Pillay says Millard didn't know there was a gun, and didn't think anyone would get hurt on May 6.
by Adam Carter 9:50 AM

Pillay says Millard is not unintelligent - was involved with businesses, could fly a helicopter, etc.
by Adam Carter 9:51 AM

"The murder was not planned and deliberate," Pillay says.
by Adam Carter 9:51 AM

@susanclairmont Must consider the planner, alleged to be Millard. "He is not unintelligent." He can pilot planes, helicopters, boats, runs a business...

He's manipulative and controlling. As we saw from his own words in his own letters. He was also running his father's business and legacy into the ground.

"The evidence shows you that Mark Smich has lied to you," Pillay says.
by Adam Carter 9:52 AM

"The evidence shows Mr. Millard did not know Mr. Smich had brought a gun with him on the test drive," Pillay says.
by Adam Carter 9:53 AM

Pillay now talking about the demeanour of Millard and Smich at the Bosma home. Millard "instilled trust," he says. "He faced them, he was friendly."
by Adam Carter 9:53 AM

I haven't followed any other trial like this.....so basically in closing arguments, Pillay can relay DM's "story" even though absolutely no evidence was presented to back it up?

"He didn't attempt to hide in the shadows."
by Adam Carter 9:54 AM

"Consider if this behaviour is consistent with the intention to kill," Pillay says.
by Adam Carter 9:54 AM

"The Crown says Mr. Millard knew he would murder Mr. Bosma ... is this the demeanor of a man who is about to kill another man?" Pillay asks.
by Adam Carter 9:55 AM

Uh, what business did he run?? Just days after his dad died he fired every employee but SS.

"The Crown says Mr. Millard knew he would murder Mr. Bosma ... is this the demeanor of a man who is about to kill another man?" Pillay asks.
by Adam Carter 9:55 AM

Well...it is, if the killer is likely psychopathic.

Pillay says the fact that there were no "common sense measures" to protect his identity show that Millard had no plan to kill.
by Adam Carter 9:56 AM

Pillay says there's a "clear contrast" between Millard and Smich. "He stayed in the dark. He did not make eye contact."
by Adam Carter 9:57 AM

Pillay shows how Smich made eye contact with the jury during his testimony. "Think about that."

"Does the demeanour of Mr. Millard reveal such a plan? Is this the demeanour of a man who is about to kill another man?" #Bosma

ok...BUT we know they planned on stealing the truck.....so is this the demeanour of someone planning on stealing a truck? NO. He's a sociopath/psychopath/some other kind of path......and had complete control of his emotions.....MOO

If it happened as DM and his legal team claim, why did DM create the elaborate scheme in his letters to frame MS on a fictional story?
Why did he not cooperate with LE?
Why did he take on most of the clean up?
Why did he buy the Eliminator?
Why did he buy the gun?

I am sure we will hear how they address these questions.

MOO

"He was clearly trying to hide something," Pillay says.
by Adam Carter 9:58 AM

He says that demeanor shows that Smich knew what was coming.
by Adam Carter 9:58 AM

Pillay now mentioning the other thefts. "Mr. Millard is not a reckless person when it comes to these thefts," Pillay says. He's "methodical."
by Adam Carter 9:59 AM

"No one in their right mind would advertise their intention to steal a truck if that plan included a murder," Pillay says. Yet "everyone in Millard's world" knew Millard wanted a diesel Dodge truck.
by Adam Carter 10:00 AM

Andrew Michalski knew. Javier Villada knew. "If his intention was to murdrer for this truck, he wouldn't have left a picture on a screen for all to see."
by Adam Carter 10:01 AM

Lisa Whidden also knew Millard wanted a truck, Pillay says.
by Adam Carter 10:02 AM

He's showing texts to Whidden about the truck on May 5, right before the Bosma test drive.
by Adam Carter 10:03 AM

"Why would Mr. Millard casually volunteer that he's working on getting a truck on May 5?" Pillay says. "An intention to kill was nowhere in Mr. Millard's mind."
by Adam Carter 10:04 AM

That others knew about the plan to steal a truck "completely obliterates" any suggestion of a plan to murder, Pillay says.
by Adam Carter 10:05 AM

How sad that the only way you can say your client is innocent is by mentioning that all his other crimes were much better planned.

If the plan was to murder, "why not keep every part of the plan secret?" Pillay asks.
by Adam Carter 10:05 AM

They were looking for a truck while Marlena Meneses was in the room, Pillay says.
by Adam Carter 10:06 AM

They didn't get along, yet Millard was "talking openly" about it in front of her, Pillay says. "It's creating evidence against you before you even commit the crime. It makes no sense at all."
by Adam Carter 10:07 AM

How sad that the only way you can say your client is innocent is by mentioning that all his other crimes were much better planned.

SO SO true. "All the other times he has been a criminal he was much smarter than this. I promise. Pinky swear."

Pillay now says Millard's failure to clear his browsing history also shows he was not planning to commit a murder.
by Adam Carter 10:08 AM

Pillay now showing that browser history that show Millard accessing the ad for Bosma's truck.
by Adam Carter 10:10 AM

Pillay says not clearing the browser history shows the risk Millard saw was not very great. "Mr. Millard could not possibly be planning a murder."
