9.10pm - Police search a Toyota Avalon parked outside Mr Tostee's father's house. They find a Sony XPeria mobile phone in the driver's side door compartment. The audio recording is later retrieved from the phone, but it appears the recording initially had been made on a different device.

Interesting to revisit a few things after having both heard the recording and read his explanation on the forum. Good grief, you pay lawyers for a good reason - his poor father - they have put up his bail and THIS is how he behaves? If he had an IQ of 150 once, it seems his neurones aren't firing properly any more. I guess a week of not smiling can do that to a brah.

So there's conflict. My guess would be that the Courier Mail has made the assumption that one of the three phones found had the recording. The phrasing of that sentence "believed to be" suggests that. It makes sense - one wouldn't think that after the police found three phones there'd be more. Or perhaps a police officer said something off the record, which might not have been 100% accurate. Further, the Brisbane Times article is longer after the event, suggesting they have had a chance to get the proper info from documents filed with the court. That would make it more reliable. So my guess is that they did find it on the Sony Xperia in his Dad's car.

BUT they found THREE OTHER phones in what I'm assuming is his car (otherwise why would it be mentioned)? So that's three phones in his car, one in his Dad's, plus whatever phone he was actually using for communication, making a total of at least five.

I'm wondering if he called Tony Ongart from one of those phones in the car in the basement before leaving them? That would explain police then taking Tony's phone, and also why there's no record of it on the recording device.

According to the Brisbane Times article:
2.25am - Police arrive at the scene. At the same time the fob key to Mr Tostee's apartment is activated.

2.28am - CCTV cameras capture a male, believed to be Mr Tostee, approach the front entrance of the apartment. He walks back to the elevator and rides to the basement.

2.29-3.08am - Sounds of walking are heard in the audio recording, which is still going from earlier in the night.
According to the Courier Mail Article:
CCTV footage obtained by police allegedly shows Tostee in the building foyer soon after the tragedy.

Police will allege he hid behind a pillar as police surrounded Ms Wright’s body and can be seen pacing backwards and forwards.

He then allegedly got back into the lift, rode to the basement and left the building.

CCTV cameras allegedly recorded him carrying what appeared to be a phone. Police will allege they later found three mobile phones in a car in the Avalon basement.
According to the Daily Mail:
2.21.50am: Male makes call to lawyer Mick Purcell. Call made from handset. '(Expletive).' Call not connected.

2.22am: Male: 'Where the *advertiser censored** are my keys?'

2.23.30am: 'Oh my god.' Sounds of getting dressed, pulling jeans up, belt etc.

2.26am: Sound of sirens in the background.

2.26.30am: Sound of lift button.

2.28.41am: Walking noises. Footsteps.

2.39.44am: Walking stops.

2.42am: Walking starts again.

2.47am: Call to Michael Purcell.

2.49am: Screen shot taken of phone with images of deceased. Then, a call to deceased.

Putting all that together: I think Tostee went downstairs and saw the drama (where he was seen on CCTV behind a pillar), then went back upstairs to go back to his apartment for some reason (that would explain him approaching the apartment door at 2:28am). He changed his mind, then rode to the basement. I wonder why he went back upstairs?

I also wonder why he suddenly decided to screenshot the images of Rrie on his phone. I'm guessing that had something to do with him planning to delete them later? Or perhaps he was going to SMS the screenshot to a friend for an opinion on whether he should delete them?

I don't think police have ever gotten Rrie's phone, have they? So there could be communication they don't know about.
 
IMO he had contacted his father before the call we hear on the recording.
Even the initial response "OH no" just seems all wrong.

The fact that he agreed to drive around to find bushes to hide near to avoid detection. hmmm

A phone call at that time in the morning would be enough to rattle me.

Wasn't his wife in Adelaide because (father) someone died. To be awoken that late at night would be fearful.

I'm convinced the Sony Xperia found in his Dad's car with the recording on it was planted by Tostee specifically for police to find.

The situation looked really bad for Tostee in the immediate aftermath. As far as anybody was concerned, Rrie was a nice woman who had gone back to Tostee's place for a few drinks and maybe a shag. At least two (possibly more) witnesses reported hearing thumping in the apartment, a fight and a woman screaming, plus they reported seeing her coming over the edge of the balcony. Tostee knows he has a bad history being thrown out of clubs, annoying women, other charges, a conviction............. Tostee thinks that the inevitable conclusion that will be drawn is that he threw her off the balcony.

