It appears that it was Novi who made the representations for leniency for HM. I wonder why western publications are reporting that it was Ary/Ray. Perhaps that is what they are being told, so that Ary/Ray can publicly justify his big buckaroonies. Or maybe he and Novi were present, though I only saw Novi in the photos.


“We ask the panel of judges to reject the prosecutors’ demand. We hope the judge can decide and give a lighter, fair sentence,” said Mack’s lawyer, Ni Kadek Sri Novi Wirani. Novi said Mack did not deserve a 15-year prison term.

The legal team added that accusations that Mack had facilitated premeditated murder could not be proven during the trial.

“At that time, the defendant helped as she was frightened. [The incident] happened too fast, she panicked.


In the indictment, prosecutors said Mack asked Schaefer to find a hit man to kill her mother before the incident took place.

In a separate trial on Tuesday, Schaefer’s legal team also asked for a lighter sentence.

Andris requested the judges to consider that Schaefer had never committed a crime and had shown remorse over the murder.

“He also has a baby from Heather. He’s still young and can reform himself,” Andris said.

They can say anything they want it appears. Sheila is not alive to dispute any of the lies. Non of her family are there speaking with the Indonesian media to refute anything. The Indonesian language media is not reporting on the trial anymore, likely paid off by Ary to stay away from this case. There is nothing being reported about the money Ary requested and received in any Indonesian language news to make him accountable for that money. Unlikely that the majority of Bali residents read The Daily Mail or any US publications. Most of them likely know nothing about this case nor do they care about two Americans who killed another American. All of the lies HM and TS told in the beginning, including accusations of mistreatment by Indonesian LE have been forgiven it seems. The prosecution is not pressing the damning premeditation text evidence but rather is calling for leniency. The defence is just rewriting the whole narrative for about the 5th time for the least possible prison time for both of them.

I seriously believe that the unmasking of the baby was another ploy to garner sympathy and help to justify a more lenient sentence -
and seeing that the legal team for both HM & TS seem to be using the child as a pawn in their defence case, sighting that they are both new parents, I believe they have set the bar at a new low -
... its about 6 foot underground now.

How much money from the trust did HM's attorney ultimately receive? And did he ever present an itemized bill as required?

Following this trial and watching this injustice is sickening, irritating, and depressing. It makes me think this must be the illogical justice on another planet. A place where two brutal killer-murderers escape the firing squad, while others are not afforded a second chance or sympathy because they carried drugs. That's cray-cray. :crazy:

The world is watching. No way would I want to go to such an illogical and corrupt place to vacation.

Roughly translated, Stella cried. And she was watched by friend Heather Oza.

Does this mean the baby was moved out of the prison because she cried and kept the other prisoners awake? If so, I'd be in favor of her friend watching it. I can't bring myself to call the baby Stella, knowing it was named after Tommy's relative, when it should have been named in honor of Sheila, another slap at her!

Prison officials have confiscated HM's Iphone. I wonder if this was during the same search that discovered another female prisoner's meth stash.

The 19-year-old’s phone was confiscated on Sunday by an officer, according to Kompas.

“Yeah, I’ll buy another one,” Mack said, as quoted by Kompas.
 
No new entry on the CH case motion of 4/7(really wasn't expecting one since the motion was a counter one). It's too bad that we don't get a better and complete report of what testimony is heard and everything that takes place in the courtroom in Bali. Regarding whether or not the phone texts b/t HM and TS came in I don't know but I thought (Sorry, I don't have time to go back and find it) I read a defense attorney's response/argument to the panel, about them or maybe it was the hotel computer communications saying "they were not to be trusted because the technology could be manipulated" or something along that order. I know @ the time I thought to myself, "oh they did get in after all" but now I am uncertain...anyone else remember that? I know (or don't think) it was in reference to the emails released by EJ by an American lawyer, it was for sure a Bali defense attorney. I admit I am mystified by the Indo legal system when they have gone so hard for the drug offenders historically but murder b/t non citizens is treated almost in a laissez faire fashion. I'm sure there are political and cultural reasons behind it but I still find it hard to understand in full.

No. Unfortunately that was the news coverage from an Indonesian language publication about that day in court. Nothing about the court proceedings, only a brief story about Stella crying and HM's "close friend" watching her while HM was in court.

You know I was going to ask that question when I posted the meth story. If they were searching female prisoners, why didn't HM lose her illegal cell phone? But then I figured they had pretty much resigned themselves to the fact that prisoners were going to get cell phones and don't bother to confiscate them anymore. Nice to know they still do although it took them long enough. Which indicates that no one in Indonesia is paying attention to what she's doing in the U.S. with regards to calls, video chats, social media and statements to Chicago news reporters or they would have gotten it off her months ago. Wasn't it reported that she was using it at the hospital too? How is it that a prisoner can walk around with bags and purses that are not being checked on the way in or out of the prison?

Maybe they're just getting fed up with her. Or a prison guard has tagged her as an easy patsy for getting cell phones that they can turn around and resell to her. I see she's her usual defiant self. "I'll just buy another one". Oh please cut her off all funds.

Interesting isn't it - that her funds are paying for an illegal cell phone and an illegal cellphone replacement.
I hope that Judge Cohen is aware of this.
...and that is the possibility of a *cough* forged receipt which should be amended.

The indictment also alleges that Mack asked her boyfriend to locate a hitman to kill her mother, who reportedly didn't approve of her daughter's relationship with the aspiring rapper. "In the text messages between them," prosecutor Eddy Artha Wijaya said in last week's indictment, "Heather Lois Mack and Tommy Schaefer agreed to take the life of Sheila Ann von Weise-Mack by smothering her face with a pillow and making it look like a suicide attempt."
In Wednesday's session, Schaefer's attorney argued that the judges shouldn't put any credibility in text messages allegedly sent between the two because they "are prone to manipulation, given sophisticated information technology," according to the Indonesian newspaper.

Schaefer described it as self-defense, but prosecutors allege that the woman's violent death was premeditated and that the young couple even exchanged earlier text messages in which Mack asked Schaefer to find a hit man for $50,000.

In the opening address of the trials, prosecutors alleged that before the Bali holiday that Mack had asked Schaefer to find someone to kill her mother for $US50,000.
They also alleged a series of text messages between the two were evidence of premeditation, where they are alleged to have discussed suffocating Mrs Mack with a pillow and making her death appear like a suicide.
 
It's ironic that the text information, two different sets of texts discussing the murder of SWM, were presented by the prosecution in the Bali court on or around Jan 21st, the same day that Cohen made his ruling that HM could have the $150,000 that she was requesting for her "defence". And then they were never mentioned again. Not even in the prosecution's sentencing charge a couple of weeks ago. :waitasec:

Okay maybe it's not all that ironic. :rolleyes:
