Mr. Rector does not want to communicate with the assigned county attorney; Mr. Rector reinvokes his right to silence, and his right to be represented by defense counsel. Mr. Rector wants all communication from the assigned deputy county attorney, or any State agent, regarding this case, to be directed to his undersigned defense counsel, not him.

RF pleads guilty to drug charges -- looking at some jail time

"...... 28-year-old Ralph Pat Leroy Folster III pleaded guilty Friday to six counts of selling methamphetamine. He also pleaded guilty to one count of weapons misconduct as a prohibited possessor.

Folster's plea agreement calls him to be sentenced to 10.5 and 35 years in prison."

Wow! Thanks for finding this - it's a must-read! Ugh, pretty much what we all expected... I remember the video of Tania slapping her fist into her hand, saying "I'm a good mother." SMH.

Caseworkers also opened an investigation in 2008 after reports that Tania was selling meth around her daughter. The workers also stated that Tania often left her daughter with her “drug friends.” Workers also cited poor conditions inside the home.

I still don't understand WHY Tania Grogan was not charged with child neglect? She had a history with authorities, I know child protective agencies do help lots of kids BUT it is the little ones left in abusive and/or neglectful homes that really make me SMH. Who knows what will come out when this trial actually starts? I can't even begin to speculate....

I know, right? I'm hoping LE is biding their time since Tania will be a witness at JR's trial. Maybe the DA wants to keep her calm and in good shape for testimony. We may still see charges brought after Rector's dealt with. I hope so anyway.

Tania plans to plead guilty.

... Grogan has agreed to a plea offer and asked Superior Court Commissioner Billy Sipe Jr. to set a change of plea hearing. The judge set Grogan’s hearing to June 4.

Folster also admitted to having two prior felony convictions out of California. Five other charges were dropped. Arizona Department of Child Safety report dated April 1. Ralph isn't named but Bella's bio dad is - I think it's only because he's her dad. The report notes that:

DCS has received no prior reports of abuse or neglect involving Isabella Grogan-Cannella and Justin Rector or Roy Cannella. DCS has received five prior reports of abuse or neglect involving Isabella GroganCannella and Tania Grogan:

On November 13, 2012, a report was received alleging physical abuse:

... due to Isabella stating her mother slapped her on her face and head. Isabella was observed to have a small bump on the right side of her head and a red mark on her right cheek. Originally Isabella said she fell and Ms. Grogan reported she had bumped into a door.

A second call was received the next day and categorized as a Status Communication. The caller was concerned that Ms. Grogan became angry and appeared to be in a "rage" after being confronted about not following the proper drop-off rules at Isabella's school. The caller stated this type of behavior is completely out of character for the mother. An investigation was initiated and Isabella stated the mark and bump on her cheek were from accidentally running into a door.

What a sad, sorry mess. It seems that Bella was terrified of her mother and at the same time terrified of losing her mother. Poor, sweet Bella. :(

In another motion, Gavin argued that the judge must not communicate with the jury after a possible guilty verdict is read since the judge may learn theories why the defendant was convicted. That knowledge could affect Jantzen’s sentencing options on whether or not to accept the jury’s sentencing decision.

Prosecutors are not liking some of the motions:

Prosecutors are opposing a motion that an Arizona man charged with killing an 8-year-old Bullhead City girl be allowed to appear in civilian clothes and without restraint at all court proceedings including his trial.

Seems like Rector was his own snitch in those telephone conversations.

Sheriff's response to motion regarding restraints:

"The Sheriff opposes any ruling that attempts to allow the Defendant to be unrestrained and/or in civilian clothing for proceedings that do not involve his jury while he remains in the custody of the Mohave County Sheriff.

Blah de blah poor JR blah blah publicity blah blah blah... like what he wears to court will have any viable impact on how jurors view his crime. Ugh. I understand the motions are standard for death penalty cases and the trial needs to proceed by the book but half of these motions could have been handled in the attorneys' offices.

C'mon JR - make good on your word and just plead guilty. I could live with LWOP, especially if defense plans to call Bella's sister for testimony. I haven't heard that it will but it's always a possibility. :no:
