Did he really just imply Stolz "lied" about the time stamp?...

Never mind. "Forget". Okay.

Pillay says that because this is a rural area, it's unlikely that a similar truck would be travelling past the camera twice. "That renders the probability of random chance even more remote."
by Adam Carter 12:44 PM

"The video camera does not lie. It does not forget. Officer Stoltz? That's another story," Pillay says.
by Adam Carter 12:45 PM

"The Supersucker video shows that Mr. Smich lied to you, under oath," Pillay says.
by Adam Carter 12:46 PM

Apparently Pillay has never spent time in farm country.

Except there is no proof all 3 instances of a truck on that video were in fact the Bosma truck. If the expert himself could not say if in fact they were the same truck, why does Pillay expect the jury to believe they were, that Smich lied, and happy-go-lucky Millard was just minding his own business while planning to steal Tim's truck and Smich shot him?

"The chances that these are some random vehicle ... are sufficiently remote," Pillay says. The expert agreed that they looked similar, but he couldn't definitively say they were all same truck. Also worth noting is that the expert could not say that any of the trucks in the videos were definitively Bosma's truck.

Or are they going to take back roads because there is less chance of anyone seeing anything suspicious? Which would account for the extra time getting to Bobcat. MOO

And you've got a driver without a licence that has never driven a highway before.

Pillay points out that Smich's lawyers didn't cross-examine about the timestamp. He says the video "stands before you as the truth."
by Adam Carter 12:47 PM

Pillay says there is no evidence to show that the Bosma was shot in the Book Road field. "When a gun goes off, it makes a sound," Pillay says. "There is no evidence before you that anyone in the area of the Book Road field heard anything that evening. Someone would have heard it."
by Adam Carter 12:49 PM

Pillay says Sharlene Bosma and Wayne De Boer would have heard a gunshot from the field.

I'll go with Pillay on this, I think its the same truck.

And as many who have commented here before, when you live in an area like this, you DO hear gunshots on a regular basis and they become part of the background noise all the time. You hear it so often you don't even notice it after a while. But since it happened inside Tim's truck, the sound would be considerably muffled, as opposed to being outdoors.

"The Crown's own witnesses, from that evening, hearing nothing," Pillay says.
by Adam Carter 12:51 PM

Pillay now talking about Rick Bullman seeing the truck and the SUV leave the field. "He would have been positioned ... to clearly hear the sound of a gun."
by Adam Carter 12:52 PM

"Mr Bullman was right there ... and he heard nothing," Pillay says.
by Adam Carter 12:52 PM

Wait, I'm confused. I thought they said he was shot on the 403 to Brantford? Does this work @ 923? I thought the timeline he just gave has them going to Bobcat at 930-947 (17 min)?

Totally forgot about that. You're right. That is what was proposed to MS while under cross.....guess they came up with a different version for closing arguments? MOO

ETA - Pillay's newest version of events sounds an awful lot like what the Crown proposed to MS during their cross examination....maybe DM took notes?

"Wouldn't his dog have reacted in some way to the sound of a gunshot?" Pillay says. Bullman was walking his dog.
by Adam Carter 12:53 PM

"No one heard a thing. Not even the the dogs," Pillay says. "This deafening silence is evidence that speaks loudly about the implausibility about the Crown's theory."
by Adam Carter 12:54 PM

Oh Pillay, the great dog whisperer.

Investigators also searched the field on May 7, alongside police dogs. Pillay says it would have been a thorough search, turning it "upside down."

And by her own accounts, she went directly into the house to watch TV. Not sure about WDB. MOO

"Where is the evidence of a shooting in that field? Where is the forensic evidence that a shooting took place in that field? Where is the glass ... where is the bullet?"
by Adam Carter 12:56 PM

"If a gun were discharged in that field, there would be some evidence there," Pillay says. There's simply no evidence Mr. Bosma was shot in that field."
by Adam Carter 12:57 PM

Now taking lunch. Back at 2:15 p.m.

by Adam Carter 12:58 PM

FYI: Will need someone to pick up Adam when court returns from lunch please & thank you :)

I'll go with Pillay on this, I think its the same truck.

This is my view as well for a few reasons:

  • Despite there being many Dodge Rams in rural country, these trucks vary widely in their appearance. The roof lights in particular are far less common feature.
  • It's a low-traffic road after 9pm on a Monday night.
  • It really does fit better into the timeline to adjust the Super Sucker video time stamp by a few minutes. It is fair to conclude that the exactly 3 hour adjustment might not be perfectly accurate.

Realistically, the odds of an exact-looking truck driving by within that time period are very low IMO.

BBM.... Uhm....and how does he know the dog didn't react? Maybe he started barking but Bullman didn't hear what the dog heard? This is getting ludicrous. MOO

While we all know MS is a liar, the logic of taking back roads into town makes loads of sense, especially considering they have a deceased man bleeding out in the front seat of a in a stolen truck. :( DM is arrogant but I honestly don't believe he'd be stupid enough to get on the 403 where the chances of seeing an OPP would be far higher than they would be on back roads.

Not to mention no one has ever come forward to suggest they were driving the exact type of truck on that road during the time in question. I find it very hard to believe that someone who was in the area that night does not know about this murder.

MOO

.

Pillay is blowing some holes in MS story , but to what advantage for DM ???? .... maybe he is just trying to make sure DM does not get a harsher sentence than MS (if that was even possible)
