These are the five school mates from Melbourne, on a round-Australia fishing trip, who rescued the missing German girl after, inexplicably, a group of off-duty cops kept fishing instead of leading the search.

She doesn’t want people to feel sorry for her. She doesn’t want to be a victim. She won’t let a random encounter with evil steal the life she loves.

Yes, you are right. Thanks for that. It is mentioned that he stalked the Japanese tourist on FB, in this Australian article that I hadn't read before. A great write-up.

It also mentions how the German backpacker got back into his car with him, after her ordeal and after she had made him throw his weapons into the bush. And I wonder if that is one of the reasons he was found not guilty of intent to kill ... because she got back into his car with him, willingly, and he tried to tend her wounds..

Would anyone of you get back into the car with him?

She sounds like an amazing young woman, tgy. Extremely self-confident, resilient, quick-thinking. It sounds as though she was too smart for this creep, used her brains, her adrenalin, her fitness, to keep herself and her Brazilian travelling companion alive. Went to the rescue of the Brazilian girl, who she apparently did not know very well or for very long, despite the danger to herself.
And who would have thought of climbing onto the roof rack, and clinging to it, to stay out of his angry reach?

No wonder her father is fiercely proud of her. I hope she is fiercely proud of herself.

Not many would have got back into the car with him. Perhaps she needed to get back to her travelling companion, her passport, her belongings. She negotiated with him to get him to toss the weapons away. She did what she could, what she felt she needed to do, to get out of this terrible situation.

So very brave and admirable.

I'm wondering if the old fella was worn out from the whole ordeal, not that early 60s is very old, but if he's not particularly fit and his adrenaline at fizzled out, the German noticed this and took control by getting him to chuck the tools before getting in. He did make a run for it later though once the police were involved, probably had time to catch his breath beforehand!

She certainly is brave and quick thinking young woman, how she cared for her companion's life while risking her own and bargaining with the devil.

She read the play well though, and survived to fight him in court. I think for some offenders they truly do offend in a haze and she saw the moment had passed, she out survived it. Exhausted and hurt, she didn't need to escape him, wasting precious energy given her brutal injuries.

A truly amazing decision she made to sit next to him and allow him to attend to her wounds. I couldn't trust that he didn't have a weapon hidden under his seat.
 
So, what is happening with the sentencing? I got the impression it will be a while due to these suppressed matters we are prevented from knowing about?
 
I believe the defence has 28 days in which to file an application for leave to appeal if they're dissatisfied with the verdict. At the expiration of 28 days, the judge will set a date for sentencing submissions.

The prosecutor will argue re aggravation (why RH should be given a harsh sentence). The defence barrister will argue re mitigation (why he should receive some degree of leniency).

Both arguments will assist the Judge in determining an appropriate sentence.

The issues covered in sentencing submissions usually include:

  • Defendant’s antecedents (prior offences);
  • Victim Impact Statements;
  • Relevant authorities (precedents);
  • Background information pertaining to the defendant;
  • Psychological / Psychiatric Reports for the defendant;
  • Character witnesses for the defendant;
  • Discussion on suitable penalties (tariffs);
  • Any other information relevant to the sentencing of the defendant.

Sentence
Once sentencing submissions are completed, the Judge will set a date to sentence the accused.

This will usually involve setting a head sentence (total time to be served) and non parole period (period that must be served prior to a defendant being eligible for parole).

I've just learned the following:

For appeals against Supreme Court or District Court decisions, the appeal against a conviction may be made on any ground that only involves a question of law; however, the leave (permission) of the court will need to be sought for:

  • appeals against the sentence,
  • appeals against conviction on any ground involving a question of fact, mixed law and fact or another ground of appeal,
  • Appeals against any other ground deemed sufficient by the Court.

An application for appeal must be lodged with the Court of Criminal Appeal within 21 days of the original decision date. Applications lodged after 21 days may still be considered under limited circumstances, and must be accompanied by an extension request.

POLICE have asked the location at which a European tourist was allegedly abducted and raped be kept secret in case other victims of the same offender come forward.

That's an outrageous statement! How can victims come forward if his identity and his property is kept secret?! BS!!!

This Belgian woman was saved by her father, a policeman in Belgium! If there are more victims, they've most likely returned to their country, deeply traumatized and feeling helpless. This man's photo and pictures of his property should be distributed by Interpol overseas.
It appears everything is done to protect the perp and discourage victims coming forward. :no:

May be that the Salt Creek media reports gave this guy inspiration of scouting victims on Gumtree.

I think it is horrendous how the public is not privy to details of the SC case now that the accused has well and truly plead not guilty. We have a right to know.

Unfortunately, this type of suppression happens all over Australia. It is a real travesty. :(

This is Derryn Hinch's take on it, and it is something most other Aussies agree with. So frustrating that the courts uphold these archaic and non-helpful-to-society laws ... due to the 'fear' of vigilante justice. :gaah:


Sexual offences often result in suppression orders unlike other violent crimes. These suppression orders are often introduced under the guise of 'it's to protect the victim' but in actual fact, it is aimed at protecting the identity of the offender.

When sexual assault victims come forward -- and suffer reliving the ordeal under the glare of our court system -- they do it not just for justice for themselves. They also don't want the person who attacked them to be able to do it again to someone else. If the community is not allowed to know who the offender is, that objective fails.

Hinch was charged in 2008 with five counts of contempt of court when he contravened suppression orders by naming the sex offenders during a protest rally.

He argued before the High Court that Victoria's Sex Offenders Monitoring Act was unconstitutional because court proceedings must be conducted publicly.

"They say that it is in the public interest that these names be suppressed, but I don't believe it is. I don't believe the public thinks it is," Hinch said.
