Notice how he didn't beat her up? He didn't knock her out. Notice how he didn't grab something and beat her to death? Notice how he didn't grab a knife or something sharp and stab her to death? Nor did he strangle her to death. He didn't even throw her off the balcony when he had the chance.

What did he do? In the middle of the chaos, he grabbed her, escorted her outside, and closed the door behind him. When dealing with someone out of control, like with someone suffering from a mental illness, it is called "de-escalation".

When he closed that door, did he think for a second that she would go over the balcony? No? So where was the intent to kill her? Did he shove her somewhere that no one could find her or she would not be able to summon help? No? So where is the intent to forcibly confine her?

Don't need intent to kill, need intent to cause GBH which was satisfied when he choked her
 
She was drunk and upset. It's not beyond the realm of possibility that she started over the edge intending to throw a scare into him, and lose footing or balance.

I somehow doubt that.

IMO what Tostee prides himself on is his intellect, his attempts at manipulating, mind games. He would get more out of that than knocking her to the ground. I believe the physical force he used on her was an extension of the psychological control he was already attempting to exert. Less about fists IMO.

Edit: Just wanted to add I'm not saying he didn't then proceed with a physical assault. In fact I believe he did. Just that it escalated to that point after he had attempted to use his 'powerful' mind.

GT clearly has this fantasy about himself,the body building, sun bed ,high rise appartment etc, But then uses homebrand products?
It just reinforces the reason I believe he had to tape everything because clearly he believes and is akin to ,what goes on in the outside world is not conducive of what's happening on the inside world aka how he makes the world perceive him. But without world view and in which it doesn't affect his outside persona he uses home brands.
If I had to reinforce this about him there lies my truth.
I believe his glasses are not real , GT has done every psychological trick in the book to appear he is a fair, liberal contributing part of the community .
He even has been wearing blue haha(associated with royalty and truth) GT must have googled that one"what to wear to court"

IMO he is extremely dangerous
 
Did you hear such a threat voiced by Warriena on the recording in between the thirty-three times she screamed 'No!', the number of times she asked to go home, her feeble 'help...' or her screams whilst hitting several balconies as she fell 14 storeys to the concrete below? I certainly didn't.
I heard her call him the 'f' word right in the middle, which demonstrates she wasn't overly scared of him, or intimidated by him.

What also wasn't on the tape was her screaming for the neighbors to call the police. Where is the frantic panic? Why doesn't she smash through the door?

The tape also didn't record her thoughts, or her intent. Everyone is speculating at best.

All i know is if Warriena didn't meet up with GT on the night she would still be alive and back home with her family. And i'm sure at her age GT wasn't the only guy she had ever been with and tried to have some fun with. But she met a devil IMO.

Please explain how you restrain someone, even though they are smaller than you, and keep them from gouging your eye. It doesn't sound like the physical altercation is solely one sided.

It's not all nice and neat like a Bruce Lee movie, or like it is on TV. Even so called "self defence" techniques are not a guarantee of anything.

She wasn't out cold, or unable to walk on the balcony. In fact, she felt physically able to climb off the balcony.

Shoving her outside could also be interpreted as "de-escalating" the situation so she does not experience GBH.

Very similar to any bar bouncer escorting a beligerant drunk outside, who is resisting, and screaming "you're assaulting me" or "don't touch me".
