've been noticed.

Boucaut: "If he wanted to rape the Brazilian, he could have and he would have."

Boucaut: "If he wanted to kill the German, he could have and he would have."

Boucaut has concluded his closing address. #SaltCreek will resume tomorrow for judges closing address - then verdict

Boucaut says jury must approach evidence in "detached, emotionless" way "or this man will not get a fair trial".

Boucaut: "If the accused had rape, murder and mayhem on his mind, don't you think it's odd..."

"... he would take not one, but two, travelling companions with him? That fact alone, that he would take another person..."

"... who can help, who could be a witness, would send a warning to you that something is not quite right here."

Boucaut says jurors should also ask why, if rape was the plan, the accused would attempt it "just 20m or so" from the camp.

Boucaut says the man made no attempt to hide his identity before, during or after the alleged incident.

Boucaut: "That's another, further incredible oddity in this case."

It's not odd at all if he planned to kill them. Zero witnesses then.

I personally think that this guy didn't intend for either of them to leave the campsite, ever.

Struggling not to LOATHE the defense over here.....:banghead:

The only truth he's spoken this whole time imo are in his use of the words 'creepy' and 'sleazy' to describe RH.

so bc they survived he didn't really mean to hurt them? bc he's a greedy, unorganized attacker he didn't plan to kill them?
despicable.

i agree! He was taking his time. He had 5 condoms and a packet of viagra to get through. it is a miracle the german didn't die. A damn miracle!

The defense counsel is a big bag of bananas if he thinks the jurors are going to buy any of that. IMO

The Judge's address to the jury has not been tweeted.

BREAKING: #SaltCreek jury has retired to consider its verdict.

THE jury in the Salt Creek kidnapping, sexual assault and attempted murder trial has retired to consider its verdict.

After eight days of evidence, and two days of closing addresses, the jury of seven men and four women began their deliberations just before 11.30am.

Theirs is an 11-member jury panel, because one person who began hearing the trial was hospitalised on Tuesday night.

#SaltCreek jury returns to ask a quick question about the seventh and final count. Justice Kelly answers, says no verdict before 2.15pm.

The #SaltCreek jury's question was about count 7, the man's alleged attack upon the German as she clung to the roof of the 4WD.

In her evidence, she claimed he was trying to get her off the roof - so she responded by trying to "kick in his face".

We've passed the four-hour mark in the #SaltCreek jury's deliberations. Verdicts still being considered.

The #SaltCreek jury can take as long as it likes to deliberate - there's no time limit for it. Deliberations can - and have - go for days.

Deliberations can also go late into the night, over weekends or break and resume on a weekend. Depends on the judge and the jury.

#SaltCreek jury has another question to ask of Justice Trish Kelly. We're more than five hours into deliberations

The wait is agonising. The only good thing I can say about it is that the defence won't be able to say the jury didn't take sufficient time to consider everything.

:waiting: :pullhair: I think we all need :needdrink:

#SaltCreek jury actually has two questions of the court.

Public gallery not told what the jury's 1st question is. In any event, Justice Kelly says the answer to it is: "No".

Justice Kelly says that question related to count 1, which is aggravated kidnapping.

She says the second question - also not read aloud - is also answered "no".

That question pertained to count four, which is the alleged attempted murder of the German.

Justice Kelly tells jurors to consider whether they want dinner and, if so, they'll have it between 6pm and 6.30pm.
