The defense team is sifting through more than 1,200 pages of evidence and more than 32 digital video discs and compact discs. Gavin estimated there are about 15 civilian witnesses, not counting expert witnesses for the prosecution and the defense, to interview.

Gavin and Gilleo have also hired a mitigation expert, Rennee DeSaye, who will assist in the mitigation presentation of the trial and assist with plea negotiations. Since the attorneys only got the case in March, plea negotiations have not started. Gavin said he expects to schedule a settlement conference, which explains the details of any plea agreement to the defendant.

I'm not a lawyer but as far as I can see, the state has Rector dead to rights so the only plea negotiation would be LWOP in exchange for a guilty plea. As I said earlier I can live with that if it spares Bella's sister from testifying.

OTOH I'll support Grandma Sue's wishes, whatever they may be. She's the best person to judge whether or not Bella's sister can withstand testifying.

Rector's defense wants to block testimony from her survivors

http://kdminer.com/main.asp?SectionID=1&SubSectionID=1&ArticleID=66017

KINGMAN - Defense attorneys for Justin James Rector, a Bullhead City man who could face the death penalty if convicted in the murder of an 8-year-old girl Sept. 2, filed court papers last week that seek to keep the child's survivors from telling the jury how the death has affected them.
(snip)
Another court document defense attorneys filed is perhaps more interesting due to its timeliness and the fact it addressed Rector's mental health.

Specifically, prosecutor Greg McPhillips wants Rector to be evaluated by a specialist who would try to determine whether he was sane at the time of Grogan-Cannella's death.

According to reports, Rector has a methamphetamine addiction and had been awake for several days prior to the incident. He allegedly drank a few beers and consumed cough syrup in an effort to "come down" on the day the girl went missing sometime after midnight.

 i'm so over this already.......good god.......this poor child

Such foolishness and waste of court time with all these ridiculous motions/requests. Seriously....restrict emotion in the courtroom? We are talking about the murder of an 8 year old child and you expect witnesses to remain emotionless? Thankfully the Judge has denied, denied, denied the requests. Let's not lose sight of Bella's rights to justice! This whole thing makes me sick. The lot of them deserve the worst we can throw at them.

nothing in MSM or on court website as to the outcome of Freddie's hearing that was to have taken place on the 8th.....

I wonder what will happen with the new baby. Sadly, will likely be born with drug dependency issues.

Fortunately, she's been in jail the majority of the pregnancy, so hopefully the drug exposure was minimized. If the baby's a girl, how many want to bet she'll name her Angel, Heaven, Neveah, or Bella, or at least include one of those names as a middle name??? And she'll probably hyphenate the last names again.

Who is going to take care of this baby? The grandma raising Bella's sisters is her paternal grandmother, so no relation.

from website re FN there was no mention of May hearing at all but on 22 May 2015 there was a notice to vacate from P1 (prosecution)......hopefully there will be further news on this

Reminder - Tania's due in court on June 4 (Thursday). She's expected to plead guilty to charges of conspiracy to sell dangerous drugs, sale of dangerous drugs and possession of drug paraphernalia.

Tania had a baby boy!

Tania Grogan, 27, was released last week on a furlough from the Mohave County jail to give birth. Her whereabouts, and if she had given birth, were unknown for several days. On Friday, the Bullhead City Bee learned Grogan gave birth around 2 p.m. Thursday at Kingman Regional Medical Center to a baby boy.
...
The baby is also said to be in her custody at this time, but will be placed in the care of family after Grogan returns to jail, said the friend.

Wonder who the baby will be placed with. I hope he will be safe and happy.

The notion of him being placed with "family" is concerning. At least we know Ralph's mother Freddie won't be the chosen one. But I can't even begin to imagine who in his or Tania's family would be a good choice to place the baby with. :(

Grogan, 29, must check back into custody by Wednesday morning, according to the terms of the furlough, Rideout said. She will enter a plea agreement resolving her drug charges Thursday. Rideout said the deal with the state will result in a multi-year prison term for Grogan.

Rideout said Grogan’s newborn and an older sibling will be in the care and custody of family while she serves her time.

"While she serves her time?" Ugh, I hope that doesn't mean she'll get her kids back when she gets out. :(

Hopefully we will hear something too about FN......

Freddie's sentencing is July 9. Tania's hearing postponed to June 15. CPS has Tania's older daughter and the baby.

KINGMAN — The attorney for the mother of a Bullhead City girl murdered in September did not show up for Thursday’s hearing, delaying her plea agreement on drug charges for at least two weeks.
...
In an earlier hearing, Nicholson, 59, pleaded guilty to felony conspiracy to sell dangerous drugs. Under her plea agreement, she will be sentenced to either probation or prison for up to more than 12 years. Sipe is scheduled to sentence her on July 9.

Deputy Yavapai County Attorney Kevin Schiff said there was a miscommunication in Grogan’s plea agreement and did not object to the continuance. Schiff also told the judge that he is recommending that Nicholson be sentenced to probation. The prosecutor said that Nicholson’s role was to bring drug buyers, including a confidential informant, to the house.

(No RBBM for this one, no offense to you
MsMarple :loveyou:

So, TG's attorney doesn't have enough respect for the Court to bother showing UP? Yet, manages to get the hearing delayed 2weeks? If the baby isn't in her custody, where the :censored: is TG?

She should be back in :jail: NOW!

There is absolutely NO reason for the furlough to be extended, as she's not personally caring for the child! The Judge didn't object, but couldn't he have ordered TG to report in tomorrow? I would have!
:judge:

What in tarnation is going on here? It feels like the inmates are running the asylum :cow: Or am I missing something?

:twocents:

It's unclear to me from reading the link whether TG is back in custody or not. The continuance is related to the extension of the date for her to appear with her attorney in court ((that's how I interpreted the MSM article)). It's possible she did show up in court but her attorney did not? Unclear to me MOO

Glad that FN took the plea - let's see what July 9 brings for her......

Back at you, Kimi! :loveyou:

And curious, yeah? The earlier article said Tania was to be back in jail on Wednesday for her Thursday hearing. I'm taking it to mean she's back in jail but didn't attend her hearing because of her attorney's no-show. But who knows?

I'm counting on that mandatory 5-year sentence she's supposed to get. I suppose they'll give her credit for time served? And let's hope CPS has long-term custody of the kids, if not permanent custody aka termination of parental rights. Neither Tania nor Ralphy should ever see them again.

Interesting, ETA: MsMarple ( :blushing: time for more :coffeews: ).
Thanks for refreshing our memories on the timeline. I wish the journo would have included that, or bothered to update TG's status. It's not like #WeThePeople aren't interested or anything! :thud:

Perhaps we need to reach out to the writer to ask for an update. Do you happen to recall which article this was mentioned in? I don't mind sending a tweet or an email....

Or, perhaps this is searchable on the jail's website?

Hey Kimi, don't you be calling me Queen Bee - she'll come along and put the sting on me for invading her hive. ;)

Here's the link:

Grogan will go back to jail before entering a drug sale plea agreement in June, Rideout said. He said the deal with the state calls for imposition of a five-year prison term.
