Tucson suspect charged with murders of judge, aide

PHOENIX (AP) - The suspect in the Tucson shootings that critically wounded U.S. Rep. Gabrielle Giffords was charged on new counts that include the murders of a federal judge and a congressional aide, according to an indictment released Friday.

A federal grand jury returned the 49-count indictment Thursday, charging Jared Lee Loughner in the deaths stemming from a Jan. 8 shooting at a political event held by Giffords outside a grocery store.

Jared Lee Loughner Charged With Murder Of Giffords Event Participants In New 49-Count Indictment

Here is a very good article reporting on this indictment and discussing how it is different than just your normal everyday, run of the mill federal indictment.

For one thing, it includes charges of murder of non-federal employees who were participating in the event held by Giffords (D-AZ) back in January.

"With today's new indictment, Loughner has now been charged in all six deaths in the Jan. 8 shooting. Previously, he'd only been charged with two deaths. Loughner has now been charged in connection with injuring all 13 of the people wounded that day. He had previously only been charged with the attempted murder of Giffords and two of her staffers. He's now been charged with 10 other counts of "injuring a participant at an activity provided by the United States." Loughner could still face state criminal charges."

The bad part about charging all the murder counts on the federal indictment is that if they don't get a death sentence, then the state cannot prosecute due to double jeopardy.

A person with direct knowledge of the decision told The Associated Press that U.S. Rep. Gabrielle Giffords will attend the launch of her husband's space shuttle in April.
The person spoke on condition of anonymity because the family and doctors have not yet publicized the decision. A news conference was scheduled for Friday at the Houston hospital where Giffords is undergoing rehab.
 
Judge orders mental evaluation for Loughner to take place in Missouri

The evaluation will be videotaped and provided to prosecutors and defense attorneys, U.S. District Judge Larry Burns said late Monday. The judge also ordered that it be conducted no later than April 29.

Prosecutors had argued that Jared Lee Loughner's exam should be conducted at a so-called medical referral center that provides forensic services and has increased resources and recommended the federal Bureau of Prisons facility in Springfield, Mo.

Loughner's lawyers have said the exam should be done by an outside expert at a Tucson prison and wanted assurances that the evaluation doesn't expand into a review of their client's sanity. Lead defense attorney Judy Clark wrote in a court filing last week that moving Loughner would harm the defense team's efforts to develop an attorney-client relationship.

The court’s order, issued Monday, says Loughner’s evaluations — including those scheduled by the defense — be videotaped and copies provided to both prosecution and defense.

“Only the defense should receive a copy of the examination videotape,” the attorneys argued in the court documents.

“These are bells that cannot be unrung,” the motion read.

Psychiatrists and other professionals at the U.S. Medical Center for Federal Prisoners in Springfield have been asked to determine whether Loughner is fit to stand trial.

Daniel Hernandez, the hero intern credited with helping to save the life of Rep. Gabrielle Giffords after the tragic shootings in Tucson, Ariz., says he has spoken with the Representative by phone, most recently on Wednesday.
"It's great hearing her voice," the Hernandez told the Arizona Republic. Out of privacy he did not comment on what was specifically said with Rep. Giffords.
"Pretty soon you will be able to ask her yourself because she's just doing extremely well and recovering very quickly," he said. <snip>
The astronaut also said his wife is also beginning to learn about the horrific shooting in Tucson that nearly took her life. While Giffords apparently did not remember the attack, Kelly said that she is now beginning to cope with the tragedy.<snip>
The mission commander spoke to the press with members of his crew, who are set to fly space shuttle Endeavor's final mission next month. The court had denied a request by Loughner to halt the exam, but put on hold U.S. District Judge Larry Burns' order requiring that videos of the exam be given to lawyers on both sides. Burns has since proposed removing the recording requirement. Prosecutors say the appeals court should agree to the changes proposed by Burns.

It has been three months since Rep. Gabrielle Giffords was critically wounded when a gunman opened fire at her constituent event north of Tucson, Ariz.
The attack was so devastating that many news outlets reported the Arizona Democrat had died. Even after it was confirmed she had survived, the situation appeared grim as details trickled from University Medical Center in Tucson.
Giffords had been shot at point-blank range in the head.
The 9mm bullet had pierced the skull above her left eye and traveled through the left side of her brain and out the back.
Doctors were monitoring her round-the-clock, and they were measuring milestones over hours, not days.
Three months later, snippets from various interviews with Giffords' doctors have painted a much more optimistic picture.
Miraculous.
Lightning speed.
Leaps and bounds.
Since Jan. 26, Giffords has been undergoing intensive rehabilitation at TIRR Memorial Hermann in Houston.
Although suited guards flank the elevators — the only indication that a higher-profile patient or visitor might be at the hospital — here the congresswoman is just "Gabby."
Gone, for now, are the congressional hearings and the long flights between the nation's capital and Arizona. Now, Giffords has only one job: to recover.
Each day, Giffords undergoes several hours of speech, physical and occupational therapy.
All day, patients and their therapists stream in and out of the main rehabilitation gym, about the size of a high-school basketball court. An oversize quote from the hospital's founding doctor adorns one wall:
"Man uses the tiniest strengths for the greatest purposes."
Against the other walls are colorful exercise balls and traffic cones. A few treadmills, simple exercise bikes and piles of mats fill the room.
Most people are surprised by how basic the equipment can be, said Victoria Miller, a physical therapist at TIRR who has not treated Giffords. They expect complicated, futuristic robotics.
"That's the myth about rehab facilities," she said.
But therapy in this case — the art, the arduous work of regaining basic life skills after traumatic brain injury — is largely a human-to-human endeavor, with each patient in the room working with someone else who coaxes him or her to take another step or to reach out a little farther.

PHOENIX &#8212; Prosecutors have asked a federal judge to order doctors who have treated the suspect in the Tucson, Ariz., shooting rampage to turn over all his medical records.

Psychiatrists trying to determine whether Jared Lee Loughner is competent to stand trial have told prosecutors they need the records for their evaluation. Their request includes pediatrician, high school and other childhood medical records.

Tucson shooting suspect's school releases records

"Nearly 3,000 pages of documents released Friday by an Arizona community college show how school administrators struggled to keep up with a flood of media requests and protect its own image just after the Tucson shooting rampage.

In the thousands of emails and documents released by Pima Community College on Friday, none was dated before the Jan. 8 shooting and most were requests by members of the media for information on Jared Lee Loughner, the suspect in the shooting that killed six and wounded 13, including Rep. Gabrielle Giffords...."

IMO, he's being a jerk for going on this flight. This is a stress that Gabby doesn't need. I'm sure Challenger and Columbia will be going through her mind. He should have turned it down and spent time with his wife.

IMO, he's being a jerk for going on this flight. This is a stress that Gabby doesn't need. I'm sure Challenger and Columbia will be going through her mind. He should have turned it down and spent time with his wife.
True, but he won't have many more opportunities- they're retiring this shuttle fleet, and if he cancelled it would be letting Loughner win in a way...

It could also be that Gabby wouldn't have it any other way. I'm hoping they discussed it and she wanted him to do this.

C'mon, I've dated more than enough women to know what they say and what they mean are two totally different things.

I don't want you to make a big deal for my birthday.

It's just Valentines day, you don't need to do anything special.

She said she wanted him to go but if he had refused and stayed with her it would have meant a lot more to her. It's like that royal guy who gave up his royal ties to marry a divorcee. JMO