But then, wait, he has the recording. Of course! OK it doesn't paint him in a perfect light, but it shows Rrie being a bit aggressive and difficult over the course of the night and then an altercation at the end where she absolutely picked something up to def - I mean assault him. And most importantly, it shows HE WASN'T ON THE BALCONY when she actually fell. And that solves that problem - no way he could have turfed her over. Problem solved. Better make sure police find that recording, then....

I don't think Tostee would have known that murder can incorporate a circumstance where someone is fleeing in terror and dies. It's not a typically understood component of murder. And in Tostee's world, I also think that men are entitled to hurt women when they are annoyed with them. There are a lot of men out there who don't understand that they're only allowed to defend/protect themselves, not to harm in a way commensurate with their own irritation or desire to teach a woman a lesson. Tostee certainly strikes me as one of those. So he would have thought the recording entirely favourable to him.

EDIT to clarify: I thought the Audio Recorder App was only available in October, which would put it after the night Rrie died. However, that was for the Smartband Talk, the next generation of Smartband that also acts as a phone. The standard Sony Smartband has been able to use the Recorder App since at least May this year from what I can tell. So Tostee could have had it in August.

Hmmm, yes, they could mean the front entrance of the apartment complex. Hadn't considered that.

I was just having a laugh at my self because I have not heard of a smart band.
I think that is exactly something Tostee would be into, given he is a compulsive recorder and it is cool.
I have always felt whatever was recording was - either stationary or fixed to his body.
I have never been convinced it was his phone.

Does anyone have any idea or reasoning why the recording doesn't start until 00:55am - if GT normally records convo's I find it strange that he doesn't start to record immediately but 3 hours after he met Rrie.

I would think that if he normally records his meetings with females, he would have recorded from the beginning when meeting someone new - did he only want memories of certain events or was the earlier part of their meeting recorded and not sync'd to all his devices?

0.55am - A sound recorder is activated on a device allegedly owned by Mr Tostee. Police are uncertain what was used to record the audio, but say the file appeared to have been transferred to a Sony XPeria phone, which was later seized.

Sleep, this may also explain why his recording only 'starts' at 00:55am. He may have recorded to a different SD card right from the get-go. A lot of phones have changeable SD cards too.

It would also keep his recordings off the cloud, if that is what he wanted.

Conversely, he probably could have recorded, saved to a PC file/cloud file, cleared his memory and started recording again - or something like that.

I think swapping out SD cards would be faster, but if he was just sitting fiddling with his phone who would know what he was doing?

In theory, yes.

This review focuses on the fitness and lifestyle elements of the Smartband (its intended purpose), but it does give you an idea of its longevity, which I've read is genuinely up to 5 days on other sites as well. Also, the Smartband was often bundled with the Sony Xperia, and appears to be most compatible with that phone by design (based on other reviews I've read). The recording was found on an Xperia.

My understanding of the way the audio recording is done is that it doesn't store it on the smartband, but sends it via bluetooth or wifi to the paired phone. It will store data if the phone or a network is out of range. Audio recording might take more battery life than other tasks, but if it can last 5 days I think a few hours would be OK.

It may not be a smartband. That was just the only device that looked like the thing on Tostee's wrist in a couple of photos. There are innumerable watches out there he could have used to record the night and then transfer to computer, phone, tablet etc. The way the recording goes I think it's definitely a watch (or some other item of jewellery that leaves his hands free, and can be on or off at any point without someone being suspicous, but a watch fits that best).

Nope you're not totally confused. There have been more phones associated with this case than I think I've owned. 3 in the car in the basement, his phone and Rrie's phone and one in his Dad's car. The Sony Xperia in his Dad's car had the recording.
 
The smart band does the find my phone thing by ringing it. Maybe some of the banter about Wrie's phone and number was him showing it off ... He wanted to make his band find it for her.
The White band wasn't available in Australia, but well connected mates :bodyguard: :bodyguard: or online shopping would solve that. The whole life tracking aspect fits so well with the psyche of someone obsessed with their conquests. You can pop photos of them on there ...
