Former DA says he essentially granted Bill Cosby lifetime immunity from prosecution in sex assault case
He acknowledged that he didn’t draw up a formal immunity agreement filed with a judge because, he said, Cosby was afraid that would make him look bad. Also, Castor said, “It was unnecessary because I concluded there was no way the case would get any better.” And he said Cosby’s lawyers did not insist on such a document.

The sexual assault case in Pennsylvania against Bill Cosby will go forward. A judge in Montgomery County ruled that the criminal case stemming from alleged unwanted sexual contact Cosby had with Andrea Constand will proceed.

This ruling doesn't surprise me........I wouldn't have bet too much but I kinda expected this to be what happened at this level.

A higher court overturning it is a better chance for Cosby .....IMO
I hope not and if you are using Castor's statement as evidence as immunity you also have to consider the last part where he says he may pick the charges back up at a later time.You can't cherry pick which part you decide to use.

I really don't like the "smell" of what little I have read about Castor's testimony......he claims to have granted lifetime verbal immunity while releasing a statement saying otherwise.
Something about Castor doesn't sit right with me about this.I fully respect a DA thinking a suspect is guilty but not proceeding with charges because there is insufficient evidence.But to say you believe the victim and then turn around and claim to have granted a lifetime immunity because the victim has credibility issues .......just doesn't add up for me.

Castor trying to claim the current DA may face personal liability concerns for trying to prosecute Cosby is pure insanity as far as I am concerned and what started me to question Castor's actions in all this.

I know Castor had past political ambitions .......how they fit in time line wise with this Cosby case I am not sure.But in 2005 charging Cosby in any case that did not involve a smoking gun would quickly kill any of those political ambitions Castor may have had at the time.

The following sentence, in my opinion, was the genuine reason that the Motion was denied:

“A secret agreement that permits a wealthy defendant to buy his way out of a criminal case isn’t right,” argued District Attorney Kevin Steele.

I believe that not only the wealth that Cosby had accumulated but his fame was the reason many of the women were never believed. The Judge yesterday saw through this and this was precedent-setting. No matter how this trial plays out - this judgment spoke to truth and not allowing wealth and fame to deter getting to the truth.

The problem is Phillips died last year, leaving only one side of the party to testify to it. What's more, Castor shied away from actually calling it an agreement — he demurred when pressed by attorneys. O'Neill sought to clarify: "So it was an agreement with yourself?"

Equally problematic for the defense was the phrasing in the news release. Castor wrote in it that he would "reconsider this decision should the need arise" — fairly open language that leaves room for it to be recanted.

I didn't know that Cosby had set up his daughter, August. BC's actions in that regard make him look even worse. Bill Cosby Loses Appeal to Have Sex Charges Thrown Out

Montgomery County Judge Steven O'Neill, though, found the evidence of such an agreement lacking after hearing from the ex-prosecutor and others at a two-day hearing. He said the issue doesn't warrant an immediate appeal that would delay the scheduled March 8 preliminary hearing.

"An immediate appeal from these orders would not materially advance the ultimate termination of the matter," the judge wrote in a brief order.

A spokesman for Cosby's lawyers said it was unclear if they would appeal to the state Superior Court.
